BACKGROUND: The Skills Development Center (SDC) effectively opened for business on January 11, 1999, The partners providing services from this facility include the Orange County Literacy Council, the Joint Orange-Chatham Community Action (.IOCCA), the Employment Security Commission, Durham Technical Community College and the Orange County Department of Social Services for its Work First program. In order to establish consistent terms of tenancy in the building, leases are established with each of the non-County department partners. The term of the lease renewal extends through .)une 30, 2009, unless the partner no longer provides services consistent with the operation of the SDC or if they fail to meet performance standards established by the Skills Development Center Advisory Committee. Rent amounts are established in the attached leases far all partners, but with the exception of the Literacy Council, have been cited as in-kind support of the program, With the exception of the Literacy Council, the SDC provides space for satellite operations from which the partners provide jab readiness programs, However, the Literacy Council uses the SDC as their primary office location. As such, it will pay to the County a total of $600 per month in rent for use of the office space and common areas, In recognition that the County also makes an annual appropriation to the Literacy Council, from which any rent increase would likely need to be covered, the rent through the 2009 renewal period will remain at $600 per month.. FINANCIAL IMPACT: The Literacy Council will pay to the County a sum of $7,200 annually. The County supports JOCCA, Durham Tech and the Employment Security Commission with in-kind support of approximately $117,972. RECOMMENDATION(S): The Manager recommends that the lease renewals with Orange County Literacy Council, the Joint Orange-Chatham Community Action (JOCCA), the Employment Security Commission and Durham Technical Community College for space to be used at the Skills Development Center, 503 West Franklin Street, Chapel Hill, NC he approved for the period July 1, 2004 through June 30, 2009; and authorize the Chair to sign on behalf of the Board, STATE OF NORTN CAROLINA COUNTY OF ORANGE AMENDMENT TO LEASE WHEREAS a lease agreement was made and entered into as of the sixteenth day of February, 1999, by and between the County of Orange, a political subdivision of the State of North Carolina, hereinafter referred to as "County" and Durham Technical Community College, whose mailing address is 1637 Lawson Street, Durham, North Carolina 27703, (hereinafter referred to as Durham Tech.) W ITNESSETH: WHEREAS, the parties hereto have mutually agreed as herein set forth; Section 3 shall be modified to read as follows: TERM: The term of this renewal shall commence on July 1, 2004 and shall terminate on July 1, 2009, unless Durham Tech no longer provides services consistent with those offered at the Skills Development Center, or is unable to meet the performance standards as set out by the Skills Development Advisory Committee, under which circumstances this lease shall be terminated with sixty (60) days notice to Durham Tech. 2, Section 4 shall be modified to read as follows: RENT: Durham Tech shall pay to the County the sum of $109,176 per annum, payable in monthly installments of $9,098, each monthly installment payable on the first day of each month during the term of this lease renewal, This rent shall be suspended in favor of in-kind contribution from the County to Durham Tech. Except as expressly modified herein, all of the terms, covenants, and conditions of the lease are hereby ratified and confirmed to be in full force and effect. Baker, Clerk to the Board STATE OF NORTH CAROLINA COUNTY OF ORANGE AMENDMENT TO LEASE WHEREAS a lease agreement was made and entered into as of the sixteenth day of February, 1999, by and between the County of Orange, a political subdivision of the State of North Carolina, hereinafter referred to as "County' and Joint Orange Chatham Community Action whose mailing address is PO Box 27 Pittsbarc, NC 27312 (hereinafter referred to as JOCCA). Section 3 shall be modified to read as follows: TERM: The term of this renewal shall commence on July 1, 2004 and shall terminate on July 1, 2009, unless JOCCA nc longer provides services consistent with those offered at the Skills Development Center, or is unable to meet the performance standards as set otat by the Skills Development Advisory Committee, under which circumstances this lease shall be terminated with sixty (60) days notice to JOCCA. 2. Section 4 shall be modified to read as follows: RENT: JOCCA shall pay to the County the sum of $6,.552 per annum, payable in monthly installments of $546, each monthly installment payable on the first day of each month during the term of this lease renewal. This rent shall be suspended in favor of in- kind contribution from the County to JOCCA. Except as expressly modified herein, all of the terms, covenants, and conditions of the lease are hereby ratified and confirmed to be in full force and effect. Section 4 shall be modified to read as follows: RENT: The Literacy Council shall pay to the County the sum of $2,244 per annum, payable in monthly installments of $187, each monthly installment payable on the first day of each month during the term of this lease renewal, This rent shall be suspended in favor of in-kind contribution from the County to ESC.
