PowerPoint Presentation PURPOSE: To hold a public hearing, receive the Planning Board and staff recommendations, and public comment, close the public hearing, and consider action on a County-initiated Zoning Atlas Amendment to rezone +/- 69.58 acres (PIN: 9863-28-1858) located at 1125 New Grady Brown School Road, Hillsborough, within the Hillsborough Township of Orange County. The proposed rezoning is: FROM: R-1 (Rural Residential) TO: NR-CD (Non-Residential Conditional District) BACKGROUND: A Conditional Zoning Atlas Amendment application (Attachment 1) was received proposing to rezone approximately 69.58 acres of property at 1125 New Grady Brown School Road, Hillsborough. Orange County is the property owner on record of Cedar Ridge High School, which is located on the parcel. The Staff Report in Attachment 2 contains additional information, maps, and analysis in regard to the application's consistency with County-adopted plans. Approval of a site-specific plan is part of the conditional district rezoning process, and the site plan and any agreed-upon conditions are binding to the development permitted for the zoning district. 2 Basic Review Process: A conditional district rezoning application requires submission of a site plan and other documents, in accordance with Section 2.9.1(C) of the Unified Development Ordinance (UDO). Sections 2.8 and 2.9 of the Orange County UDO require the following review: • FIRST ACTION — Applicant holds a Neighborhood Information Meeting (NIM). Staff Comment: The NIM was held on January 9, 2025 at 5:30 p.m. at Cedar Ridge High School. • SECOND ACTION — The Planning Board reviews the application at a regular meeting and makes a recommendation to the BOCC. Staff Comment: The Planning Board reviewed this application at its regular meeting on April 9, 2025. • THIRD ACTION — The BOCC receives the Planning Board and staff recommendations at an advertised public hearing and makes a decision on the application. Staff Comment: The public hearing is scheduled for June 3, 2025. A formal site plan is required as part of a conditional rezoning application and has been submitted (Attachment 1). Orange County, in coordination with Orange County Schools, has initiated a Zoning Atlas Amendment in order to bring the existing Cedar Ridge High School site into compliance with the Orange County Unified Development Ordinance and to allow for future development. Additional background information related to this request is contained in the Staff Report (Attachment 2). Proposed Conditions Per Section 2.9.1 (F) (3) of the UDO, mutually agreed upon conditions can be imposed as part of this process if they address: a. The compatibility of the proposed development with surrounding property, b. Proposed support facilities (i.e. roadways, and access points, screening and buffer areas, the timing of development, etc.), and/or c. All other matters the County may find reasonable and appropriate or the petitioner may propose. Orange County Development Advisory Committee staff has recommended the imposition of conditions, as included in the Ordinance in Attachment 8. Public Notification: In accordance with Section 2.8.7 of the UDO, notices of the Public Hearing were mailed via first class mail to property owners within 1,000 feet of the subject parcel. These notices were mailed on May 19, 2025 — 15 days before the hearing. Staff also posted the subject parcel with signs on May 19, 2025 — 15 days before the hearing. See Attachment 3 for the notification materials. Planning Board Recommendation: The Planning Board reviewed the zoning atlas amendment at its April 9, 2025 regular meeting. At this meeting the Board voted unanimously to recommend approval of the Statement of Consistency (Attachment 7) and the proposed Zoning Atlas Amendment (Attachment 8). 3 An excerpt of the approved minutes from the meeting, as well as the Planning Board's signed Statement of Consistency, are included in Attachment 6. Planning Director's Recommendation: The Planning Director recommends that the Board of County Commissioners: 1) Consider the matter for action; 2) Acknowledge that legally-sufficient public notice was given for the application and this meeting, in accordance with State law and the Orange County UDO; 3) Review the staff report (Attachment 2), featuring analyses of UDO compliance, impact of the use to the surrounding area, safety and efficiency of land use, and consistency of the application with the Orange County's adopted plans; 4) Allow for the applicant's presentation of materials; 5) Conduct the public hearing, receive public comments, and consider the Planning Board recommendation; 6) Close the public hearing; and 7) Vote to Approve the Statement of Consistency (Attachment 7) and Zoning Atlas Amendment Ordinance (Attachment 8). FINANCIAL IMPACT: This request has been reviewed by various County departments who have determined that the approval of the request would not create the need for additional funding for the provision of County services. Costs associated with advertising, including the public hearing notice and mailings, were paid from the 2024-25 Planning and Inspections Department budget. Further I (we) understand that any assistance I (we) may receive from County staff in preparing this application in no way guarantees a favorable recommendation by staff on the merits of this proposal nor does grantee an approval of the proposed atlas amendment by the County. ` Owner Signatur (s) ' Iictt Signature (if different from owner) Date V Date Page 2of2 6 ORANGE COUNTY SCHOOLS 1/22/2025 REZONING REQUEST AND SITE PLAN APPROVAL NARRATIVE FOR CEDAR RIDGE HIGH SCHOOL The Orange County Schools is seeking a rezoning of the Cedar Ridge High School property from R-1 (Rural Residential)to NR-CD(Non-Residential—Conditional District).The rezoning will correct the legal nonconformity of the school being in this zoning district, which was created when Orange County amended its Unified Development Ordinance (UDO) text in 2021 and disallowed schools in the R-1 district. Approval of this site-specific zoning application will 1) bring the property into conformance, recognizing its existing development footprint as site-specific conditions; 2) allow for improvement of the property within a development envelope; and 3) create conditions for further school-related improvements to be approved administratively unless they present a deviation from the zoning standards or are a special use, as defined in the Orange County UDO. Approval of this zoning application is necessary for approval of all additions and external improvements to the existing buildings and structures, including the pending construction of an agricultural building. Orange County Schools would like to extend their agricultural program to include an agricultural building. The agricultural program is already in place at the school and so no new students will be added for this project. The 2,288 sf pole barn shelter will be located 200' east of the existing school. There is a new pedestrian connection from the existing school entrance to the new shelter.This will allow the Cedar Ridge HS agricultural program to be more like the one at Orange High School which has a barn. Emergency Services to Cedar Ridge High School are primarily provided by Orange County, as the school lies outside the Town of Hillsborough's incorporated limits; these services will not change due to new development on campus. Fire and emergency services are primarily provided by the Orange Rural District, with secondary services provided by the Efland District and Town of Hillsborough. The police services are provided by the Orange County Sheriff with secondary service provided by the Town of Hillsborough. The new building will not have any sanitary sewer facilities as they will be available in the existing school. An existing water line is present at the site. Both utilities are provided by the Town of Hillsborough. Power to the site is provided by Piedmont Electrical Coop who will set a new transformer near the shelter.All solid waste management will be administered by Orange County Schools and Orange County Solid Waste, as it is at present. This property is located in the Lower Eno River Unprotected watershed and must comply with the regulations of the Falls Lake Nutrient Management Strategy. Stormwater has already been provided to the proposed building site by the addition of a bioretention cell on the north end of the new site. This was installed during the last construction project at the school which was the classroom addition. Runoff from the new facility will be treated by this cell; a stormwater management plan for this application is not warranted. Page 1of12 7 ORANGE COUNTY SCHOOLS 1/22/2025 A USGS stream was shown at the location of the proposed Agricultural Laboratory but a Surface Water Identification performed by Orange County formally recognizes that this stream does not presently exist at this location on the property. All work on this site is interior to the school property. The 100' MTC setback and buffer are not disturbed. The site was cleared and graded under a previous contract and all new construction is done without clearing or significant earthwork. No new traffic will be generated due to this project. No changes will be made to the car or bus movements for the school. The anticipated construction schedule start is late spring of 2025 with completion in early 2026. The funding source for this project was under the previous budget year (FY 23-24) for accounts for Classroom and Building improvements provided by Orange County. Data on school student enrollment and staffing is found on Page 4 of this document. The Environmental Assessment and Biological Inventory (Page 5) confirm the lack of significant ecological habitat on this property; no additional protection measures are warranted. The site plan addresses the other use requirements of a "School: Preparatory",as found in Orange County UDO Section 5.8.4, including, but not limited to, landscaping, site access, and screening of the property from public rights of way, including compliance with the Major Transportation Corridor overlay district requirements. It is assembled from three (3) tracts featuring five (5) parcels and features a 60-foot public right of way that accesses the internal area of the "Orange County Board of Education" property from New Grady Brown School Road. The recorded deed and accompanying property description are attached to this narrative, satisfying Orange County UDO Sections 2.8.3(A) and 2.9. Orange County Schools is applying for a conditional zoning district to immediately allow for a new structure on the property to support an Agricultural Laboratory, and is requesting a condition to allow for further development of the property as a by-right zoning regulation. The school was constructed in 2001 and has a building footprint of approximately 270,022 square feet (6.20 acres), not accounting for the paved parking areas and walking paths. It was constructed prior to the regulation of stormwater runoff or nutrient management was required in this watershed by Orange County, the regulatory authority. Over half of the property is actively used for school purposes and, outside of the buffered areas on its perimeters and perennial streams, is generally managed and maintained as a lawn of fescue or Bermuda grass with ornamental shrubs. The property is located in the Lower Eno River Unprotected watershed, flowing into the Lower Eno River and, eventually, the Eno River and Falls Lake. There are no NC Department of Environmental Quality-identified "impaired" waters on site or downstream of the property. The property has two perennial streams on it: one identified in a 2000 site plan as Sand Branch, which defines the property's western perimeter; and an unnamed tributary ("UT") that transects the property east-west and feeds into Sand Branch.The UT was displayed by the US Geological Survey (USGS) as crossing the entire property but a Surface Water Identification conducted by Orange County Erosion Control and Stormwater staff identified an origin point immediately west of the high school's football stadium. It is possible that the construction of the campus in 2000 impacted the location and flow status of this stream. No wetlands are documented on site. The only possible wetland soils location is a band of Chewacla, a predominantly nonhydric soil, collocated with Sand Branch and its immediate area. No known Natural Heritage Elements or Element Occurrences have been documented on the property by the North Carolina Natural Heritage Program (NHP). Sand Branch and its riparian buffer zone are identified in the 2019 Eno-New Hope Wildlife Habitat Connectivity (Triangle Connectivity Collaborative) Network as a "Higher"-ranked habitat patch and corridor (this is the second-highest classification). The stream and its buffer are protected by Orange County Schools by restricting access with an eight-foot chain-link fence. A site visit identified numerous exotic invasive species within the buffer but the canopy and undergrowth could largely be characterized as mature secondary successional growth. Orange County's 2030 Comprehensive Plan identifies "Resource Protection Areas" (RPAs) as "[I]and designated as Primary Conservation Area which contains sensitive environmental resources, historically significant sites, and features considered unbuildable because of their limitations or unsuitability for development". Two RPAs are identified on the Cedar Ridge High School property: one that is the same Sand Branch corridor that is identified by NHP; and another patch on the southeastern corner of the property that appears to be a legacy mixed hardwood Page 7of12 13 ORANGE COUNTY SCHOOLS 1/22/2025 tree stand that subsequently was cleared and is being reestablished (Image 1). This is consistent with the area of the property being identified by NC NHP as a "Rural Forest Priority Landscape". ' 3 TV � .. SOURCE:Orange County,North Carolina,Land Records The US Fish and Wildlife Service (USFWS) identifies no critical habitats of endangered or threatened species protected by the federal Endangered Species Act on the property, as reflected by their Information for Planning and Consultation resources (https://ipac.ecosphere.fws.gov/). The property does have an area of influence that could potentially affect the endangered and threatened species identified in Table 1. However, given the present use of the high school and its predominant development footprint, the proposed development of a small accessory structure, and a development potential that is limited to the current campus, no significant impacts are anticipated to this area. While the property has a variety of vegetation and landscape features, the high activity of human uses on the site, including an athletic field and parking lot, make it a likely location only for those species with a high tolerance for human uses, particularly noise. Page 8of12 14 ORANGE COUNTY SCHOOLS 1/22/2025 RESOURCES MANAGEMENT PLAN A document and map, submitted as a part of a Conditional District application that sets forth, in detail, the location of and the proposed methods for: a) Protection of natural resources(i.e. habitat maintenance,existing vegetation,and mitigation of environmentally sensitive areas): The Cedar Ridge HS property has no significant habitats or species on it except for the Sand Branch stream and its buffer. This stream buffer may include specimen trees, but they will not be impacted by any future development activities as the stream and its 100' buffer are already restricted from all access by an 8' chain-link fence. Continuation of this restricted access is a proposed condition of approval on the zoning application. b) Ownership and maintenance of open spaces (common open space, proposed conservation easements, and landscape buffers): It is the understanding of OCS that all school property is owned by Orange County and leased to Orange County Schools as reflected in public records with Orange County Register of Deeds. Maintenance of open spaces and common open space is managed by OCS and third-party landscape contractors employed by OCS. There are no conservation easements or landscape buffers which are not already in public records. c) Provision of services (solid waste management to include recycling, stormwater management (temporary and permanent), irrigation systems to include the source of water: All water and wastewater services are provided by the town of Hillsborough. Recycling is placed in sorted containers within the school and collected by Orange County Solid Waste Management. Irrigation systems are supplied by Hillsborough as well. There is a water tower at the corner of New Grady Brown Road and Orange Grove Road which holds water for use by both Cedar Ridge High School and Grady Brown Elementary School d)The handling of land clearing debris: This is a cleared building lot so there will be very little if any debris created. In keeping with protection of natural resources, all organic matter produced by the project will be incorporated back into the finish site prep and landscaping. If any remaining debris is onsite, it will be taken to a central facility for composting Page 9of12 15 ORANGE COUNTY SCHOOLS 1/22/2025 TRAFFIC IMPACT STUDY NOT APPLICABLE: Cedar Ridge High School has been fully operational since 2000, and the roadways surrounding the site and internal traffic patterns are working as planned and approved. The proposed new building doesn't increase the number of students, teachers, or staff, so there will be no traffic impact due to the proposed construction. P a g r, 10 of 12 16 ORANGE COUNTY SCHOOLS 1/22/2025 LANDSCAPE & TREE PRESERVATION PLAN No substantial changes to the existing landscaping and tree canopy are anticipated if this conditional zoning application is realized in full. A primary succession Piedmont forest of largely softwood trees is regrowing in the "future development area" on the southern part of the campus, but this growth is only about ten years old; it was cleared during school construction and has not commitment to preservation or cultivation. The 30-foot easement for a "pedestrian path" shown on the site plan and provided as a condition of approval will require crossing of the existing 75-foot landscaped buffer on the frontage of the property facing New Brady Brown School and Orange Grove Roads. The exact location and orientation is to be determined but, as presented, should require a single 30-foot perpendicular crossing of the landscaping. Construction of a pedestrian or multiuse path could evaluate alternatives to minimize such disturbance at preliminary engineering design. Page 11012 17 ORANGE COUNTY SCHOOLS 1/22/2025 PROPOSED CONDITIONS FROM THE APPLICANT 1. The applicant proposes two future development areas as shown on site plan C2.0 dated 2/12/2025.A. Area in northwest corner of existing site. B.Area on the east side of existing site . 2. The applicant will provide a single boundary survey of the high school property to replace the four currently recorded. Please note the road R.O.W. internal to the campus that runs perpendicular to Grady Brown School Road will be abandoned. The survey will be completed in approximately 18 months from zoning approval. 3. The applicant proposes a 30'-0" wide pedestrian easement along Orang Grove Road and a portion of Grady Brown School Road (from the intersection to the bus entrance drive). The site plan dated 2/12/2025 shows it behind the existing buffers; however, the final location is to be determined and is contingent on the approval of the Orange County School Board. Orange County Schools is applying for a conditional zoning district to immediately allow for a new structure on the property to support an Agricultural Laboratory, and is requesting a condition to allow for further development of the property as a by-right zoning regulation. The school was constructed in 2001 and has a building footprint of approximately 270,022 square feet (6.20 acres), not accounting for the paved parking areas and walking paths. It was constructed prior to the regulation of stormwater runoff or nutrient management was required in this watershed by Orange County, the regulatory authority. Over half of the property is actively used for school purposes and, outside of the buffered areas on its perimeters and perennial streams, is generally managed and maintained as a lawn of fescue or Bermuda grass with ornamental shrubs. The property is located in the Lower Eno River Unprotected watershed, flowing into the Lower Eno River and, eventually, the Eno River and Falls Lake. There are no NC Department of Environmental Quality-identified "impaired" waters on site or downstream of the property. The property has two perennial streams on it: one identified in a 2000 site plan as Sand Branch, which defines the property's western perimeter; and an unnamed tributary ("UT") that transects the property east-west and feeds into Sand Branch. The UT was displayed by the US Geological Survey (USGS) as crossing the entire property but a Surface Water Identification conducted by Orange County Erosion Control and Stormwater staff identified an origin point immediately west of the high school's football stadium. It is possible that the construction of the campus in 2000 impacted the location and flow status of this stream. No wetlands are documented on site. The only possible wetland soils location is a band of Chewacla, a predominantly nonhydric soil, collocated with Sand Branch and its immediate area. No known Natural Heritage Elements or Element Occurrences have been documented on the property by the North Carolina Natural Heritage Program (NHP). Sand Branch and its riparian buffer zone are identified in the 2019 Eno-New Hope Wildlife Habitat Connectivity (Triangle Connectivity Collaborative) Network as a "Higher"-ranked habitat patch and corridor (this is the second-highest classification). The stream and its buffer are protected by Orange County Schools by restricting access with an eight-foot chain-link fence. A site visit identified numerous exotic invasive species within the buffer but the canopy and undergrowth could largely be characterized as mature secondary successional growth. Orange County's 2030 Comprehensive Plan identifies "Resource Protection Areas" (RPAs) as "[I]and designated as Primary Conservation Area which contains sensitive environmental resources, historically significant sites, and features considered unbuildable because of their limitations or unsuitability for development". Two RPAs are identified on the Cedar Ridge High School property: one that is the same Sand Branch corridor that is identified by NHP; and another patch on the southeastern corner of the property that appears to be a legacy mixed hardwood tree stand that subsequently was cleared and is being reestablished (Image 1). This is 26 consistent with the area of the property being identified by NC NHP as a "Rural Forest Priority Landscape". The property does have an area of influence that could potentially affect the endangered and threatened species identified in Table 1. However, given the present use of the high school and its predominant development footprint, the proposed development of a small accessory structure, and a development potential that is limited to the current campus, no significant impacts are anticipated to this area. The existing high school was permitted in 2001. The existing site includes the main school facility and several accessory structures and uses, including tennis courts, baseball fields, track and field facilities, concessions, and bleachers. Currently, the site meets landscaping and parking requirements for the existing school. Public Water and Sewer The site is served via public water and sewer (Town of Hillsborough system). Proposed Project Proposed Development Orange County, in coordination with Orange County Schools, has initiated a Zoning Atlas Amendments to bring the existing Cedar Ridge High School site into compliance with the Orange County Unified Development Ordinance (UDO) and to allow for future development. The existing high school was permitted in 2001 following the site plan review process. In 2021, Orange County adopted several amendments to the LIDO to address zoning changes at the state level. As part of this process, the UDO was modified, no longer allowing for schools in the R-1, Rural Residential zoning district. This action resulted in Cedar Ridge High School becoming a legal non-conforming use. Based on the UDO, a legal non-conforming use is allowed to continue operations, however, these uses are not allowed to expand. As a result, the proposed pole barn could not be approved as an accessory structure without correcting the non-conforming status of the existing land use. Approval of the proposed zoning atlas amendment will bring the existing school site into compliance with the UDO, allow for the construction of the proposed pole barn, and allow for future development and 3 36 improvements (i.e., accessory structures, expansions, etc.) to be approved administratively as part of the Non-Residential Zoning Compliance Permit process. The Orange County Unified Development Ordinance (UDO) Table of Permitted Uses (Article 5, Section 2) allows for "Schools: Preparatory" to be permitted in the Non-Residential-Conditional District (NR-CD) zoning district, subject to specific conditions, including a site-specific plan, required by the Orange County Board of County Commissioners (BOCC). The applicant and property owner are requesting a rezoning of the +/-69.58 acres property to NR-CD. The applicant has provided a site-specific plan featuring the existing high school facility and the proposed pole barn. The site-specific plan features landscaping, parking, and stormwater control measures that conform to the Orange County UDO. A formal site plan is required to be submitted as part of an NR-CD rezoning application. Approval of the site plan is part of the NR-CD rezoning process. Any agreed-upon conditions are binding to the development footprint permitted for the zoning district. This determination eliminates a requirement from the applicant to provide a more detailed Environmental Impact Statement (EIS) process as outlined in Sections 2.25.2 and 6.16.4 of the UDO. 6 Solid Waste The applicant has indicated future development will conform to the Orange County Solid Waste Management Ordinance. Attachment 5 includes Development Advisory Committee comments from Orange County Solid Waste staff. Proposed Conditions Per NCGS 160D-703, imposed conditions and site-specific standards are limited to those that address conformance of the development and use of the site to local government ordinances and adopted plans or the impacts reasonably expected to be generated by the development or use of the site. Per Section 2.9.1 (F) (3) of the UDO, the following conditions are being proposed: 1. The property shall be developed consistent with the reviewed site plan and application as acted upon by the Orange County Board of Commissioners on June 3, 2025. 2. The applicant will provide a single boundary survey of the high school property to replace the four currently recorded. The road R.O.W. internal to the campus that runs perpendicular to New Grady Brown School Road will be abandoned. The survey will be completed and recorded with a revised deed no later than 18 months from zoning approval. 3. The applicant proposes a 30'-0" wide pedestrian easement along Orange Grove Road and a portion of New Grady Brown School Road (to provide a pedestrian connection from this intersection to the school). The site plan dated 2/12/2025 shows it behind the existing buffers; however, the final location is to be determined and is contingent on the approval of the Orange County School Board. 4. The anticipated BOCC public 30 hearing date is June 3, 2025. 31 32 Lamar Proctor: Moving to the next agenda item. Number 7 is a zoning atlas amendment to review it, review and 33 make a recommendation to the BOCC on a county initiated zoning atlas amendment to rezone, 34 plus or minus 69.58 acres located at 1125 New Grady Brown School Road. 35 36 Ashley Moncado: Thank you. Good evening. I'm Ashley Moncado with the Planning Department. Before we start 37 with the first item, I just want to do a quick review since we have two conditional rezoning 38 applications in front of you tonight. As some of you may be aware, a conditional rezoning 39 application is different than a conventional in that it allows for one specific use to be identified, 40 discussed,and reviewed. Conditional rezonings allow for appropriate and agreed upon conditions 41 to be placed on the project. In addition, these rezoning applications require a site-specific plan for 42 review and approval which is binding. Any modifications to the site plan in the future would be 43 required to come back to Planning Board and BOCC for review and approval. So, starting with 44 the first item,tonight is a county initiated rezoning application to rezone the existing Cedar Ridge 45 High School site from R1 Rural Residential, to NRCD Non-Residential Conditional District. The 46 69.58-acre parcel is located north of New Grady Brown School Road in the Hillsborough 47 Township. Orange County, in coordination with Orange County Schools has initiated this rezoning 48 to bring the existing Cedar Ridge High School into compliance with the Orange County Unified 49 Development Ordinance and to allow for future development. The existing high school was 50 permitted in 2001. In 2021, Orange County adopted several amendments to the LIDO no longer 51 allowing for schools in the R1 district. This action resulted in Cedar Ridge High School becoming 52 a legal, non-conforming use. A legal non-conforming use is allowed to continue operations. 53 However, it is not allowed to expand. As a result,the proposed pole barn could not be approved 54 as an accessory structure without first correcting the legal non-conforming status of the existing 55 school site and land use. Approval of the proposed zoning atlas amendments will bring this 79 56 existing school site into compliance, allow for the proposed pole barn,and allow for future 57 development and improvements to the site to be processed by staff as part of the zoning 58 compliance permit process. The parcel is currently zoned as Rural Residential. The request is to 59 rezone the parcel to Non-Residential Conditional District to allow for a preparatory school,which is 60 a permitted use in the NR-CD district. Adjacent parcels in Orange County are zoned as R1,and 61 the adjacent parcels to the east, they're within the Town of Hillsborough, but they are also zoned 62 as R-20, Residential. Adjacent land uses include low-density residential and undeveloped 63 parcels. The parcel is located in 10-year Transition future land use classification. There are no 64 amendments being proposed to the Comprehensive Plan Future Land Use. In addition to a 65 signed application, a conditional rezoning application requires a site plan, narrative, environmental 66 assessment. These items are all contained within Attachment 1 of your packets. A site-specific 67 plan featuring the existing the high school, and the proposed pole barn was submitted by the 68 applicant. The existing pole barn is located here to the east. The site plan also includes 69 accessory structures and uses including tennis courts, baseball fields,track and field facilities. 70 The plan also identified landscaping, parking, and storm water control measures which all conform 71 with the UDO. Access is provided with existing access to two driveways,which connect to New 72 Grady Brown School Road. There is no expected additional traffic to be generated from this 73 request. Mutually agreed upon conditions can be proposed as part of this process. Four 74 conditions have been proposed as part of this request from the applicant. Please note, agreed 75 upon conditions are binding to the development permitted for the zoning district. The proposed 76 conditions are contained in the proposed statement of consistency and the draft ordinance 77 contained in your packets and also here on the slide. Following the applicant's presentation,we 78 can come back to answer questions regarding the conditions at the review and recommendation 79 portion of the presentation. At this time, I am going to hand it over to the applicant to allow for 80 them to introduce themselves, and to complete their presentation. 81 82 Cy Stober: Good evening. I'm Cy Stober. I'm planning and inspections director with Orange County, and 1 83 am the applicant for this conditional rezoning. With me tonight are Patrick Florence with Orange 84 County Schools, and Ken Redfoot, the architect associated with the project. We are here tonight 85 to discuss the conditional rezoning of Cedar Ridge High School to bring it into conformance with 86 the Orange County Unified Development Ordinance,which allows for preparatory schools only in 87 conditional zoning districts. You'll note the location at New Grady Brown School Road and 88 Orange Grove Road. The school has been present since 2000, and largely in this form. It wasn't 89 until the UDO was amended in 2021 that the R1 district became a non-conforming zoning district 90 for a preparatory school use. The school use is established now for over 20 years and presents 91 no new negative impacts to the surrounding area. As such, in my opinion, it can be deemed 92 harmonious with the surrounding area. So, I just covered that preparatory schools are only 93 permitted in three conditional zoning districts. Given the school use, it had appeared that non- 94 residential conditional was the appropriate zoning district for the school. Before you,you have a 95 somewhat simpler version of the site plan that Ashley just presented to you, and I might add 96 Ashley went through a lot of the details, and I don't intend to reiterate them regarding the 97 necessity and the location of the school. Suffice it to say the pole barn,which will be used for an 98 agricultural lab is located here.That pole barn would then be enabled through the conditional 99 zoning process. There are two other areas I'll cover in just a moment that would be permitted to 100 be allowed to be developed in the future that are identified on this plan as well. Of the conditions, 101 it would be the site-specific plan that would be permitted for Cedar Ridge High School for its 102 current conditions as well as any future expansions. The applicant, Orange County Schools,will 103 provide a single-boundary survey of the property. Currently,there are four that are stitched 104 together, and, on record at the register of deeds, and the school is offering to provide a single 105 boundary survey. There's also an unopened right of way located on the property that will be 106 abandoned as part of that property boundary survey.Again,the property shall be developed 107 consistent with the site plan that you see before you. These are the two areas proposed for future 108 development. So, should the site plan be approved, should the conditional zoning district be 109 approved,these two areas would be permitted to be expanded into, provided they are consistent 110 with all of the unified development ordinance standards. I'll remind you that the landscaping 80 111 standards exist already on the property, and they're reflected on the site plan. There would be no 112 new encroachment into the landscaping with one exception that I'll get to in a moment,and that 113 the setbacks are per site plan. So,what we're looking for is accessory structures that would 114 conform with the school use, be consistent with the school use, and would conform with the 115 standards, say lighting standards, parking standards, etcetera of the unified development 116 ordinance. The one potential change to the landscaping is a 30-foot-wide pedestrian easement 117 along Orange Grove Road and a portion of New Grady Brown School Road. Pedestrian access to 118 this particular campus,to Cedar Ridge High School, is a known desire of the community for 119 students to be able to walk to the school, and to provide safe access. The county's transportation 120 department is working with DOT on providing this access on the other side of the interstate, and 121 the site plan is an excellent opportunity to provide for the easement. Now, Orange County 122 Schools staff has been clear that the school board will need to approve any dedication of 123 easement, so exact location is to be determined, but the intention and which the conditions states 124 is that'll be a pedestrian connection from the intersection of New Gardy Brown School Road and 125 Orange Grove Road to a door at the high school. And with that,that is the intent of the 126 application. It is to bring it into conformance to create no new negative impacts to the surrounding 127 area and to provide for future access and future expansion consistent with the existing high school 128 use. I'm happy to answer any questions. 129 130 Meg Millard: I just had one question about there was some discussion in there about there were two streams, 131 one was fenced off and one was unfound. I don't understand that. Was it found ever? 132 133 Cy Stober: It was. The one stream is, is fenced off. It's essentially the western property boundary, and the 134 fence surrounds the entire buffer. So,the buffer is well protected. It's also pretty much left wild. 135 It's, not actively maintained, but Chris Hirni,from Department of Environment Agriculture, Parks 136 and Recreation toured the site with me and with the staff, and it's a healthy kind of successional 137 forest. There are some invasives. The other stream was formerly shown to go right under the 138 football field. Orange County Erosion Control provides for surface water identification. A surface 139 water identification was ordered and paid for by Orange County Schools, and the origin of the 140 stream is now shown to be immediately west of the football field. I could speculate on why it no 141 longer is at the blue line that was originally shown but suffice it to say its current head waters is 142 immediately west of the football field and drains to that tributary on the western perimeter. 143 144 Meg Millard: So, not near the pole barn? 145 146 Cy Stober: Not any longer. No. 147 148 Statler GiIfillen: Immediate property owners have all been notified of this? 149 150 Cy Stober: Of course. Well, per staff. Encouragement of Energy Efficiency, Lower Energy Consumption, and the Use of Non-Polluting Renewable Energy Resource: Decreasing the use of non-renewable resources and lowering energy consumption are encouraged in both public and private activities. The county's transportation system should be enhanced to promote more energy efficient modes of travel and improve air quality. Staff Comment: Not applicable. ■ Planning Principle 4. Natural Area Resource Protection: Protection of the County's natural areas, including forests, wildlife habitat, and other important open spaces should be a priority. Staff Comment: The applicant provided an Environmental Assessment and a Biological Inventory as part of the application package. Staff has reviewed and determined no significant environmental impact is expected from this project based on existing conditions. Required landscape buffers are provided along New Grady Brown School Road and Orange Grove Road. In addition, existing landscape is maintained along the entire perimeter of the site. The project protects the existing stream on site with required stream buffering. ■ Planning Principle 5. Preservation of Rural Land Use Pattern: The County's rural areas are a cherished component of the County's character. Future development should preserve and enhance the county's rural landscape. Staff Comment: The 2030 Comprehensive Plan, Appendix G, Land Use Classification and Overlay Locational Criteria, identifies 10-Year Transition in the Comprehensive Plan as areas changing from rural to urban in form and density. No additional impacts (i.e. noise, traffic, lighting) shall result from the proposal. Existing landscaping is to remain on-site acting as a buffer to adjacent properties and minimizing impacts to the adjacent parcels. ■ Planning Principle 6. Water Resources Preservation: The County has finite water resources to provide to future populations. The protection and management of the County's water resources should be a high priority. Staff Comment: The existing school is connected to public water and wastewater service. No additional utilities are proposed. The project will continue to protect the existing stream onsite. ■ Planning Principle 7. Promotion of Economic Prosperity and Diversity: Development of a diversity of new businesses and expansion of existing businesses should occur in Orange County. Staff Comment: Not applicable. ■ Planning Principle 8. Preservation of Community Character: Future growth and development should occur in a manner that preserves and enhances the existing character of the County, its townships, and rural crossroads communities. Staff Comment: The project proposes development which is consistent with the existing high school. The existing school is appropriately located within the 10-year Transition area, as defined in the 2030 Comprehensive Plan. The site is surrounded by low density residential uses, undeveloped parcels, and the Interstate 40 corridor. No additional traffic, lighting, or noise will occur from the proposed project. As a result, no additional offsite impacts will result. The proposal shall not create a conflict with the adjacent low density rural residential uses and undeveloped properties. 85 ■ Land Use Overarching Goal: Coordination of the amount, location, pattern, and designation of future land uses, with availability of County services and facilities sufficient to meet the needs of Orange County's population and economy consistent with other Comprehensive Plan element goals and objectives. Staff Comment: The proposal, as proposed and limited by the application and site plan, is consistent with the 2030 Comprehensive Plan's stated goals. The application proposes to bring the existing school site into compliance with the UDO and allow for future development. The existing high school has been operating on this parcel since 2001, serving the needs of the County. The proposal will not change the existing use of the parcel and will allow the school to continue to serve Orange County residents. The proposed project shall remain compatible with minimal negative impacts to the immediate area. ■ Land Use Goal 2: Land uses that are appropriate to on-site environmental conditions and features, and that protect natural resources, cultural resources, and community character. Staff Comment: The proposed use meets all UDO standards for buffering and screening, as well as the applicable erosion control and stormwater regulations. There is no proposed activity in the stream buffer area. ■ Land Use Goal 3: A variety of land uses that are coordinated within a program and pattern that limits sprawl, preserves community and rural character, minimizes land use conflicts, supported by an efficient and balanced transportation system. Staff Comment: The existing use is consistent with the future land use classification allowed by the 2030 Comprehensive Plan, Appendix F; and is consistent with the land use allowances for the 10-Year Transition. No additional traffic, lighting, or noise will occur from the proposed project. In addition, existing landscaping and land use buffers will remain. Standards contained in the UDO, including landscaping and setbacks, will continue to allow the use to be buffered from neighbors and prevent negative impacts. The site shall be developed with all applicable development standards from the UDO in order to protect neighboring residential properties and minimize land use conflicts. ■ Land Use Goal 6: A land use planning process that is transparent, fair, open, efficient, and responsive. Staff Comment: The Orange County staff has noticed the public regarding this application, as required by Sections 2.8.7, 2.9.1(D), and 2.9.2 of the UDO, including a required Neighborhood Information Meeting, mailings to neighboring property owners, posting of the property, and advertisement in the local newspapers. Staff Comment: The applicant provided an Environmental Assessment and a Biological Inventory as part of the application package. Staff has reviewed and determined no significant environmental impact is expected from this project based on existing conditions. Required landscape buffers are provided along New Grady Brown School Road and Orange Grove Road. In addition, existing landscape is maintained along the entire perimeter of the site. The project protects the existing stream on site with required stream buffering. ■ Planning Principle 5. Preservation of Rural Land Use Pattern: The County's rural areas are a cherished component of the County's character. Future development should preserve and enhance the county's rural landscape. Staff Comment: The 2030 Comprehensive Plan, Appendix G, Land Use Classification and Overlay Locational Criteria, identifies 10-Year Transition in the Comprehensive Plan as areas changing from rural to urban in form and density. Promotion of Economic Prosperity and Diversity: Development of a diversity of new businesses and expansion of existing businesses should occur in Orange County. Staff Comment: Not applicable. ■ Planning Principle 8. Preservation of Community Character: Future growth and development should occur in a manner that preserves and enhances the existing character of the County, its townships, and rural crossroads communities. Staff Comment: The project proposes development which is consistent with the existing high school. The existing school is appropriately located within the 10-year Transition area, as defined in the 2030 Comprehensive Plan. The site is surrounded by low density residential uses, undeveloped parcels, and the Interstate 40 corridor. No additional traffic, lighting, or noise will occur from the proposed project. As a result, no additional offsite impacts will result. The proposal shall not create a conflict with the adjacent low density rural residential uses and undeveloped properties. 90 ■ Land Use Overarching Goal: Coordination of the amount, location, pattern, and designation of future land uses, with availability of County services and facilities sufficient to meet the needs of Orange County's population and economy consistent with other Comprehensive Plan element goals and objectives. Staff Comment: The proposal, as proposed and limited by the application and site plan, is consistent with the 2030 Comprehensive Plan's stated goals. The application proposes to bring the existing school site into compliance with the UDO and allow for future development. The existing high school has been operating on this parcel since 2001, serving the needs of the County. The proposal will not change the existing use of the parcel and will allow the school to continue to serve Orange County residents. The proposed project shall remain compatible with minimal negative impacts to the immediate area. ■ Land Use Goal 2: Land uses that are appropriate to on-site environmental conditions and features, and that protect natural resources, cultural resources, and community character. Staff Comment: The proposed use meets all UDO standards for buffering and screening, as well as the applicable erosion control and stormwater regulations. There is no proposed activity in the stream buffer area. ■ Land Use Goal 3: A variety of land uses that are coordinated within a program and pattern that limits sprawl, preserves community and rural character, minimizes land use conflicts, supported by an efficient and balanced transportation system. Staff Comment: The existing use is consistent with the future land use classification allowed by the 2030 Comprehensive Plan, Appendix F; and is consistent with the land use allowances for the 10-Year Transition. No additional traffic, lighting, or noise will occur from the proposed project. In addition, existing landscaping and land use buffers will remain. Standards contained in the UDO, including landscaping and setbacks, will continue to allow the use to be buffered from neighbors and prevent negative impacts.
