Compliance Letter from Town of Chapel Hill PURPOSE: To make a recommendation to the North Carolina Department of Transportation (NCDOT) and the North Carolina Board of Transportation (NC BOT) concerning a petition to add Zieger Lane and Cattail Lane in the Rusch Hollow Subdivision to the State Maintained Secondary Road System. BACKGROUND: This request includes a NCDOT petition for two (2) road additions to the State Maintained Secondary Road System. The road lengths and widths are as follows: Road Name Length in Number of Frontage Pavement and Right-of-Way Miles Lots with Houses Widths in Feet Zieger Lane 0.13 11 22-ft pavement, 50-ft Right-of-Way Cattail Lane 0.05 4 22-ft pavement, 50-ft Right-of Way Total 15 The Rusch Hollow Subdivision is located in Orange County along Rogers Road (State Road (SR) 1729) (Attachments 1 and 2). This single-family residential subdivision is within the Town of Chapel Hill's Extra-Territorial Jurisdiction (ETJ). However, per North Carolina General Statutes §136-62, the Board of County Commissioners (BOCC) is an appropriate governing body to approve the road addition request associated with the subdivision. There are no known violations associated with the subdivision, as confirmed by the Town of Chapel Hill (Attachment 5). The Rusch Hollow Subdivision was recorded on November 18, 2004 (Plat Book 96 Page 84) (Attachment 3). Zieger Lane and Cattail Lane were originally platted and designed to meet public road standards, but have been maintained private roads in the interim. The roadways were intended to become public roads when conditions met NCDOT maintenance responsibility and ownership criteria, as reflected on the recorded plat. 2 Zieger Lane serves as the entrance to the subdivision off Rogers Road (SR 1729) and terminates in a stub out and intersection on the eastern end of the subdivision with Cattail Lane. Cattail Lane continues and intersects with Rusch Road (SR 1842), which also connects with Rogers Road (SR 1729). NCDOT has investigated this request and has submitted a petition to the BOCC for its recommendation (Attachment 4). North Carolina General Statutes §136-62 and §136-102.6 require that road petitions for additions to the State system be made by the governing body. Conclusion: The above-referenced application meets the criteria endorsed by the BOCC for recommending acceptance of public roads into the State Maintained System for roads approved through the governing jurisdiction's subdivision process (NCDOT Subdivision Roads Minimum Construction Standards, January 2010, revised July 2020). FINANCIAL IMPACT: There is no direct financial impact to the County associated with this item. NCDOT will incur additional maintenance responsibilities and costs. The right-of-way will extend the entire length of the road that is requested to be added to the state maintained system and will include the necessary areas outside of the right-or-way for cut and fill slopes and drainage. Also, we agree to dedicate additional right-of-way at intersections for sight distance and design purposes and execute said right-of-way agreement forms that will be submitted to us by representatives of the NCDOT. A Zoning Compliance Permit was issued July 23, 2004 for streets and infrastructure. A Final Plat was signed by the Town of Chapel Hill in November 23, 2004 and recorded on November 29, 2004. The project has prepared some minor revisions to the approved Special Use Permit, Zoning Compliance Permit, since the original approval. As of now, to the best of my knowledge, the project is in compliance with all of the approvals issued. As the project is outside of the Town's city limits, we have no objections to the request for the streets to be included within the NCDOT SR system. Please let me know if you have any questions!
