STATEMENT OF CONSISTENCY OF
A PROPOSED UNIFIED DEVELOPMENT ORDINANCE TEXT AMENDMENT
WITH ADOPTED ORANGE COUNTY PLANS
An application was received to amend the Orange County Unified Development Ordinance
( UDO) to add Family Care Facility as a potential use in the MPD-CD (Master Plan Development
Conditional District) and to allow MPD-CD districts to be considered in the Rural Neighborhood
Activity Nodes , as designated by the 2030 Orange County Comprehensive Plan . Upon review ,
the Orange County Planning Director recommended alternative amendments to the UDO text to
update Family Care Facility use and definition .
The Board of County Commissioners hereby issues this Statement of Consistency pursuant to
NCGS § 160D-605 Governing Board Statement. The Board finds that the amendments to the
Orange County UDO text that allows for Family Care Facilities as a permitted use in MPD -CD
districts and updates the definition of " Family Care Facility" is consistent for the following
reasons :
1 . The requirements of UDO Section 2 . 8 Zoning Atlas and Unified Development
Ordinance Amendments have been met ;
2 . The amendment is consistent with the adopted 2030 Orange County Comprehensive
Plan , as prescribed by UDO Section 1 . 1 . 5 Statement of Intent - Amendments and
Section 1 . 1 . 7 Conformance with Adopted Plans;
a . The amendment is consistent with the 2030 Comprehensive Plan because it
supports the following :
Housing Goal 1 :
A wide range of types and densities of quality housing affordable to all in all parts
of the County .
Housing Goal 2 :
Housing that is useable by as many people as possible regardless of age , ability
or circumstance .
Objective H-2 . 1 :
Accommodate the development of group homes , foster care facilities , transitional
housing facilities and other housing types in appropriate locations to provide
increased opportunities for social interaction , a de- institutionalized lifestyle , and
gainful employment .
3 . The amendment is consistent with the adopted Master Aging Plan 2022-2027 ;
a . The amendment is consistent with the master aging plan because it supports the
following :
Goal 3 — Housing : Improve choice , quality , affordability , and stability of housing
for older adults .
Objective 3 . 1 : Expand the development of a wide array of housing models that
advance racial equity , livable design , and social connections for older adults .
4 . The amendment is consistent with the adopted Consolidated ( Housing ) Plan 2020-2025 ;
a . The amendment is consistent with the consolidated plan because it supports the
following :
Priority Need #3 - Integrated Housing for People with Service Needs
5 . The amendment is reasonable and in the public interest because it encourages
development of a needed housing type for disadvantaged and/or aging populations .
The Orange County Board of Commissioners hereby adopts this Statement of Consistency
and the findings expressed herein .
