2024-25 GRANT
AGREEMENT
THIS AGREEMENT, entered into this 6 day of September, 2024, by and between Orange
County ("County"), by and through the Orange County Arts Commission ("Arts
Commission") and ("Grant Recipient").
WHEREAS, the Arts Commission is a countywide arts agency that ensures the growth of
local arts experiences by providing funding and support for diverse high quality programs and
projects.
WHEREAS, the Arts Commission administers the annual Grants Program to provide
economic opportunities to Orange County artists and non-profit organizations coordinating arts
projects benefiting the citizens of Orange County.
WHEREAS, the annual Arts Grants Program is supported by Arts Commission with
funds from the Grassroots Arts Program of the North Carolina Arts Council, a division of the
Department of Natural and Cultural Resources, a state agency.
WHEREAS, the Grant Recipient was selected by the Arts Commission to receive
the annual Arts Grant through the procedures duly adopted by the Arts Commission; and
WHEREAS, both parties wish to promote and maintain the integrity and clarity of the
Grant Recipient's ideas and statements and delineate the Grant Recipient’s obligations to the
County;
NOW, THEREFORE, the County and the Grant Recipient, for the consideration
and under the conditions hereinafter set forth, agree as follows:
1.Approved Grant Project. Grant funds are provided under this Agreement for the project
(“Project”) described in the Grant Recipient’s Grant Application, attached hereto and
incorporated herein as Exhibit A.
2.Grant Award. Grant funds in an amount not to exceed ($ )
have been awarded by the Arts Commission to the Grant Recipient for the approved
Project. The Recipient shall be required to match funds at least dollar-for-dollar with cash
from the Grant Recipient’s funds not derived from either Orange County appropriations or
the North Carolina Arts Council, as outlined in the attached Exhibit A.
3.Contingency. This grant is contingent on North Carolina Arts Council Grassroots
Program funding to the Arts Commission. Final decisions on Grassroots Program funds
to the North Carolina Arts Council are subject to approval by the North Carolina General
Assembly.
4.Responsibilities of the Grant Recipient

A.Implementation. The Project implementation shall take place between July 1,
2024 and June 30, 2025. The Project shall be implemented in the manner
described in Exhibit A. Time is of the essence in the implementation of the
Project.
B.Modifications to project. Grant Recipient shall present major changes to the
original proposal, including but not limited to changes in design, implementation
schedule and increase in Project budget by more than 10%, in writing to the Arts
Commission for approval. Arts Commission shall approve or disapprove Grant
Recipient’s request for modifications within seven (7) days of receipt thereof.
Consent to project modifications shall not be unreasonably withheld. Arts
Commission’s decisions shall be in writing. In the event the Arts Commission
fails to approve or disapprove the requested modifications within the time stated
herein, the modifications shall be deemed approved.
C.Non–assignment. The grant cannot be assigned or transferred to a different project
or artist without prior written approval of the Arts Commission.
D.Records. Grant Recipient must maintain records and other evidence pertaining to
costs incurred and revenues acquired during the Project implementation. Grant
Recipient shall maintain financial records pertaining to the Project for three (3)
years from the date of this Agreement, in case of audit.
E.Use of Funds. Grant Recipient shall not use the grant funds to repay outstanding
taxes or other debts of any nature. The grants shall be utilized solely for the
purpose described in the attached Exhibit A.
F.Final Report. Grant Recipient shall submit to the Arts Commission a Final Report
on July 14, 2025. The Final Report shall be in the format required by the North
Carolina Arts Council. Failure to submit the Final Report or late submission of
the Final Report, for any reason, shall be grounds for denial and/or cancellation of
grant funds for the Project and future grant proposals.
5.Responsibilities of the Arts Commission
A.Payment. The Arts Commission shall release the grant funds in the amount of
$ to the Grant Recipient.
6.Publicity
A.Acknowledgement. Credit must be given to the Orange County Arts
Commission and/or the North Carolina Arts Council using the proper logo(s)
and credit line in brochures, news releases, programs, and all other printed and
online publications. Copies of such printed materials must accompany the
evaluation report. Official Orange County Arts Commission and North Carolina
Arts Council logos may be downloaded at www.artsorange.org/grantee-resources
and may not be altered in any way. When no printed information is used, verbal

credit shall be given. In addition, all print and promotional material must include
the following credit line and logo(s) (check all that apply):
i.County Funds Only. Orange County Arts Commission logo required.
Credit line required for audio projects: “This program is supported by the
Orange County Arts Commission.”
ii.North Carolina Arts Council Funding. The Orange County Arts
Commission and the North Carolina Arts Council logos are required. Credit
line: “This program is supported by the N.C. Arts Council, a division of the
Department of Natural and Cultural Resources.”
B.The Grant Recipient must enter all events, exhibits, and performances open to the
public and related to this grant award on the Orange County Arts Commission
website at www.artsorange.org/events. In addition, the Grant Recipient must
add a link to www.artsorange.org (Orange County Arts Commission logo
preferred) to their main webpage.
7.Indemnity. The Grant Recipient agrees to indemnify and hold harmless the County, the
Arts Commission and the North Carolina Arts Council and their officers and employees
from any and all claims or actual injury, damage or loss to a person, or real or personal
property that results from or is in any way connected to the use of the grant funds.
8.Independent Contractor. The Grant Recipient is an independent contractor and not an
employee, agent or other representative of the County and/or the Arts Commission.
Nothing contained in this Agreement shall be construed to create the relationship of
principal and agent, or employer and employee, between Grant Recipient and Arts
Commission or Orange County Government. Grant Recipient understands and agrees
that he/she is not authorized to incur any expenses or any liability whatsoever on behalf
of the County or the Arts Commission and has no authority, expressed or implied, to
obligate or make representations on behalf of the County or the Arts Commission. In
addition, Grant Recipient agrees to maintain his or her own worker's compensation
insurance for himself/herself and his or her employees for the duration of the art work's
installation.
9.Termination
A.In the event of any of the circumstances set forth below (hereinafter referred to as
“default”), the Arts Commission may immediately terminate this Agreement:
(i)Any fraudulent representation in any verification required to obtain
payment under this Agreement or other dishonesty on a material matter
relating to the performance of services under this Agreement.
(ii)Nonperformance, incomplete service or performance, or failure to
satisfactorily perform any part of the Project or to comply with any
provision of this Agreement, as determined by the Arts Commission in its
sole discretion.

(iii)Failure to adhere to the terms of applicable county, state or federal laws,
regulations, or stated public policy.
B.In the event of default by the Grant Recipient, the Arts Commission has the
discretion to elect to terminate this Agreement, in whole or in part and/or require
the Grant Recipient to repay the grant funds within seven (7) from written notice
of default or allow the grant recipient the opportunity to cure the default. This
clause shall not be interpreted to limit the County’s or the Arts Commission’s
remedies in law or in equity.
10.Miscellaneous.
A.Entire Agreement. This Agreement and the attachments contain the final and
entire understanding of the parties with respect to the subject matter of this
Agreement. All modifications and amendments to this Agreement shall be in
writing. This Agreement shall be binding upon the parties, their heirs, successors
and assigns.
B.Governing Law. Governing Law and Priority: Both parties agree that this
Agreement shall be governed by the laws of the State of North Carolina and
Orange County. Grant Recipient shall at all times remain in compliance with all
applicable local, state, and federal laws, rules, and regulations including but not
limited to all state and federal anti-discrimination laws, policies, rules, and
regulations and the Orange County Non-Discrimination Policy and Orange
County Living Wage Policy (each policy is incorporated herein by reference and
may be viewed at
http://www.orangecountync.gov/departments/purchasing_division/contracts.php.).
Any violation of this requirement is a breach of this Agreement and Arts
Commission may immediately terminate this Agreement without further
obligation on the part of the Arts Commission. This paragraph is not intended to
limit and does not limit the definition of breach to discrimination. By executing
this Agreement the Grant Recipient certifies that they has not been identified, and
has not utilized the services of any agent or subcontractor identified, on the list
created by the State Treasurer pursuant to G.S. 147-86.58. By executing this
Agreement the Grant Recipient certifies that they has not been identified, and has
not utilized the services of any agent or subcontractor identified, on the list
created by the State Treasurer pursuant to G.S. 147-86.81. By executing this
Agreement Grant Recipient affirms they are and shall remain in compliance with
Article 2 of Chapter 64 of the North Carolina General Statutes. In determining
the basic services to be provided, should any documents be referenced in or
attached to this Agreement, the terms herein shall have priority in any conflict
between the terms of referenced documents and the terms of this Agreement.
C.Dispute Resolution: Neither party may initiate binding arbitration. Any disputes
shall be resolved by nonbinding mediation. If such mediation fails either party
may initiate litigation to resolve the dispute. Should either party initiate litigation
to settle any dispute involving the terms of this Agreement such litigation shall be

initiated in the General Court of Justice of North Carolina seated in Orange
County, North Carolina.
D.Signatures. This Agreement together with any amendments or modifications may
be executed electronically. All electronic signatures affixed hereto evidence the
intent of the Parties to comply with Article 11A and Article 40 of North Carolina
General Statute Chapter 66.
IN WITNESS WHEREOF, the Orange County and the Grant Recipient have signed this Grant
Agreement, effective on the last date this Agreement is signed by both parties as indicated by the
dates set forth under signatures below.

Summary
As Congresswoman Ayanna Pressley says, “Voting is an act of self-care.”
W hatever the outcome of the next election, we need to take care of
ourselves and others, repairing the tattered fabric of American civility and
community. Performance can help do that. W hen we hear a story about
someone whose lived experience is different from our own, we are changed
by our new knowledge. To that end, my show "Myth America," is an
exploration of voices rarely heard center stage, sparking conversation and
sharing among listeners.
This 65-minute, retrospective performance features three original character
monologues written across forty years -- interwoven with family history tales
and personal stories. I describe its contents this way: “W hat do an Irish
immigrant, an unhoused person, an essential worker, and a child sharing her
unstudied wisdom have in common? Their humanity calls to our own.”
At the 2023 National Storytelling Festival, this show received a standing
ovation from 1000 people. Since then, I have presented it in much more
intimate settings across the country. Listeners' responses to the show
include: “Seriously brilliant.” “Brought humanity to a person who is often
demonized.” “Timely and needed by our world.”
As my Artist Project, I propose giving 4-6 free performances of "Myth
America" as a tool of civic engagement. W orking with community partners, I
will mount the show in various Orange County neighborhoods. Performances
will be followed by post-show conversations with audiences, linking the
issues onstage with concerns in our communities. On the day of the
performances and audience chats, the neighborhood venues will also host
nonpartisan voter registration drives. These events will take place between
late summer and early fall 2024 before the final deadline for registering to
vote.
Rev. Marcus McFaul at Binkley Baptist Church has agreed to host an event
on the afternoon of August 25, 2024. Censored AP English teacher/public
speaker Mary W ood, featured in the W ashington Post, will join us. A grant
from NC Storytelling Guild will pay her fee/travel expenses.

Molly Luby, Community History Coordinator at the Chapel Hill Public Library,
has committed to hosting another event.
I've reached out to the Marian Cheek Jackson Center about hosting an event
at the Hargraves Community Center. And I've invited Chapel Hill/Carrboro
NAACP to get involved in voter registration.
I've contacted Associate Pastor Lisa Frost-Phillips at St. Matthews
Episcopal Church about cohosting an event at the church or at the Eno Arts
Mill Gallery in Hillsborough, inviting Northern Orange County NAACP to
collaborate on voter registration.
I've written Janice Tyler, director of the Seymour Center, and staff at the
Carrboro Century Center about co-hosting events as well.
Molly Luby, UNC journalism professor Carl Kenney, UNC anthropologist
Glenn Hinson, Hidden Voices founder Lynden Harris and author/storyteller
Donna W ashington have all agreed to lead post-show conversations with
audiences.
The Orange/Durham/Chatham County chapter of the nonpartisan League of
W omen Voters has expressed interest in helping with voter registration at my
events. I've also asked the local chapter of the American Association of
University W omen to assist.

Community Impact Returning to Chapel Hill in 2018, I have taken every opportunity to impact
community in my adopted home state through storytelling-focused events: By
performing for children at the Kidzu Museum, the Chapel Hill Public Library's
Star Party, and the International Children's Day Celebration at the Raleigh
Museum. And by performing for adults at house concerts in Chapel Hill; at
Clapping Hands Farm and the Roadhouse Storytellers series in Pittsboro; in
the virtual National W omen's Theatre Festival in Raleigh; at the Old North
State Storytelling Festival in Cary; in the virtual Remembrance and Renewal
Storytelling Festival at UNC, and at a fundraiser for resettled Afghan
refugees in the Triad.
Also by guest lecturing in classes for the Folklore Program, the Performance
Studies Program and the School of Information and Library Science at UNC,
and teaching from the mountains to the sea -- at Storytellers W ildweek in
Little Switzerland and the NC Storytelling Guild's W inter W orkshop in Fort
Caswell. Finally by conducting a previous OCAC-funded Artist Project,
partnering with the UNC W omen's Center, the Crisis Unit of the Chapel Hill
Police Department and the Compass Center for W omen and Families,
presenting stories/panels online to benefit survivors of domestic violence.
Narrative can be used intentionally to divide a “we” into an “us and them.” But
it can also be used to bring people together, creating a new “we.” By offering
multiple performances of my retrospective show "Myth America" along with
community conversations and voter registration drives, I aim to build "we"
relationships with community stakeholders, neighborhood organizers and
local advocacy groups in Orange County.
My first two confirmed venues are the Binkley Church and the Chapel Hill
Public Library. The Binkley Fellowship Hall holds 150-200 people, while the
Library's Meeting Rooms A and B have a capacity for 84-162, respectively.
Between the two, I hope to attract at least 150 participants.
After confirming a Jackson Center partnership, I'll reserve the 100-person
Hargraves Community Center Auditorium or its 50-60 person Meeting Room
for another event. I expect to hold an event in Hillsborough, possibly at the
St. Matthews Episcopal Church (seating 160) or the more intimate Eno Arts
Mill Gallery. Between those next two settings, I hope to attract another 125
listeners. Potentially, that's 275 people before I confirm my final
neighborhood partners, hopefully the Seymour Center and Carrboro's
Century Center.
W ith six events planned, I expect to serve at least 350 Orange County
residents. W ith help from my neighborhood partners to attract their
constituencies, I will also draw from my network in the Triangle, the Triad and
statewide to expand our audiences. The final numbers will include not only
listeners, but also venue hosts/partners, post-show conversation leaders,
voting registration volunteers and those who attend so that they can register
to vote.

Artist Experience A GRAMMY-nominated performer and freelance touring and teaching artist
for forty years, I’ve worked in universities, museums, theaters, schools,
libraries, faith communities, residences for mentally challenged adults, and
prisons. I am also a published researcher, archivist and scholar of
storytelling studies. I have produced several similar projects linking
storytelling performance with social justice advocacy:
2010: Through Independent Actors Theatre in Columbia MO, I mounted
"Changing Skins," interweaving transgender folktales, science, sociology and
personal observations about gender fluidity. It received a Catalyst Award
from the University of Missouri (MU) LGBTQ Resource Center. My
performance of the show at the 2013 National storytelling Festival was
reviewed in Storytelling, Self, Society.
2012: I premiered "Sometimes I Sing" based on Susan Glaspell’ 1916 one-
act play, "Trifles," in a production at MU. I published the script and an essay
about its provenance in an anthology about Glaspell’s work.
2016: I compiled "Tales from Beyond the Ban," featuring folktales from the
seven predominantly-Muslim countries named in the former president’s travel
ban, alongside snippets of oral histories from international teaching
assistants at MU. I’ve written about the experience in the International
Journal of Conflict and Reconciliation.
2021: I wrote a successful OCAC Artist Project grant proposal, underwriting
several free online events cosponsored by the UNC W omen's Center, the
Crisis Unit of the Chapel Hill Police Force and the Compass Center for
W omen and Families. The events featured a virtual screening of my
domestic-violence related monologue, "Sometimes I Sing." Four of the five
events were followed by panels of scholars, survivors and providers of direct
services to survivors. Our virtual audiences included the constituents of the
UNC W omen's Center, Moxie Scholars at UNC, the NC Department of
Justice, the W ake County Domestic Violence Task Force, the
Orange/Durham/Chatham County branch of the American Association of
University W omen and the general public. Last winter, I spoke about this
project at a conference in Toulouse, France, and again at a conference in
Portsmouth, NH. I'll do so again at the National Storytelling Conference in
July. I am currently revising an essay about that 2021 OCAC grant project for
an international publication.
2024: Commissioned by UNC Process Series director Joseph Megel, I wrote
"Notes from a Pandemic Pothole" for the virtual Remembrance and Renewal
Storytelling Festival in 2021. Now called “Lucille Says,” it's an original
monologue from the point of view of a white, high-school-educated female
café owner in a southern college town. W ritten in first person, it addresses
the personal toll of the pandemic, its impact on a small business and its
confluence with America’s racial reckoning in 2020-2021. I published the
script and an article about the piece in Storytelling, Self, Society. "Lucille
Says" makes up the second half of my retrospective show "Myth America,"
first performed at the 2023 National Storytelling Festival. I have toured the
show to more intimate venues in DC, NH and W A since. "Myth America --
Storytelling as Civic Engagement" is the cornerstone of my current
application for an Artist Support Grant from the OCAC.

How do you plan to
market your project?
After confirming event dates with my neighborhood partners, I'll create virtual
fliers & hard-copy postcards to spread the word through partnership networks
& my own. I'll include events in my online newsletter and send press
releasees to various print & broadcast media outlets. I'll create a dedicated
page on my website; post on my own Facebook page & those of groups to
which I belong. I'll create listings about events for online calendars for
Orange County organizations & beyond.
