HomeMy WebLinkAboutMinutes - 19650201The Crange County Board of Commissioners met in regular session on Monday, February 1, 1965, at 10:00 o'clock a.m., in the Commissioners Room at the Courthouse in Hillsboro, N. C. Members present: Chairman Harvey D. Bennett, Commissioners Gordon B. Cleveland, William C. Ray and Henry S. Walker. Members absent: Commissioner Carl M. Smith. Due to the absence of the Clerk, S. M. Gattis was requested to take the minutes of said meeting.. Upon motion of Commissioner Cleveland, same being duly seconded, the Acting Clerk was asked to dispense with the reading of the minutes of the January 4th meeting. Chairman Bennett stated that in reviewing the minutes of the January 4th meeting he noticed that no reference had been made to action taken by the Board with reference to the Blind Aid Grants received from the Welfare Department. The Clerk was directed to insert a list of these grants into the January 4th meeting. Paul Siebel, Community Services Consultant, informed the Board that the County Advisory Committee, established through the Employment Opportunities Act, had prepared its first proposal for transmittal to Washington, D. C. This program included such items as Remedial Reading, Pre- School Reading and Adult Education. The Board directed Mr. Siebel to forward the proposal to Washington with their endorsement and approval. The following road petition was presented and the Clerk was requested to forward same to the State Highway Commission: Broogdocm (Brigadoon) George Jenkins of the Homestead Community near Chapel Hill presented the Board with a petition signed by 118 citizens of said community. Said petition requested that the Homestead Community area be zoned. 2rr. Jenkins stated that this area was being considered for zoning by both the towns of Chapel `fill and Carrbom . Discussion ensued. The Board advised Mr. Jenkins that said petition would be taken under consideration and that the signed petition and the map of the area would be on file with the Clerk to the Board. Jim Wight, Welfare Director, presented the following Aid to the Blind grants. Said grants were duly signed by Chairman Sennett. AID TO THE BLIND AGENDA February 1, 1965 Name Eff. The following department officials presented reports for the month of January, 1965: James Wight, Welfare Director Tom Bivins, Veterans Service Officer Cashe Boggs, Dog Warden E. M. Lynch, Clerk of Court The. Welfare Director also presented the semi-annual financial report of his department. This report was favorably received by the Board. Gera P. Sykes was present to discuss with the Board two bills which he proposed to have introduced in the General Assembly. The bills, entitled'A.Bill to Be Entitled An Act To Amend The Laws of Eminent Domain In North Carolina" and "A Bill To Be Entitled An Act To Provide For The Re-Evaluation of Real Property Taken For Public Purposes", were reviewed by the Board. Copies of this proposed legislation were given to each Board member at their January 4th meeting and same had also been copied in the minutes of that meeting. The bill entitled "A Bill To Be Entitled An Act to Ament The Laws of Eminent Domain In North Carolina" had been amended by Mr. Sykes. Upon motion of Commissioner Cleveland, seconded by Commissioner Walker the following proposed legislation entitled "A Bill To Be Entitled An Act To Provide For The Re-Evaluation of Real Property Taken For Public Purposes" was unanimously adopted. .380 A BILL TO BE ENTITLED AN ACT TO PROVIDE FOR THE RE-EVALUATION OF REAL PROPERTY TAKE! FOR PUBLIC When any telegraph, telephone, electric power, lighting or pipeline company, or the North Carolina State Highway Commission, acquires an easement over real property either by contract or condemnation, it shall be the duty of the county and of any municipality or other local ad valorem taxing authority or political subdivision within which the concerned lands may lie to re-evalue said lands. Said re-evaluation shall be accomplished not later than the year following the taking of aiW right of way or other rights under the power of eminent domain. Members of the County Board. of Education met jointly with the Orange County Board of Commissioners. The purpose of this joint meeting was to appoint a member for the County A. B. C. Board. Upon motion of Commissioner Cleveland, R. J. Smith, Sr., was unanimously re-appointed to the County A. B. C. Board for a term of three(3) years, said term to commence at the expiration of his present term. There being no other business, the joint meeting of the County Board of Education and the County Board of Commissioners adjourned. Sherman Shelton, Agricultural Extension Agent, and Mrs. Bonnie Davis, Home Economics Extension Agent, presented their Annual Narrative Report for 1961 to the Board. Commissioner Cleveland brought to the attention of the Board the fact that under G.S. certain hospital insurance companies are now exempt from property tax. It was his feeling that this statute should be repealed. Upon motion of Commissioner Cleveland, seconded by Commissioner Walker, and unanimously adopted, the legislative delegates from Orange County were to be advised of G.S. l/ and requested to introduce legislation repealing said statute. The Commissioners requested the County -Administrator to compile a list of tax exempt insti- tutions which are now located in Orange County. This list is to be made up of those institutions which he feels should not come under the tax exempt statute. By agreement of the Board, the following proposed legislation entitled "A Bill to be Entitled an Act to Ament the Laws of Eminent Domain in North Carolina", which was presented by G. P. Sykes, was unanimously adopted: A BILL TO BE ENTITLED AN ACT TO AMEND THE LA;;'S OF EMINENT DOMAIN IN NORTH CAROLINA When any telegraph, telephone, electric power, lighting or pipeline company acquires an easement either by contract or condemnation, it shall be the duty of such company in regards to said easement: (a) When any timber or brush shall be cut or cleared on the right-of-way or adjoining land, said company shall remove or destroy all slash, stumps and other refuse. (b) Except where the owners of the property has planted agricultural crops on such easement, it shall be the duty of the company to plant any cleared portion of such easement in a manner and with a type of planting which will conserve the soil, prevent wail erosion, be beneficial to wild- life and shall be approved by the North Carolina Commissioner of Agriculture. (c) Prior to the cutting of any timber on land adjacent to the right-of-way of said company, the company shall notify the landowner concerned that said timber is to be out, and such landowner shall be afforded the choice of retaining his timber so cut or of requiring such company to remove the out timber from his premises. Notice under this paragraph shall be sufficient if posted by regular Tinted States mail at least five days and not more than thirty days prior to the cutting of timber. If no response has been made to such notice when timber is cut, it shall be removed by the company. The violation of any of the provisions of this section shall constitute a misdemeanor punishable in the discretion of the court. Upon motion of Commissioner Walker the Clerk was directed to write the State Highway Commis- sion and request that the local load limit on County Road #1114 leading from N. C. highway 70 to Interstate 85 and locally known as the Buckhorn Road be removed. This motion was unanimously adopted. Chairman Bennett yielded the chair to Vice Chairman :-Talker for the purpose of tendering his resignation as a member of the County Welfare Board. Said resignation was accepted with regret. Upon motion of Commissioner Cleveland, seconded by Commissioner Walker, and unanimously adopted Commissioner Ray was appointed to fill the unexpired term of Commissioner Bennett on the County Welfare Board.
