HomeMy WebLinkAboutMinutes - 19641207Minutes of the Board of County Bommissioners December 7, 1964 .?(3 The Orange County Board of Commissioners met in regular session on Monday, December 7, 1964, at 10:00 o'clock A.M., in the Commissioners Room at the Courthouse in Hillsboro, N. C. Members present:' Chairman Donald Stanford, Commissioners Harvey Bennett, Gordon B. Cleveland, Carl M. Smith and Henry S. Walker. Members absent: None. The minutes were read and approved. Chairman Stanford asked for old business. No old business was brought before the Board. Upon motion of Commissioner Bennett, seconded by Commissioner Cleveland, the following resolution was adopted: ORANGE COUNTY BOARD OF COMMISSIONERS HILLSBORO, N. C. R E S O L U T I O N O F C O M M E N D A T I O N For Donald M. Stanford Whereas, Donald M. Stanford was nominated by the voters of Orange County to the Orange County Board of Commisioners in the Democratic Primary of May 1956, and Whereas, Donald M. Stanford was elected by the voters of Orange County to the Board of County Commissioners of Orange County in the General Election of November 1956, and Whereas, Donald M. Stanford was again nominated in the Democratic Primary of 1960 and again elected in the General Election of 1960 to the Orange County Board of Commissioners, and Whereas, Donald M. Stanford was elected by his fellow County Commissioners as Chair- man of this board in December of 1960 and has held this position continuously since that date, and Whereas, Donald M. Stanford through his boundless energy and keen insight has shown to this board and to the people of Orange County the pathway towards better local government, and Whereas, in 1964 Donald M. Stanford did not seek re-election to this board but instead was nominated and elected as the Member of the North Carolina House of Representatives from Orange County. Therefore, Be It Resolved, that the Orange County Board of Commissioners, acting through its members Harvey D. Bennett, Gordon B. Cleveland, Carl M. Smith and Henry S. Walker, now takes this means of expressing to Donald M. Stanford its sincere appreciation and deep gratitude for his faithful service, able leadership, and progressive ideas, and it wishes him and his family every happiness in the yeats ahead. Let a copy of this resolution be presented to the said Donald M..Stanford, a copy sent to the press, and the resolution be spread on the minutes of this meeting, this 7th day of December, 1964. /S/ Harvey D. Walker BOARD MEMBER /S/ Betty June Hayes CLERK Commissioner, Bennett. presented a framed copy of the resolution to Chairman Stanford. S. M. Gattis, on behalf of the courthouse employees and department officials, presented a gift of luggage to Chairman Stanford. There being no further business to come before this board, same was adjourned. V4 E. M. Lynch, Clerk Superior Court, administered the oath of office to the incoming commis- sioners Harvey D. Bennett and William C. Ray. These men then were seated as Commissioners of Orange County. The first item of business was to elect a chairman for the next two years. The County Administrator distributed ballots to the Board member for the purpose of electing said chairman. Harvey Bennett was elected to serve as chairman. Upon Motion of Commissioner Walker, seconded by Commissioner Cleveland, and unanimously adopted, the Board agreed to elect a Vice Chairman. Henry Walker was elected Vice Chairman to the Board of Commissioners. Chairman Bennett administered the oath of constable to Vernon Burch of Chapel Hill Township. Representatives of the Hillsborough Historical Society and the Historic Hillsborough Commission appeared before the Board. Mrs. Alfred Engstrom, Chairman of the Commission, asked the County Commissioners to halt demolition of the former Walker Milling Company building until further investigation could be made, as the historical groups need time to see what can be done towards preserving the building. Mrs. Engstrom was informed by Chairman Bennett that the County had entered into a legal contract with S. C. Cooper for the demolition of said building, and that at this time the Board was uncertain as to its position in the matter due to said contract. Mrs. Engstrom then requested that if the building could not be saved, that the bricks or a portion thereof be salvaged, as the bricks are of historic significance in that they were first used in the old Hillsborough Academy that later became Bingham School, built about 1$15. She further stated that it was the opinion of the two groups which she represented that the bricks should be kept in Hillsboro. Other members of the histarical groups voiced their opinions concerning the Walker i building. The Board agreed to inspect said building and to talk with Mr. Cooper before any action was taken on said matter. The following department officials presented retorts for the month of November, 1964: E. M. Lynch, Clerk of Court, presented the following letter to the Board; which had been addressed to him from Bert M. Montague, Administrative Assistant to the Chiif Justice: "The Chief Justice has entered an order for cancellation of the second week of a two week conflict session of Superior Court for Orange County for the trial of civil cases, said second week beginning 23 November, 1964." "Formal notification of that order is enclosed." Same Lora Liza Ann Winston $51.00 Discussion ensued on the Wlker Milling Company Building. Upon motion of Commissioner Cleveland, seconded.by Commissioner Ray, it was proposed that the County of Orange purchase the bricks of the Walker Building from contractor S. C. Cooper at a cost of $45.00 per 1,000. Said bricks are to be held for six months to allow the Historic Hillsborough Commission and/or the Hillsborough Historical Society ample time to secure funds for purchase of same. Chairman Bennett called for a vote on said motion. Commissioners Cleveland and Ray voted Yes. Commissioners Smith and Walker voted No. Chairman Bennett broke the tie and the motion was passed. The. County Attorney and the County Admistrator brought to the attention of the Board an offer which had been made by James R. Farlow of Chapel Hill. Mr. Farlow had offered to purchase a portion of the Mary Barnett tract which is now covered by an Old Age Assistance Lien. Mr. Farlow had offered Orange County $200.00 for a release deed on a certain portion of said property. Upon motion of Commissioner Smith, seconded by Commissioner Walker and unanimously adopted, the Board rejected Mr. Farlow's offer of $200.00 for a portion of the Mary Barnett property. Upon motion of Commissioner Walker, seconded by Commissioner Smith, and unanimously adopted, the following tax listers were appointed for the year, 1964: Hillsboro Township Remus J. Smith, Jr. Little River Township Mrs. Robert Murray Eno Township Mrs. J. D. Griffin Bingham Township E-velyn Tear Cheeks Township Mrs. Henry Heath Cedar Grove Township Joe Compton Chapel Hill Township L. R. Cheek Chairman Bennett presented a letter from the Asheville Citizen Times Publishing Company of Asheville, N. C. Said letter requested the County to purchase space in the inaugural edition for Dan K. Moore. Said request was denied. Sherman Shelton, Negro Farm agent, reported on his recent trip as technical leader of a group of ten Africans studying agricultural problems in this country. Mr. Shelton thanked the Board for their courtisies extended to him during his leave of absence. S. M. Gattis, County Administrator, explained to the Board the time schedule involved in the tax revaluation program currently being completed in Orange County. Sheriff, C. D. Knight, informed the Board that Judge W. Marshall Smith would not be hold- ing Recorders Court on Wednesday, December 9. Sheriff Knight stated that due to the number of Superior Court Terms, the Recorders Court Docket would become congested if some of the cases were not tried immediately. He requested that the Board appoint a Vice Recorders Court Judge to hold court on this date. Upon moticn of Commissioner Walker, seconded by Commissioner Cleveland, and unanimously adopted, A. H. Graham, Sr., of Hillsboro, was appointed Vice Recorders Court Judge for the purpose of holding court on Wednesday, December 9. Juries were drawn for the following terms of court: January 18, 1965, Civil Term 24 name January 25, 1965, Civil Term 18 names February 22, 1965, Criminal Term 36 names V6 RESOLUTION Upon motion duly made and seconded, the following resolution was unanimously adopted at the regular meeting of the Board of Commissioners of Orange County on Monday, December 7, 1964. WHEREAS, Honorable Raymond B. Mallard, one of the judges of the Superior Court of North Carolina, has hold several special sessions of court in addition to the regular sessions of Superior Court in Orange County during the current year and has been faced with many and varied intricate questions of law and procedure; and WHEREAS, Raymond B. Mallard, Judge, has presided over the above mentioned sessions of court with dignity, dispatch and fairness, both to the State of North Carolina and to the parties who have appeared in his courts; and WHEREAS, it is recognized by the citizenry of Orange County that Judge Mallard has made an outstanding contribution to the cause of justice and orderly court procedure during his judicial service in this county: NOW, THEREFORE, we, the members of the Board of County Commissioners of Orange County, do hereby commend Judge Raymond B. Mallard for his devotion to his judicial duties and for the learned and impartial manner in which he has conducted the above mentioned courts and for his deep knowledge of humanity as shown by the judgments rendered, all in the highest tradition of the administration of justice in the State of North Carolina. It is ordered that the Clerk to this Board present a copy of this resolution to the Clerk of the Superior Court of Orange County with the request that same be read during the session of court which began on December 14, 1964, and that same be entered as a part of the minutes of said court, with original copy delivered to His Honor, Judge Mallard. .Upon motion of Commissioner Cleveland, seconded by Commissioner Walker,the meeting was adjourned.
