PURPOSE: To make a recommendation to the North Carolina Department of Transportation
(NCDOT) and the North Carolina Board of Transportation (NC BOT) concerning a petition to add
Shagbark Court and Mocker Nut Lane in the South Grove Subdivision to the State-Maintained
Secondary Road System.
BACKGROUND: This request includes a petition for two (2) road additions to the State
Maintained Secondary Road System. The road lengths and widths are as follows:

The South Grove Subdivision is located in Orange County along US 15 501 S, northeast of Smith
Level Road (State Road 1919) (Attachments 1 and 2). This single-family residential subdivision
is within Chapel Hill's Extra-Territorial Jurisdiction (ETJ). However, per North Carolina General
Statutes §136-62, the Board of County Commissioners (BOCC) is an appropriate governing body
to approve the road addition request associated with the subdivision. There are no known
violations associated with the subdivision, as confirmed by the Town of Chapel Hill (Attachment
5).
The South Grove Subdivision was recorded on January 7, 2013 (Book 110/Page 178)
(Attachment 3). Shagbark Court and Mocker Nut Lane were designed to public road standards,
but have been private roads in the interim. The roads were intended to become public roads
when conditions met NCDOT maintenance responsibility and ownership criteria, as reflected on
the recorded plat. Shagbark Court serves as the entrance to the subdivision off of US 15-501
South and terminates in a cul-de-sac on the east end of the subdivision. Mocker Nut Lane
intersects with Shagbark Court and terminates at the northern property line in a road stub.

NCDOT has investigated this request and has submitted a petition to the BOCC for its
recommendation (Attachment 4). North Carolina General Statutes §136-62 and §136-102.6
require that road petitions for additions to the state system be made by the governing body.
Conclusion: The above-referenced application meets the criteria endorsed by the BOCC for
recommending acceptance of public roads into the State-Maintained System for roads approved
through the governing jurisdiction's subdivision process (NCDOT Subdivision Roads Minimum
Construction Standards, January 2010, revised July 2020).
FINANCIAL IMPACT: There is no direct financial impact to the County associated with this item.
NCDOT will incur additional maintenance responsibilities and costs.
ALIGNMENT WITH STRATEGIC PLAN: There are no Orange County Strategic Plan Goals
applicable to this item.
RECOMMENDATION(S): The Manager recommends that the Board:
1) Forward the Petition for Addition to the State Maintained System to the NCDOT for
Shagbark Court and Mocker Nut Lane in the South Grove Subdivision; and
2) Recommend the Department of Transportation accept the roads for maintenance as State
Secondary Roads.

2. Identify Contact Person (This person serves as spokesperson for petitioner(s)).
3. Attach four(4)copies of recorded subdivision plat or property deeds, which refer to candidate road.
4. Adjoining property owners and/or the developer may submit a petition. Subdivision roads with prior
NCDOT review and approval only require the developer's signature.
5. If submitted by the developer, encroachment agreements from all utilities located within the right of
way shall be submitted with the petition for Road addition. However, construction plans may not be
required at this time.
6. Submit to District Engineer's Office.

REQUIREMENTS FOR ADDITION
If this road meets the requirements necessary for addition, we agree to grant the Department
of Transportation a right-of-way of the necessary width to construct the road to the minimum
construction standards of the NCDOT. The right-of-way will extend the entire length of the
road that is requested to be added to the state maintained system and will include the
necessary areas outside of the right-or-way for cut and fill slopes and drainage. Also, we
agree to dedicate additional right-of-way at intersections for sight distance and design
purposes and execute said right-of-way agreement forms that will be submitted to us by
representatives of the NCDOT. The right-of-way shall be cleared at no expense to the
NCDOT, which includes the removal of utilities, fences, other obstructions, etc.
General Statute 136-102.6 (see page 29 for Statute) states that any subdivision recorded on or
after October 1, 1975, must be built in accordance with NCDOT standards in order to be
eligible for addition to the State Road System.

I am writing to confirm that the South Grove Subdivision is within Chapel Hill's Planning
Jurisdiction and was approved by the Chapel Hill Town Council on May 18, 2008. A Zoning
Compliance Permit was issued April 23, 2012 for streets and infrastructure. A Final Plat was
signed by the Town of Chapel Hill in December 2012 and recorded on January 7, 2013.
The project has prepared some minor revisions to the approved Special Use Permit, Zoning
Compliance Permit, as well as the Final Plat over the past couple of years. As of now, to the best
of my knowledge, the project is in compliance with all of the approvals issued.
As the project is outside of the Town's city limits,we have no objections to the request for the
streets to be included within the NCDOT SR system.
