SUBJECT: Bid Award — Fairview Park Tennis/Pickleball Court Expansion Project

PURPOSE: To:
1) Approve a construction contract with H.M. Kern Corporation of Greensboro, NC for the
construction of the Fairview Park Tennis/Pickleball Court Expansion Project;
2) Authorize the County Manager to execute the Agreement, subject to final review by the
County Attorney, and any subsequent amendments for contingent and unforeseen
requirements up to the approved budget amount on behalf of the Board; and
3) Approve the purchase of lighting fixtures from Musco Lighting for the Fairview Park
Tennis/Pickleball Court Expansion Project.
BACKGROUND: In 2023, the Board of Commissioners approved the transfer of funding within
the Capital Investment Plan for the expansion of the tennis court facility at Fairview Park. The
scope includes constructing three new tennis / pickleball courts and site drainage improvements.
In April 2024, Orange County published an Advertisement for Bids for the project. On April 25,
2024, the County received six (6) sealed bids from General Contractors. On June 18, 2024, the
Board rejected all bids and authorized staff to rebid the project later in the summer when
contractor availability could potentially increase, and costs may better align with available funding.
A rebid was advertised and held on September 12, 2024. The County received five (5) sealed
bids from General Contractors, with the lowest bid including two (2) add alternates (resurfacing
the existing courts and providing 2 benches) for $561,500. This total amount reflects a savings of
almost $180,000 from the initial bids earlier in the spring.
This project is a highly weather dependent type of construction, but is hopeful to be finished by
April 2025.
FINANCIAL IMPACT: There is $910,000 in the Fairview Park capital project for this project. The
low bid from H.M. Kern was $561,500, which does not include a separate contract for lighting.

The lighting equipment is proposed for procurement from Musco Lighting for $225,000 under the
group purchasing program — Sourcewell contract number: 041123-MSL. The total package for
construction with lighting is $786,500.

OBJECTIVE 7. Invest in services and programs that improve the health and quality of life
in the community.
RECOMMENDATION(S): The Manager recommends that the Board:
1) Approve a construction contract with H.M. Kern Corporation for the construction of the
Fairview Park Tennis/Pickleball Court Expansion Project and the purchase of lighting
fixtures from Musco Lighting; and
2) Authorize the County Manager to execute the construction Agreement, subject to final
review by the County Attorney, as well as any subsequent amendments for contingent and
unforeseen requirements up to the approved budget amount on behalf of the Board.
