PURPOSE: To consider awarding housing bond funds in the amount of $205,000 to Habitat for
Humanity to purchase land on Purefoy Drive in the Rogers Road community in Chapel Hill and
authorize the Manager in consultation with the County Attorney to enter into a Development
Agreement detailing the conditions of award.
BACKGROUND: In June 2004, the Board of County Commissioners (BOCC) approved a
revision to the Affordable Housing Bond Policy that incorporated a Land Banking Program that
provides the opportunity for local organizations to utilize bond money to purchase land that
becomes available in the community prior to the establishment of a firm development plan, A
total of $612,500 ($352,500 in FY 1997 Housing Bond funds and $260,000 in FY 2001 Housing
Bond funds) was allocated for this program,
An application for Land Banking funds was received on September 9, 2005 from Habitat for
Humanity requesting $205,000 to purchase three parcels of property on Purefoy Road in the
Rogers Road community of Chapel Hill, The property is vacant with the exception of the
presence of one mobile home currently occupied by the seller's son, Attached to this abstract
are two maps highlighting the location of the property. Habitat has plans to construct a total of
22 single-family dwellings on this property by December 31, 2010.
This property is in the Chapel Hill planning jurisdiction near the Rusch Hollow subdivision
currently under construction by Habitat far Humanity and adjoins a 6.75 acre tract currently
owned by Habitat for Humanity. Preliminary plans include the provision of public water and
sewer provided by the Orange Water and Sewer Authority by extension from Rusch Hollow to
serve this property, (See Water-Sewer Map) Additionally, this neighborhood is in an area that
the Town of Chapel Hill has targeted for a Small Area Plan to be developed beginning in the
Summer of 2006,
As required by the Orange County Housing Bond Policy, the Project Review and Selection
(PRS) Committee held apre-application conference with staff from Habitat to discuss the
proposed application, reviewed the submitted application, and then met with the organization to
discuss the committee's funding recommendation. Members of the Project Review and
Selection Committee include: County Staff Members: Gwen Harvey, Ken Chavious, Paul
Thames, Craig Benedict, Perdita Holt, and Tara Fikes; Commissioners Valerie Foushee and
Barry Jacobs; and Affordable Housing Advisory Board Members Barbara Mull, .labrina
Robinson, and Allan Rosen. The Committee also includes representatives from the Towns of
Carrboro, Chapel Hill, and Hillsborough in the person of James Harris, Loryn Barnes, and
Margaret Hauth respectively.
After review of the application as well as supplemental material submitted by Habitat the
Committee recommends the allocation of up to $205,000 in housing bond funds to assist in the
purchase of the Purefoy Road properties with the following conditions:
1. Habitat should engage the local community during the development planning phase.
2. A written agreement with the seller that ensures the current tenant on the property is not
displaced by the proposed development.
Attached to this abstract is the detailed recommendation from the committee.
FINANCIAL IMPACT: There is currently approximately $482,570 available for the Land
Banking Program from the FY 1997 and 2001 Affordable Housing Bond Programs. This
expenditure will leave a balance of $277, 570.
RECOMMENDATION (S): The Manager recommends that the Board award housing bond
funds in the amount of $205,000 to Habitat for Humanity to purchase land on Purefoy Drive in
the Rogers Road community in Chapel Hill and authorize the Manager in consultation with the
County Attorney to enter into a Development Agreement detailing the conditions of award.

The Project Review and Selection (PRS) Committee has reviewed the above referenced
application regarding the purchase of property on Purefoy Road in the Rogers Road
community in Chapel Hill, The following details the committee's recommendation for
bond funding for this project based on the original application, the past-review
recommendation conference, and additional application material dated October 20,
2005.
The Committee met with Susan Levy, Executive Director of Habitat for Humanity on
October 25, 2005 and shared the following recommendation,.
Specifically, the Committee recommends providing bond funds for this land acquisition in
the amount of $205,000 with the following conditions.
1. There should be formal evidence of an agreement with the seller regarding the
disposition of the two lots that are currently planned far resell to the owner once
Habitat has subdivided the lots, The agreement must consider the
consequences of purchase and non-purchase in a manner that ensures that the
current tenant is not displaced without adequate replacement housing.
2. Habitat should seek community involvement in the planning of the proposed
housing development on the site,.
Additionally, all bond awards require, at a minimum, an appraisal, title opinion, a site
inspection, and survey as well as a satisfactory Phase I environmental report, before the
award can be granted.. We have received the title opinion and environmental report and
they are currently under review by county staff-
