SUBJECT: Resolution to Coordinate With NCDOT to Provide Comments on Development-
Related Transportation Proposals Located Along Orange County's Western
Border

PURPOSE: To consider a resolution expressing intent and interest in coordinating with the
North Carclina Department of Transportation (NCDOT) to provide comments on development-
related transportation proposals located in Alamance County along Orange County's western
border.
BACKGROUND: North Carolina legislation does not require local governments to share
development proposals with neighboring local governments for the purposes of assessing
potential regional impacts and providing comments. Furthermore, North Carolina legislation has
given municipalities authority to plan within an established Extra-Territorial Jurisdiction and
enforce their own zoning and subdivision ordinances without formally coordinating with county
government.
Presently, there is no avenue for Orange County to comment on transportation-related
proposals within Alamance County or the City of Mebane even though such development may
have an impact on Orange County and the provision of public services,
The NCDOT District Office reviews all development proposals that access NCDOT-maintained
roads, whether located within a county or a municipal planning jurisdiction, to assess
transportation system impacts. Therefore, Orange County has an opportunity to provide
comments an development-related transportation proposals within Alamance County or the City
of Mebane through coordination with the NCDOT.
The attached resolution establishes Orange County's intent and interest in coordinating with the
NCDOT District Office to review and provide comments on major development proposals in
Alamance County and/or the City of Mebane that have potential impacts to Orange County
infrastructure and services. While Orange County has fostered good communications with staff
in the NCDOT Division 7 and District Offices, and has an informal relationship with the NCDOT
to comment on development in Alamance County and the City of Mebane, the attached
resolution requests a more formal process for reviewing such development,
FINANCIAL IMPACT: There are no direct financial impact associated with the approval of this
resolution.
RECOMMENDATION(S): The Manager recommends that the Board approve the proposed
resolution.
ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS
A RESOLUTION OF INTENT AND INTEREST TO REVIEW AND COMMENT ON
DEVELOPMENT-RELATED TRANSPORTATION PROPOSALS ALONG ORANGE
COUNTY'S WESTERN BORDER THROUGH THE NCDOT
WHEREAS, transportation planning is a regional planning effort that does not
limit itself to finite geographic boundaries; and
WHEREAS, the NCDOT District Office reviews development proposals within
different jurisdictions, whether county or municipal, to assess transportation system
impacts; and
WHEREAS, the coordination and communication among various local
governments can assist the NCDOT with their assessment of a development proposal
based on the local government's knowledge of existing and future land use, long-range
transportation plans, including public transportation plans, and other development
proposals that may be in the process; and
WHEREAS, NC legislation does not require specific courtesy review of
development proposals between proximate local governments to share and comment
on potential impacts, solutions and suggested traffic improvements; and
WHEREAS, NC legislation has given authority to municipal governments to plan,
through zoning and subdivision regulations, within an Extra-Territorial Jurisdiction
without formally coordinating with county government, even though such plans have
potential impacts to many county public services (e.g. Sheriffs office, schools, public
transportation, senior citizen and other social and health services), whether prior to
annexation or after annexation; and
WHEREAS, NCDOT can be the conduit to ensure that all affected local
governments have important input into the development review process with respect to
transportation impacts, no matter which jurisdiction, through an open development
review process; and
WHEREAS, the development review process can be conducted in a timely
manner to promote well-planned and orderly economic and housing development; and
WHEREAS, this suggested planning process can lead to less cost to the State
through better planning, dedication or reservation of necessary right-of-ways, developer
improvements and contributions; and
WHEREAS, NCDOT and Orange County have coordinated on many existing and
future transportation plans and improvements that have led to an improvement of the
health, safety and welfare of local and regional citizens and businesses;

NOW THEREFORE BE IT RESOLVED that the Orange County Board of County
Commissioners, to further the goal of coordinated and efficient transportation planning,
respectfully requests that the NCDOT District Office include and offer County
administration and planning staff the opportunity to review and comment on major
development proposals within Alamance County and/or the City of Mebane that will
impact Orange County infrastructure and public services.
