PURPOSE: To approve submission of the Annual Public Housing Agency Plan for the Orange
County Housing Authority,
BACKGROUND: The U.S. Department of Housing and Urban Development Department (HUD)
requires all agencies operating the Secticn 8 Existing Housing Assistance Program to prepare a
Five (5) Year Public Housing Agency (PHA) Plan and an Annual Plan, The County's
Department of Housing and Community Development administers the Section 8 Program that
provides rent subsidies to low income families in the County. Currently, the Section 8 Housing
Program serves approximately 623 families throughout the County including the towns of
Carrboro, Chapel Hill and Hillsborough.
The PHA Plan is a 5-year plan that describes the mission of the Agency and the Agency's long-
range goals and objectives for achieving its mission over the next five (5) years. The Board of
Commissioners approved this plan on .)anuary 18, 2001. Each year, this plan must be updated
via an Annual Plan that provides details about the Agency's immediate operations, program
participants, and programs and services and the Agency's strategy far addressing the needs of
the community in the upcoming fiscal year, The only substantive change in the Annual Plan
the cominq_year, HUD approved the project-based vouchers for the 24-unit Club Nova
Apartments being built in Carrboro, Construction should be complete by the end of this
calendar year.
FiUD provides a template for the plan, and the County's Annual Plan is provided with this
abstract, The plan was made available for public comment for the period March 1, 2004 to April
15, 2004 and a public hearing was held at the March 4, 2004 BOCC to receive public comments
as well, A summary of the public comments received along with a staff response is provided
with this abstract,

All of the comments received have come from the disabled community and ,many of the
comments relate to the provision of reasonable accommodations in the administration of the
Section 8 Program, During the coming year the Department will explore the availability of a
social work intern who may assist efforts to address the special needs of this population.
Additionally comments related to administrative processes contained in the County's Section 8
Administrative Plan and not the PHA Annual Plan. As noted in the attached report, the County
may amend the Administrative Plan in accordance with program regulations at any time during
the year Thus approval of the PHA Plan at this time does not prevent future modification to
administrative procedures and the Board may wish to provide guidance and feedback to staff on
a~ concerns or changes it would like addressed.
This plan must be filed with HUD and must contain the attached Certification of Compliance/
Board Resolution signed by the Chair of the Board of Commissioners in order to continue to
receive funding to operate the Section 8 Existing Housing Assistance Program.
FINANCIAL IMPACT: The Section 8 Housing Voucher Program is fimded entirely by the U.S,
Department of Housing and Urban Development with an annual budget of approximately $4
million dollars for 623 rental vouchers for low-income families.
RECOMMENDATION (S): The Manager recommends that the Board approve submission of
the Annual Public Housing Agency (PHA) Plan for the Orange County Housing Authority and
authorize the Chair to sign the Certification of Compliance/Board Resolution on behalf of the
Board.

Comment #2: Apply for more Section 8 Vouchers for the Disabled
Staff Response:
Opportunities to apply far new Section 8 vouchers from the U.S, Department of Hcusing and
Urban Development (HUD) are announced in a publication known as a Notice of Funding
Availability or NOFA when funding is available in a given budget year, In past years, NOFAs
are not available each year far new vouchers for the general low-income population, The last
time the County applied for new fair-share vouchers was 2002 when two applications were
submitted in March and July of that year, Both applications were not successful due to HUD
receiving more applicaticns than available funds, HUD does not traditionally provide more
information regarding the reason applications are not funded,
The most recently published Notice of Funding Availability (NOFA) announcing the opportunity
for vouchers for the disabled was in 2003. However, a review of the guidelines revealed that a
significant level of support services is required to be provided by existing non-profit
organizations and there was insufficient time to identify agencies able to provide the services
necessary, County staff will be more aggressive in monitoring future NOFA publications to
identify potential application opportunities.
A local advocacy group known as RANE has suggested that the County provide up to $3,000 to
a private consultant to apply for vouchers for the disabled should the opportunity became
available this year. The Board of County Commissioners could choose to appropriate money
for this purpose perhaps from the local Housing Trust Fund after a specific request from an
interested party upon the publication of a Notice of Funding Availability for Mainstream
Vouchers for the Disabled. Any funding request for professional services must be done in
accordance with local procurement procedures including the execution of a Professional
Services Agreement.
There have also been suggestions that Orange County explore the success of other housing
authorities such as Charlotte and Winston-Salem in acquiring vouchers targeted to persons with
disabilities. County staff will contact these housing authorities and other local communities to
gain more information regarding their mainstream programs in preparation for future funding
opportunities.
Comment #3: Current Waiting List Status
Staff Response:
In October 2001, the Department suspended receipt of new Section 8 applications because of
the anticipated lengthy wait for assistance -three to four years based on a turnover rate of
approximately 25% per year. With such a massive waiting list and associated waiting period,
department staff considered it unfair to continue to accept applications when rental assistance
may be years away. At that time the HUD Greensboro Office was consulted and they concurred
with our assessment. In October 2001, there were approximately 1024 applicants on the
waiting list. As of April 12, 2004, due to the process of withdrawing names from the waiting list
when turnover vouchers became available, there are currently 529 applicants on the Section 8
Waiting List. The current waiting list is described below:

In December 2003, HUD approved the designation of 24 project-based vouchers far persons
with disabilities who lease a dwelling unit at the planned Club Nova Apartments in Carrboro.
Construction is scheduled to be completed by December 2004. (This approval came after an
initial rejection of the project by HUD in June 2003 due to concerns that the project would serve
only persons with a specific disability, which is a clear violation of the Section 8 Project-Based
Voucher Program. Additional information was then submitted to HUD to confirm that the project
would be available to all persons with disabilities and the project-based vouchers were
eventually approved in December 2003.) In preparation for the availability of these units at the
end of this year (2004), the existing waiting list was reviewed to determine whether there are
currently persons with disabilities on the list.
After this review, it was found that there are less than 24 disabled persons on our existing list;
thus, it will be necessary to open the waiting list and receive new pre-applications for Section 8
housing assistance in order to take advantage of the leasing opportunities at the Club Nova
Apartments. Ccunty staff initially explored opening the waiting list to persons with disabilities
only, however, upon consultation with the Greensboro HUD office, staff was informed that the
waiting list must be open to all potentially eligible applicants and not just those with disabilities.
County staff recommends the PROPOSED date for accepting new pre-applications for the
Section 8 Program as September 2, 2004. Application interviews will be conducted at both the
Chapel Hill and Hillsborough offices on Tuesdays and Thursdays only from 9:00 am to 5:00 pm.
This proposed date will allow the department to complete a planned computer system
conversion, purge the existing waiting list, notify all interested parties of the opening of the list,
and plan for the human resources necessary to resume application intake.
The definite open application period will be announced well in advance through a variety of
media in an effort to reach all interested parties, Additionally, County staff will enlist the
assistance of interested disability advocates in publicizing the dates, times, and locations far
application in-take to ensure adequate notice to this population
Mental health advocates have suggested that we provide copies of the pre-application forms at
Club Nava in order for clubhouse staff and other advocates to assist potential applicants provide
the information necessary. In order to do this, we would have to assure that we are providing
the same accommodations far all persons with disabilities not just Club Nava members. That
would involve identifying all potential "ports of entry" for all disabled persons countywide, which
would be an extremely difficult task, As an alternative, staff suggests that, upon request by
potential applicants, family members, or other advocates, arrangements can be made for county
staff to visit an agency site or a potential applicant's home or other out-of-office location at a
predetermined time to conduct the pre-application interview. Additionally, staff has begun
discussions with local advocates for the disabled population to identify other methods for
ensuring that this segment of the population has full opportunities to apply for Section 8 funding
without violating individual rights and federal fair housing laws,
Waifing List Maintenance
Applications are maintained according to date and time of application and preference ranking.
The program presently has maintained the following Waiting List Preferences (equally ranked -
10 points) for the applicants that are:
a. Involuntary displaced;
b, Living in substandard housing to include homeless families; and
c, Paying more than 50% of their income for rent and utilities.
Additionally, the program has the following Local Preferences (equally ranked - 5 points) far:
a. Elderly or disabled families;
b. Families who live, work, or have been hired to work in the jurisdiction;
c, Families who are graduates or participants in an education and training program
to prepare for self-sufficiency;
d.. Graduates of transitional housing programs for homeless persons; substance
abusers; and victims of domestic abuse;
There has been question regarding whether the disabled can have a higher preference ranking
among the local preferences. (At this time, both the elderly and disabled have the same ranking
local preference.) Local housing authorities are able to establish local preferences along with
their preferred ranking. County staff will analyze this request and report back to the Board of
County Commissioners in late May regarding the feasibility of targeting the disabled as a higher
local preference than other target populations. Approval of submission of the 2004 Annual Plan
does not prevent later amendments to the agency's Administrative Plan.
Additionally, local advocates have asked that "any applicants who were dropped from the list,
whose failure to respond to PHA requests for information or updates were due to his/her
disability be reinstated in the order they were originally wait-listed". This would be a huge
administrative task given the number of persons that have been selected from the list during the
life of this program -approximately 20 years. As an alternative, staff recommends that any
previous program applicant that wants the agency to review their withdrawal from the list due to
the failure to respond submit a request to the agency as a reasonable accommodation due to a
disability. Additionally, staff recommends a proactive approach that will reduce the likelihocd of
this occurrence as discussed in Comment #4 that will address the needs of the disabled
population at the time the agency resumes accepting applications.
Comment #4: Lack of local agency policies for the disabled population
Staff Response:
In response to concerns regarding local policies to accommodate persons with disabilities,
county staff has reviewed the current Administrative Plan to identify current policies regarding
the provision of reasonable accommodations for the disabled population. These provisions are
articulated throughout the existing Plan that support the general Reasonable Accommodations
Policy included in the Administrative Plan's Statement of Policy that follows..
REASONABLE ACCOMMODATIONS POLICY [24 CFR 100.202]
It is the policy of this PHA (Public Housing Agency) to be service-directed in the
administration of our housing programs, and to exercise and demonstrate a high
level of professionalism while providing housing services to families.
A participant with a disability must first ask for a specific change to a policy or
practice as an accommodation of his or her disability before the PHA will treat a
person differently than anyone else. The PHA's policies and practices will be
designed to provide assurances that persons with disabilities will be given
reasonable accommodations, upon request, so that they may fully access and
utilize the housing program and related services, The availability of requesting an
accommodation will be made known by including notices on PHA forms and
letters. This policy is intended to afford persons with disabilities an equal
opportunity to obtain the same result, to gain the same benefit, or to reach the
same level of achievement as those who do not have disabilities and is
applicable to all situations described in this Administrative Plan including when a
family initiates contact with the PHA, when the PHA initiates contact with a family
including when a family applies, and when the PHA schedules or reschedules
appointments of any kind.
If the PHA finds that the requested accommodation creates an undue
administrative or financial burden, the PHA will deny the request and/or present
an alternate accommodation that will still meet the need of the person.
An undue administrative burden is one that requires a fundamental alteration of
the essential functions of the PHA (i.e , waiving a family obligation).
An undue financial burden is one that when considering the available resources
of the agency as a whole, the requested accommodation would pose a severe
financial hardship on the PHA..
The PHA will provide a written decision to the person requesting the
accommodation within iQ days. If a person is denied the accommodation or
feels that the alternative suggestions are inadequate, they may request an
informal hearing to review the PHA's decision.
Reasonable accommodation will be made for persons with a disability that
requires an advocate or accessible offices. A designee will be allowed to provide
some information, but only with the permission of the person with the disability,
All PHA mailings will be made available in an accessible format upon request, as
a reasonable accommodation.
In practice, reasonable accommodations have been and can be made in several ways upon
request including, but not limited to the following:
1. Home visits to complete annual recertification processes and applications;
2. Coordination with case managers/social workers/relatives/other authorized
representatives to obtain the written documents necessary for the program;
3. Agency visits to explain the Section 8 Program and answer general program
questions;
4. Increases in the voucher payment standard to accommodate higher rents for suitable
housing for persons with disabilities,.
5. Notifying the disability community before opening the Section 8 waiting list to accept
applications;
6. Providing extra time to gather documentation of eligibility;
7, Making exceptions to screening criteria regarding criminal histories based on
mitigating circumstances; and
8. Allowing time for extensions to the time allowed for a housing search,
It is important to note this is not an exhaustive list of possible accommodations. The PHA's
current Reasonable Accommodations Policy allows the agency to be flexible and responsive as
needs arise in the disabled community. However, in order far the Department to know that a
specific reasonable accommodation is necessary for program applicants and participants a
specific request must be submitted to the PHA since it is difficult to know the individual needs of
each person with a disability,.
As mentioned earlier, in an effort to increase outreach efforts, County staff has enlisted the
assistance of disability advocates and organizations serving the disabled population to identify
other methods far ensuring that the Section 8 Program adequately serves the disabled
community. As an example, one suggestion made to date involves this agency sending a copy
of written correspondence to a Section 8 participant (with their consent) to a designated service
provider who can assist them in meeting their program obligations, This is a reasonable request
and staff hopes to be able to continue to identify other effective outreach methods in
collaboration with other interested individuals and organizations. Plans have been made for
county staff to meet with iwo groups of interested groups in the coming months to continue this
discussion,
Comment #5: Possible utilization of HOME funds for rental assistance.
Staff Response:
Tenant Based Rental Assistance (TBRA) is an eligible use of HOME funds.. The 2004 - 2005
HOME Program design provides $264,000 far rental assistance for approximately 15 units for a
period of two years. Participants in the HOME TBRA Program will be selected from the Section
8 Pragram waiting list and the program and the pragram will operate as the current Section 8
Housing Voucher Program. Funds for this pragram should be available by October 1, 2004,
Specific guidelines for this program are under development, and as requested, the needs of the
disabled community will be considered during policy development, Additionally, the completed
program guidelines will be shared with interested disability advocates as requested,
Comment #6: Homeownership Program option under the Section 8 Housing
Voucher Program
Staff Response:
Homeownership assistance is eligible under the Section 8 Housing Vouaher Program.
However, given the acute need for rental assistance in the community, the recent allocation of
project based vouchers, and the availability of financial assistance for homeownership from
other funding sources including the HOME Pragram and the County Affordable Housing Bond
Program, a homeownership program has not been developed for the County to date..
BANE has expressed an interest in developing a Section 8 Homeownership Pragram and a
working group will be convened during the 2004-2005 fiscal year to develop guidelines for
establishing this program during the fiscal year,
Comment #7: Availability of assistance from local Congressman to acquire
additional housing vouchers in the County.
Staff Response:
Since the Section 8 Housing Voucher Pragram is a federal program, it is appropriate to enlist
the support of our Congressman to assist in the acquisition of housing vouchers far the
community.
