PURPOSE: To amend the Upper Eno Critical and Lower Eno Unprotected Watershed boundary
line on Orange County Parcel Identification Numbers (PINs) 9864-00-2205 and 9863-09-3922 to
reflect a ridgeline professionally surveyed on the parcels in 2024 (see Attachments 1 and 2).
BACKGROUND: Mr. Frank David Cohen and New Goloka Village, LLC, the owners of PINs
9864-00-2205 and 9863-09-3922, respectively, hired R.S. Jones &Associates, Inc., to survey the
parcels, including the ridge line between the two watersheds on the parcels. This professional
surveying work revealed a discrepancy with Orange County's mapped watershed boundary lines,
which are based upon the State's delineation of water supply watershed boundaries.
Based on staff review and coordination with the NC Division of Energy, Mineral, and Land
Resources (NC DEMLR) Water Supply Watershed Protection Coordinator, the sealed
professional survey represents the most recent and accurate data and should be recognized as
the true ridgeline and watershed boundary on the parcels. As a matter of policy, the State advises
delegated programs such as Orange County to notify the elected body of the watershed boundary
change for formal recognition. This item serves as that notification and acknowledgement will
serve as formal recognition. Staff will likewise notify NC DEMLR and the North Carolina
Environmental Management Commission (EMC) of the change, subject to County
acknowledgement. Staff will also correct the representation of the watershed boundary line the
subject property on all formal adopted maps.
Note: Critical and Protected Watersheds within Orange County are part of the County's delegated
Stormwater Management Program, as reflected in the adopted Orange County Watershed
Boundary Map (see Attachment 3). These watersheds are also adopted Zoning Overlay Districts
in the Unified Development Ordinance. Staff will initiate a Zoning Atlas amendment to formally
bring this overlay district into alignment with the State-recognized watershed, as featured herein.
FINANCIAL IMPACT: There is no direct financial impact to the County associated with this item.

SOCIAL JUSTICE IMPACT: There are no direct Orange County Social Justice Goals associated
with this item.
ENVIRONMENTAL IMPACT: The are no direct Orange County Environmental Responsibility
Goal impacts applicable to this item.
RECOMMENDATION(S): The Manager recommends that the Board:
1. Acknowledge this action; and
2. Authorize Planning Staff to start processing a Staff-initiated Zoning Atlas Amendment.
