Resolution of Approval PURPOSE: To review and approve the Williams Glen Major Subdivision Preliminary Plat application for the property with Parcel Identification Number 9883-09-8108, immediately east of Lawrence Road, in accordance with the provisions of Section 2.15 and Article 7 of the Unified Development Ordinance (UDO). BACKGROUND: An application for a Major Subdivision Flexible Development Preliminary Plat was received, proposing a 15-lot subdivision with 35% open space. Review Process: A Major Subdivision application requires the submission of a concept plan, a preliminary plat, and other documents, in accordance with Section 2.15 of the UDO. • First Action — Onsite visit with the Planning Director. Staff Comment — The onsite visit occurred on January 8, 2024. • Second Action — The applicant holds a Neighborhood Information Meeting (NIM). Staff Comment: The NIM was held on February 13, 2024, at 5:45 p.m. at the Orange County Public Library. • Third Action - The Planning Board reviews and takes action on the Preliminary Plat application. Staff Comment: The Planning Board reviewed the Preliminary Plat application at its regular meeting on April 3, 2024, and voted 8-1 to recommend approval of the Preliminary Plat. The Preliminary Plat application was presented at the February 15, 2024 Development Advisory Committee (DAC) meeting. DAC comments are contained in Attachment 4. 2 • Fourth Action — The BOCC reviews and takes action on the Preliminary Plat application. • Fifth Action — Per UDO Section 2.15.4, once all construction activities are completed, or appropriate performance guarantees are approved, the Planning Director shall take action on an application solely to affirm conformity with all applicable regulations and any established conditions, and approve the recordation of a Final Plat, allowing for the individual lots to be created. The Preliminary Plat application was provided to the State Clearinghouse for courtesy review on February 8, 2024. Planning staff reviewed the State Clearinghouse comments, as they pertain to the Major Subdivision project area, and did not identify areas of significant concern. Proposal: The applicant has submitted a Preliminary Plat (Attachment 1) to develop 15 single-family residential lots with approximately 35% (+/-9.95 acres) of dedicated open space, consistent with the open space requirements for a flexible development subdivision. The plat is compliant with all Orange County UDO's subdivision standards, and no objection or comment was identified by the DAC to the Preliminary Plat's approval (Attachment 4). Additional information and staff analysis regarding the proposal is contained in Attachment 2. Planning Board Recommendation: The Planning Board received and reviewed the Preliminary Plat application at its April 3, 2024, meeting and voted 8-1 to recommend approval of the preliminary plat (Attachment 1). Agenda materials from the meeting can be viewed at: https://www.orangecountVnc.gov/AgendaCenter/ViewFile/Agenda/ 04032024-1983 Planning Director's Recommendation: The Planning Director recommends that the Board of County Commissioners: 1) Consider the matter for action; 2) Review the staff report (Attachment 2), featuring analyses of UDO compliance and consistency of the application with Orange County's adopted plans; 3) Receive the Preliminary Plat application, and 4) Approve the Preliminary Plat, as submitted. FINANCIAL IMPACT: This request has been reviewed by various County departments which have determined that the approval of the request would not create the need for additional funding for the provision of County services. SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goal is applicable to this item: • GOAL: ESTABLISH SUSTAINABLE AND EQUITABLE LAND-USE AND ENVIRONMENTAL POLICIES The fair treatment and meaningful involvement of people of all races, cultures, incomes and educational levels with respect to the development and enforcement of environmental laws, regulations, policies, and decisions. Wood, LSS 9 INTRODUCTION & SITE DESCRIPTION A detailed soil and site evaluation was performed on 15 lots proposed for the Lawrence Road Subdivision, Lawrence Road, Hillsborough, NC (Orange County PIN: 9883194355). Wood Soil Consultants, PLLC (WSC) was retained to perform a detailed soil and site evaluations of the 15 lots to determine if there is sufficient Provisionally Suitable soil for Conventional Type or Low- Profile Chamber systems for at minimum, a 4-bedroom home, ideally a 5-bedroom home. The study area had been partially evaluated in a November 21, 2021 Reconnaissance Soil & Site Evaluation performed by WSC. The property was evaluated in accordance with the "Laws and Rules for Sewage Treatment and Disposal Systems", amended December 6, 2018. The area is mostly open field with some woods on the eastern fringes of the study area and along southern boundary. INVESITGATION METHODOLOGY The field survey was conducted on December 4 and 6, 2023 by Michael G. Wood, LSS and Ethan T. Wood. Soil borings were advanced with hand-augers and soil color determined using a Munsell Soil Color Chart. Observations of the landscape as well as soil properties (depth, texture, structure, soil wetness, restrictive horizons, etc.) were recorded. Soil borings were described per the USDA-NRCS, Field Bookfor Describing and Sampling Soils, Version 3.0. Soil borings and site features are noted in Figure 1. FINDINGS Thirty (30) soil borings, two each on the 15 lots, were advanced, and their locations noted on Figure 1. The minimum bedroom capacity is provided in Table 1. Table 1. A drainfield layout will also be required on every lot in order to determine the drainfield specifications; trench width,trench depth, LTAR, drainfield type (Accepted, Low- Profile Chamber, Panel block, etc.), etc. In order to perform the drainfield layout, the following items will be required: • The property lines and corners will be flagged in the field by a surveyor. • The house box will be clearly staked on each lot. • Any additional site improvements, such as a pool, should be staked. CONCLUSIONS The findings presented herein represent our professional opinion based on our Septic Suitability Evaluation and knowledge of the current laws and rules governing on-site wastewater systems in Orange County and North Carolina. There is ample soil to accommodate at minimum a 4- or 5- bedroom house on each of the 15 lots. Soils naturally change across a landscape and contain many inclusions. As such, attempts to quantify them are not always precise and exact. Due to this inherent variability of soils and the subjectivity when determining limiting factors, there is no guarantee that a regulating authority will agree with the findings of this report. Any concurrence with the findings of this report will be made by regulating authority at the time of Improvement Permit issuance. The site contains a stream with a 65-foot stream buffers, per UDO Section 6.13. Public Water and Sewer Private well and septic are proposed for the site. 3 15 Proposed Project Proposed Development Lawrence Road Partners, LLC, property owner and applicant, is proposing a flexible major subdivision including 15 single family homes and 35% (+/-9.95 acres) open space on +/- 28.17 acres. The applicant has proposed to pursue the flexible development option and has not submitted a conventional option, per Section 2.15.2(C)(3) of the LIDO. The Flexible Development Conservation Cluster option involves the preservation of a minimum 33% of the total tract's land area as protected open space. The applicant has submitted a preliminary plat (Attachment 1) with proposed lots adhering to the 1-acre lot size and proposing approximately 9.95 acres of open space. Landscape Buffer The Flexible Development plan identifies a 30-ft. Type B Buffer along Lawrence Road and a 20-ft. Type A Buffer along the southern parcel line. No additional buffers are required, per UDO Section 6.8.6. Recreational Facilities Pedestrian Open Space Area (POSA) has been identified on the Preliminary Plat as part of the Secondary Open Space area at the eastern end of the proposed cul-de-sac. The plan includes a 20-ft. Pedestrian Access Corridor providing pedestrian access to the remainder of the site. No roadway improvements are required by NCDOT, but the project will require a Driveway Permit. The new road shall not be interconnected to any adjacent properties and is proposed to terminate in a cul-de-sac conforming with the NC State Fire Code. Per LIDO Section 6.17.2(2), a traffic impact analysis is not required. The proposal is 25 for a 15-lot subdivision on approximately 28.17 acres with 35% (9.95 acres) of dedicated open space. The 26 parcel is located on Lawrence Road in the Eno Township, PIN 9883-09-8108. 27 28 Ashley Moncado: The next item is for you to review is a Major Subdivision Concept Plan and Preliminary 29 Plat application for the Williams Glenn Subdivision on approximately 28 acres. The site is undeveloped and 30 located within the Rural Residential zoning district and Lower Eno Unprotected Watershed. Surrounding 31 parcels are zoned as R1, R2 and R4. Parcels to the north and to the east are undeveloped. Parcels to the 32 south and to the west contain single-family homes and there is church directly west of the existing site. The 33 parcels is classified as 20-Year Transition Area in the Orange County Future Land Use Map, and it is classified 34 as Mixed Residential Neighborhood in the Central Orange Coordinated Area Land Use Plan. The applicant is 35 proposing a Flexible Major Subdivision, including 15 single-family homes. The average lot size is 1.12 acres. 36 Based on the Conservation Cluster of Flexible Development Option, they are required to provide, at least, 33 37 percent open space. The applicant is proposing 35 percent open space or 9.95 acres. The subdivision is 38 planning to meet the setback standards of the R1 zoning district. A 20-foot Type A landscape buffer is being 39 provided along the southern parcel line and a 30 foot Type B landscape buffer is provided on the western 40 property line along Lawrence Road. Access is being provided by a 50-foot public right of way, and the site will 41 also be served by individual wells and septics. For existing conditions on this site, and we do have the larger 42 Lawrence Road site, here, for review tonight. So please be mindful the actual subdivision, being located down 43 here in this quadrant. There's an existing tree line. There is also a stream located on the existing site that 44 would require a 65-foot buffer. I was going to move on to the site analysis, zoomed in to the actual site, the 45 actual parcel related to the subdivision. You can see the stream here, as well as a 65-foot stream buffer. The 46 lighter yellow includes areas with a slope of 7.5 to 15 percent, and this pink-reddish color here includes a slope 47 of greater than 25 percent. The Primary Open Space totals 1.09 acres, and includes the stream. The stream 48 buffer area and the little pocket of slope, there. The Secondary Open Space totals 8.86 acres and includes the 49 areas around the proposed lots along the northern end, the western side, and the southern side of the site and 50 includes the remaining areas. It's been identified by yellow for slope. And then, here, we have the Concept 35 APPROVED WITH CORRECTIONS 5.1.24 51 Plan. We can see the 15 lots, the lot lines, possible building location footprints. Wells are identified by the 52 blue dots. Potential septic areas are identified by the green polka dots at the rear of the lots. We can also see 53 the 50-foot public right of way that is being proposed to provide access to all the proposed single-family 54 homes, and that does include an 18-foot travel way that will be in that public right of way. Finally, there is also 55 20-foot wide pedestrian access corridor, which will be connected to the cul-de-sac, running north to connect to 56 the northern parcel, which would be the future home of the recreational facilities that were affiliated with SUP 57 that was approved by the Board of Adjustment. We have the Preliminary Plat, which you'll notice is very 58 similar to the Concept Plan on the last slide. Again, we can see the lot lines. We can see the setbacks that 59 are being proposed based on the R1 zoning district. Landscape buffer is being identified on the western side, 60 as well as the southern side of the parcel. Stream and stream buffer and stormwater control measures are 61 being identified here with circles, on the Preliminary Plat. The Preliminary Plat also identifies 20-foot-wide 62 drainage and access easements along the northern part of the parcel here. It kind of cuts between these two 63 lots along the southern side of the proposed lots. The Concept Plan for this application was presented at the 64 January 18th DAC. The Preliminary Plat was presented at the February 15th DAC. Comments are provided 65 in your agenda packets. The Neighborhood Information Meeting was coordinated by the applicant and held on 66 February 13th. The NIM report is in your packets as well. This is where we kind of get a little different from 67 the last application and what Taylor hinted at earlier this evening. Tonight, you will receive and review the 68 Concept Plan; approve the Flexible Development Option; and then you'll be looking at reviewing the 69 Preliminary Plat and providing a recommendation on the Preliminary Plat to the BOCC. The Planning Director 7o recommendation in front of you tonight, is to receive and discuss the Concept Plan application; approve the 71 Flexible Development Option contained in Attachment 1; and then receive the Preliminary Plat application and 72 recommend approval of the Preliminary Plat, as submitted. 73 74 Statler Gilfillen: I am the Eno Village representative to the Planning Board. Lawrence Road is a street. 75 It's one of the only bypasses of Hillsborough, and we're all aware of the traffic congestion and the problems 76 that we have. Each time that you add a new access to Lawrence Road, you begin to control or potentially 77 even make it more dangerous going up and down Lawrence Road. I have some serious qualms, not with the 78 development itself, with providing two immediate accesses to Lawrence Road. When I look at this, as a 79 licensed architect, with over 40 years of experience in planning and design, why it is really necessary to design 80 this to have two accesses that close together, with individual cars coming out of each one of those streets will 81 slow and congest the traffic along Lawrence Road? I have serious problems with the design as it's presented, 82 not the concept of what he's trying to do. Thank you. 83 84 Phil Koch: So I'm very familiar with layout from the SUP, as well as from this, and the two things are 85 actually separate items, and the DOT has required turn lanes for the access that's above, that's going into the 86 ball field area, play area, all of that that is involved in the athletic association and a separate entrance here. 87 And they have reviewed this entrance. They are in agreement that this is the best spot for the entrance. I have 88 looked at it with them out on the site. They have actually stated this, I believe, even when the SUP was going 89 through that this was an acceptable entrance, and now they've come back, and they've met with us in the field 90 and said this is where they want the entrance to be. It is near where the church entrance is, and they did not 91 want these lots coming out on to the roadway north. They did not want it to tie to the one for the ball field. 92 93 Statler Gilfillen: What's their logic for that? 94 95 Phil Koch: They wanted to go ahead and bring out to Lawrence Road. 96 97 Adam Beeman: Do you know if the road for the athletic fields, is that a private road or public? One of the comments refers to the lot sizes 108 and concept wastewater disposal areas prohibit the department's siting private wells on each lot, according to 109 the setback requirements of Orange County, and then a community well may be a solution, otherwise 110 permitting is subject to denial. Where's the impact of that item in the DAC report on the plan? 111 112 Phil Koch: That comment was made at the original DAC. The approval of this resolution authorizes and directs the Orange County Manager to accept for Orange County and on behalf of the public generally, the offer of dedication of all publicly offered areas/easements, including rights-of-way for the public portions of roads named "Kelsey Court" without maintenance responsibility. Per the Orange County Unified Development Ordinance (UDO) the applicant shall construct, maintain and/or improve all Common Open Space areas until such time as it is accepted for ownership and maintenance by a recorded Homeowner's Association (HOA). Before the Final Plat of Williams Glen can be approved by the Planning Department and recorded within the Orange County Registrar of Deeds office the following conditions shall be addressed: A. Declaration of Restrictions 1. The Orange County Planning Department shall author a Declaration of Restrictions (hereafter `the document') establishing and describing the 39 various development restrictions, standards, conditions, and requirements associated with development of, and within, the project. The document shall be recorded concurrently with the Final Plat and approved, as to form and content, by the applicant and the County Attorney. 2. The document is not intended to serve, supplant, or take the place of any document recorded by the applicant establishing local homeowner covenants, or deed restrictions enforced by either the applicant or an established homeowners association. B. Sewage Disposal 1. Each residential lot shall contain an adequate area for septic disposal and repair area, approved by the Orange County Division of Environmental Health. 2. The septic system location may restrict the size and location of improvements. The document shall contain this statement and further indicate information regarding the tentative location of septic systems is available from the Orange County Health Department, Division of Environmental Health. Each lot that does not contain a suitable building site shall be designated both on the Final Plat and by instrument recorded in the Orange County Registrar of Deeds as restricted for development potential as set forth in the UDO. 3. The owner/applicant shall not destroy trees located within identified land use buffers, stream buffers, open space areas, or tree protection areas denoted on the Final Plat for the installation of on-site waste disposal system drain or repair fields. 4. No septic system shall be located within a required stream buffer as detailed within the UDO. 5. The Owners shall include in the restrictive covenants provisions requiring each lot owner to have the septic system serving their lot inspected by a licensee of the North Carolina On-Site Wastewater Contractors and Inspectors Certification Board, who is properly registered to perform such inspections within Orange County, no less than one (1) time in every five (5) year period (unless inspections are required more often by rule or regulation of the Orange County Health Department) and to have the system pumped if recommended by the inspector. Payment for the inspections required under this condition shall be the responsibility of the individual lot owner or the homeowner's association as established by the governing Homeowner's Association declaration. These provisions shall be in a form approved by the County Attorney. 40 C. Wells 1. Each residential lot shall contain an adequate area for the development of a well to provide potable water supporting development of the property as approved by the Orange County Division of Environmental Health. D. Roads and Access 1. Kelsey Court shall be constructed to the standards of the North Carolina Department of Transportation in accordance with the approved Preliminary Plat. Each public roadway, as well as the proposed stormwater management system, shall be located within a minimum 50-foot right-of-way, with 5-foot utility easements on each side. Construction shall be inspected and approved by NCDOT. OR A letter of credit or escrow agreement shall be submitted to secure construction of the aforementioned roadways to the standards of the North Carolina Department of Transportation in accordance with the provisions of the UDO. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Planning and Inspections Department. The financial guarantee must reflect 110% of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. In this instance, the document shall state posted financial guarantee(s) will not be released until the road construction has been inspected and approved by NCDOT. 2. All lots shall receive access from the above public road. No driveway access for any of the lots shall be permitted off of Lawrence Road. 3. An erosion control and stormwater management plan for construction for the aforementioned roadway shall be submitted by the applicant to the Orange County Erosion Control Division for review and approval prior to any land disturbing activity on the site in accordance with the UDO. 4. Approved double-bladed street name signs shall be erected at the intersections of public streets prior to Planning Department signatures on the Final Plat or prior to issuance of any building permit if road construction is secured by letter of credit as described herein. 5. Prior to any construction or alteration of any existing access within the right-of-way of Lawrence Road, the owner/applicant shall secure a driveway permit from the NCDOT District Office. The owner/applicant shall submit a copy of the NCDOT-approved permit and NCDOT approval letter to the Planning Department prior to, or at the same time as, the request for a grading permit is made, or before Planning 41 Department signatures are affixed on the Final Plat, whichever is first. 6. Sight triangles (10' x 70') shall be shown on the Final Plat at the intersection of Lawrence Road and Kelsey Court. E. Land Use Buffers and Landscaping 1. The 30-foot wide "Type B" land use buffer along Lawrence Road and 20- foot wide "Type A" land use buffer along the southern parcel line, as identified on the approved Preliminary Plat. These buffers shall be maintained and/or preserved in perpetuity in accordance with the provisions of Section 6.8 of the UDO. The document, as well as any local covenants, shall require the applicant or future homeowners association to preserve the required land use buffer. 2. Trees within the tree protection area(s) denoted on the approved Preliminary Plat shall be preserved as proposed by the applicant. 2. Upon completion of roadway improvements Planning Department staff shall complete an inspection in the area to ascertain if additional roadway plantings are required in accordance with the provision(s) of the UDO. In the event additional plantings are required, the applicant shall submit a formal landscape plan re-establishing required vegetation. The owner/applicant shall install landscaping as indicated on the approved Landscape Plan and the Planning Department shall inspect and approve such landscaping before signing the Final Plat. It should be noted no part of any additional landscaping shall encroach into the ten (10) foot by seventy (70) foot sight triangles at the public road intersection. OR The owner/applicant shall submit a letter of credit or cash bond to secure required landscape installation and preservation. The owner/applicant shall provide, as specified within the UDO, an estimate of the cost for required preservation, plantings and their installation. The financial guarantee shall reflect 110% percent of the estimate and be issued by an accredited financial institution licensed to do business in North Carolina. 3. Provision for protection of existing trees shall be included in the Final Plat, as well as the recorded Declaration of Restrictions as prepared by the Orange County Planning Department. 4. Clear cutting or other removal of any trees or other vegetation on individual lots is prohibited as specified within the UDO. This requirement shall be further evidenced within the subdivision's recorded Declaration of Restrictions and the Final Plat. 5. The Landscape Plan shall detail required tree plantings along common property lines for each of the 15 proposed lots. Development of each individual lot shall necessitate the submittal of a landscape plan providing documentation on the installation and/or preservation of existing vegetation to comply with established landscaping requirements detailed 42 within the UDO. 6. The stream buffer areas denoted on the approved Preliminary Plat shall be left in an undisturbed, natural state. F. Drainage 1. The applicant shall submit a final Stormwater Management and Erosion Control Plan for approval by Orange County Erosion Control prior to the commencement of land disturbing activities. 2. Drainage easements shall be located on the Final Plat as required following review and approval of the stormwater management plan by Erosion Control staff. 3. Drainage culverts shall be sized and located appropriately, as required by NCDOT and Erosion Control, by a licensed North Carolina Professional Engineer. G. Emergency Services 1. The developer shall continue work between property owners, NCDOT and the Orange County Fire Marshal to ensure that adequate access/maintenance of fire water source(s) and suppression devices (e.g. fire hydrants) has been obtained. H. Parkland 1. At the time of recordation of the Final Plat, the applicant shall pay to Orange County $6,330.00 ($422.00 times 15 lots) payment-in-lieu-of- parkland dedication fee. I. Construction Waste 1. Per Orange County Ordinance, clean wood waste, scrap metal and corrugated cardboard and all present construction waste, must be recycled. 2. Per Orange County Ordinance, all haulers of construction waste must be properly licensed. 3. Prior to any demolition or construction activity on the site the applicant shall hold a pre-demolition/pre-construction conference with the County's Solid Waste staff. This may be the same meeting held with other development officials. J. Miscellaneous 1. The Final Plat shall contain a title block and vicinity map in accordance with the UDO. 43 2. The open space shall be conveyed into the Homeowner's Association before Planning Department signatures are affixed to the final plat. 3. Tree cutting in the delineated land use buffers along the perimeter of the project is prohibited except for necessary maintenance purposes, which has to be approved by County staff prior to any such tree cutting taking place. 4. Tree cutting/disturbance of flora within identified stream buffers shall be permitted only as detailed within the Orange County Unified Development Ordinance. 5. If street lighting is proposed, then a lighting plan shall be submitted to the Planning Department for review and approval prior to purchase of lighting fixtures from the utility provider. Any lighting shall meet the Outdoor Lighting Standards as set forth in the UDO. 6. A sign permit shall be obtained from Orange County for the subdivision sign located at or near the entrance of the subdivision prior to beginning construction. 7. Methods of disposal of trees, limbs, stumps and construction debris associated with construction activity shall be by some method other than open burning as required in the UDO. K. Certifications 1. A Certificate of Survey and Accuracy signed by a Professional Land Surveyor shall be notarized on the face of the Final Plat. 2. A Certificate of Declaration and Maintenance in the form provided in the UDO signed by the landowner and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 4. The North Carolina Department of Transportation shall certify that the platted portions of Kelsey Court has been entirely constructed to State standards or that construction plans have been approved prior to Planning Department signatures on final plat. 5. A Certificate of Approval signed by the Orange County Planning and Inspections Department shall appear on the face of the Final Plat. 6. All other required certificates detailed within the UDO, applicable to the project, shall be placed on the Final Plat for signature. NOW THEREFORE BE IT RESOLVED by the Board of Orange County Commissioners that the revisions to the Preliminary Plat for Williams Glen are approved in accordance with the above mentioned conditions and attached Preliminary Plat dated 44 February 21, 2024.
