HomeMy WebLinkAbout4_3_24 ORC Meeting Summary Approved 5.1.24 1 SUMMARY NOTES 2 ORANGE COUNTY PLANNING BOARD 3 APRIL 3,2024 4 ORDINANCE REVIEW COMMITTEE 5 6 7 NOTE: A QUORUM IS NOT REQUIRED FOR ORDINANCE REVIEW COMMITTEE MEETINGS. 8 9 MEMBERS PRESENT:Adam Beeman (Chair), Cedar Grove Township Representative; Lamar Proctor(Vice-Chair), 10 Cheeks Township Representative; Beth Bronson,At-Large Representative; Marilyn Carter,At-Large Representative; 11 Statler Gilfillen, Eno Township Representative; Chris Johnston, Hillsborough Township Representative;Whitney 12 Watson,At-Large Representative. 13 14 STAFF PRESENT: Cy Stober, Planning & Inspections Director; Perdita Holtz, Deputy Director—Long Range Planning 15 &Administration; Patrick Mallett, Deputy Director—Development Services; Lauren Coffey, Planner 1 16 17 AGENDA ITEM 1: CALL TO ORDER 18 Meeting began at 6:02 PM. 19 20 AGENDA ITEM 2: UNIFIED DEVELOPMENT ORDINANCE(UDO)TEXT AMENDMENT—TOBACCO AND HEMP RETAIL USE- To 21 review BOCC-initiated amendments to the UDO pertaining to"Tobacco and Hemp Retail"uses. 22 23 PRESENTER: Cy Stober, Planning & Inspections Director 24 25 Mr. Stober gave a brief presentation on the proposed amendments which were initiated by a BOCC member. 26 27 Chair Beeman confirmed that existing primary sales uses are existing nonconformities. 28 29 Mr. Johnston asked if there were any similar locational restrictions. Mr. Stober provided the example of how the 30 Ordinance handles sexually oriented businesses. 31 32 AGENDA ITEM 3: UNIFIED DEVELOPMENT ORDINANCE(UDO)TEXT AMENDMENT—REGULATORY REFORM COMPLIANCE 33 AND CONFORMANCE—To review Planning Director-initiated amendments to the UDO in response and pertaining to 34 NC Session Laws 2023-108 and 2023-137,which affect the County's abilities to regulate residential architecture, as 35 well as densities and impervious surfaces in water supply watersheds. 36 37 PRESENTER: Cy Stober, Planning & Inspections Director 38 39 Mr. Stober discussed changes that will occur to bring the UDO into compliance with State law. These include a 40 change of responsibility title of UDO compliance to the Planning Director, broadening the definition of Residential 41 Development, a 5-part test for Residential Density, and modifications to impervious surface ratios. 42 43 Mr. Stober discussed stormwater management applicability of the Ordinance changes. 44 45 AGENDA ITEM 4: UNIFIED DEVELOPMENT ORDINANCE(UDO)TEXT AMENDMENT—LANDSCAPING STANDARDS—To review 46 Planning Director-initiated amendments to the UDO pertaining to Section 6.8"Landscaping, Buffers&Tree 47 Protection"regulations. 48 49 PRESENTER: Cy Stober, Planning & Inspections Director 50 51 Mr. Stober explained the benefit of these changes to provide clarification, encourage connectivity, and bring the 52 language to reflect current best practices. 53 Approved 5.1.24 54 Chair Beeman requested that the language of these changes not be worded as"must."to allow for more flexibility in 55 the event of hardships. 56 57 Mr. Stober explained the changes will move the Protection of Existing Vegetation section,change Land Use Buffers 58 to Landscape Buffers and reduce the number of types of buffers, and eliminate reference to"scenic views." 59 60 Chair Beeman noted that planting should not be in front of utilities. Mr. Stober stated that standards will be cross 61 referenced with State Building Code. 62 63 AGENDA ITEM 5: ADJOURNMENT 64 The meeting adjourned at 7:03 PM.
