PURPOSE., To provide:
1. An update on the progress of the Churton Grove development,
2. A report on their annexation request to the Town of Hillsborough, and
3. Response to Churton Grove resident Ms. Osborn's inquiries.
BACKGROUND:
1. UPDATE
The Churton Grove project is a planned development of 410 single family and 216 multi-
family units. Phase 1, 59 single-family and Phase 2A, 78 single-family, have completed
their infrastructure and approximately 100 single-family homes have been built.
2. ANNEXATION
The developer, Churton Grove, LLC, Patrick A. O'Neal, Manager, requested annexation of
• Phase IIC — Commercial
• Phase IIB — 216 Multi-family
• Phase III & IV—273 Single-Family
pursuant to his letter (see attachment 1)of June 4, 2002 to the Town Manager of
Hillsborough. Phases I and IIA had previously been requested for annexation but were
held in abeyance at that time.
Condition 40 of the Class A Special Use Permit (SUP) states:
"The applicant shall request annexation by the Town of Hillsborough for each phase of the
development following the construction of required improvements." The County has found
it prudent in the past, as well as with more current policy, that the project proceed through
the development approval and construction process (rezoning, SUP, phased infrastructure,
project timing, etc.) before annexation. However, the recent request was prior to the
construction of any improvements.

There are many conditions within the County SUP that exhibit the close coordination with
Hillsborough on many issues of utilities and architecture.
Also pursuant to annexation law, the annexing municipality would have to prepare a report
on the feasibility of providing the project with public services. A letter from Eric Peterson
(June 6) and Town Board discussion on June 10 found that Hillsborough does not have
enough information to conduct an analysis at this time and since the project would be a
satellite annexation, there.would be question whether the project would exceed the town's
percentage limits of satellite annexation.
If annexation does occur pursuant to Section 160A-45-49, the undeveloped land within the
previous county Planned Development (PD) and SUP would be subject to the laws and
ordinances (including zoning)of the municipality. In other words, the County zoning
authority and SUP conditions would be expunged and be replaced by a new duly enacted
zoning designation from Hillsborough. Hillsborough would process and approve how the
remainder of the undeveloped land would be built:
In summary, the options from the developer to change conditions have been forwarded
from the county in the form of a letter dated May 22. This available amendment process
may have prompted the letter of June 4 by the developer to Hillsborough requesting
annexation to forego county zoning/SUP conditions. At this time, Hillsborough cannot act
on the request until more development information is given and suggested dialogue
between county/town commissioners is achieved.
3. OSBORN RESPONSE
Ms, Susan Osborn, a resident of Churton Grove, had questions concerning the timing and
construction of the pool/clubhouse and what help/requirements the County could impose
on the development. The attached material outlines the responses.
FINANCIAL IMPACT: None at this time.
RECOMMENDATION(S): The Manager recommends that the Board receive the report.

Dear John:
Please find attached a letter from the developers of Churton Grove requestiin annexation of
multiple phases of their project. This item will be on the Town Board's June 10 Board meeting
for discussion. The Board will decide whether or not to request the Town staff to conduct a
financial analysis/feasibility study for the request. The developer did not include acreage totals
for the various phases. Since this property is not contiguous to Hillsborough it may be that the
request exceeds the Town's allowable limit for satellite annexations. We currently do not have
enough information from the developer at this time to answer the question. I will keep you
updated on the status of this issue. Please don't hesitate to give me a call if you have any

Since May 8, 2002 Planning Staff has met and corresponded (see letters 1 & 2) with the
Churton Grove developer and another interested citizen group. The following
information is a status report of the Churton Grove (Scotswood) Planned Development
and responses to Ms. Osborn's questions which she re-wrote on May 28, 2002 and
forwarded to the Board of County Commissioners (see letter 3).
On June 12, 2002 Robert Davis and I met with three neighborhood appointees of the
Homeowners Association (HOA) still presently under the control of the developer. They
voiced independent concerns similar to Ms. Osborn and are interested in working with
the developer to achieve their goals.

Issue 1 — Request that developer meet "end of 2002" deadline for pool and
clubhouse availability '
The SUP Condition #27 (see attached) sets forth the recreation requirements which are
primarily active and passive dedications do not specify the requirement of a clubhouse.
The pool fence is noted under 27g and would be built later as part of the multi-family
project (Phase 2b) but has been approved by staff to be moved up in the project to a
site within Phase 2a where the approximately 15 acres of recreation land is centrally
located. A concept site plan for the active recreation area has been informally
submitted. There is not a requirement for a clubhouse and no timeframe on building the
pool except that it must occur before Phase III single family.
The county cannot force but only prompt the developer to proceed in sequence to build
the pool in Phase 2 within the time period for the 2nd — 25% of units/2 %2 year period
which extends to January, 2005.
Issue 2—Request that type and number of multi-housing units be identified
The quantity of multi-family units is a maximum 216 units. The density is approximately
7.5 dwelling units an acre on approximately 29 acres. There is no site plan for this area
at this time, only a concept plan (see Concept Plan 1) submitted in 1986 which roughly
reflects a town home product. The SUP does not dictate bedroom number or price
range, nor can our site plan requirements. Staff has informally discussed the need to
have a mix of 'reasonable cost' housing which can more easily occur in a town home
product.
Issue 3 — Request that the clubhouse and pool be of solid construction
The SUP does not mention the type of pool construction. During the building permit
stage, staff would ensure the design meets state standards which offer a variety of
acceptable construction methods. The.construction design is a product of initial cost
and long-term maintenance and is the developer's choice unless included in approved
Homeowners Association documents.
Issue 4— Request that no membership be sold outside our community
The only zoning limitation on outside pool memberships that the county can regulate is
the threshold between a private community pool and a commercial public pool. That
threshold is liberal for private pool purposes because a membership system can invoke
the private pool guidelines. The ratio of internal to external memberships is not written
into the code but a reasonable standard could be 80% internal. From a Health
Department standpoint, whether there is any ratio of internal to external is a moot
subject, any'collective use' is determined to be a public pool health standard.
The county (through letter #1) explained the process to make amendment to the SUP
conditions but also noted that other planning areas of current interest would likely be
folded into a current day reanalysis and processing through the Board of
Commissioners.

In summary, the county is not stopping the developer from building the clubhouse/pool.
Staff has established a positive dialogue with a new homeowners group. In addition,
staff continues with the developer to process and review the commercial site (Phase 2c
—see plan) and looks forward to the yet unsubmitted multi-family plan (Phase 2b).

This letter serves as a follow-up to our meeting of April 3, 2002 and fiuther clarification
of condition numbers 37 and 39 of the Planned Development Special Use Permit(SUP), Class A.
Correspondence on these issues and more was transmitted previously on March 9, 1999,April 6,
1999,Jun;28,2001 and on March 15, 2002 from the Orange County Planning Department.
Please also note that any condition of the Special Use Permit can only be modified by re-
processing of the Special Use Permit through our Planning Board and Board of County
Commissioners. The next available rezoning Special Use Pern&application submittal period is
Jun;24, 2002. The application procedures and timelines are attached(attachment 1 -3 pages).
This letter will focus on conditions 37 and 39 with additional notes on other subjects.
1. Condition number 37 is a project `sequencing' element which requires each phase to be
platted,constructed or bonded in the phasing order as listed Also, construction plans for
the public infrastructure must be approved in order. The limit of each phase and related
lots is noted(see map- attachment 2).
2. Condition number 39 is a project `timing' element which restricts development and
construction of the residential units in the development to no more than 25%of the total
residential units in any 2 12 year period So,even though you can plat,construct and/or
bond development infrastructue in all phases of the development in sequence pursuant to
condition 37 you cannot skip a phase in the development and construction. Anil, building
permits for residential units can only be obtained in accordance with the phasing plan as

limited by the timing plan. Since your 6rm.often sells lots to builders after platting, we
recommend that you notify the buyers concerning the phasing plan and the timing their
receiving building permits to avoid people buying lots that they cannot build upon for a
few years unless they know about this restriction. (Please see attachment 3 labeled
condition 39-Project Timing Program.)
3. The commercial phase is unaffected by condition 39 (timing)but is affected by condition
37(sequencing). The platting and infrastructure bonding or constructing in phases is
progressing in order. Phase I(single-Emily) and Phase IIA(single-family) have been
bonded or constructed.Phase IIB(multi-family)must be platted,bonde&constructed
prior to the development of Phase IIC.

The following are thoughts on recreation facilities from SUP condition#27(excerpts from the SUP are
enclosed):
The recreation area was shown on the approved preliminary plan as part of Phase HA and therefore was
platted with the plat recorded concurrent with Phase IIA(a single family phase). Recreation facilities to be
constructed within the recreation area which are intended to satisfy the Special Use Permit, should be completed
prior to any units receiving certificates of occupancy(CO)in Phase M. This would open the recreation area
approximately when 353 units of 626 of the total residential units in the project are complete. The 353 units
include 137 of the 410 single family units and all of the 216 multi-family units.
The recreation area improvements and facilities must be bonded accordingly, including the clubhouse
that was noted as part of the site plan. The site plan shows the clubhouse being part of the multifamily tract
(Phase IIB). If you are adding another clubhouse to the single family area,then it must be completed as above
noted

to the conditions of approval. "The rezoning and effective date of the special use permit shall
occur upon approval by the Water Resources Division of the N.C. Department of Natural
Resources and Community Development of a water allocation plan developed by and for the
Town of Hillsborough. Development of Scotswood shall occur pursuant to that plan."
The Eno River Management'Plan Implementation Agreement was adopted on February 6,
1989 and on February 11, 1997, the Town of Hillsborough commenced its new reservoir
project by the recording of plats of the reservoir project Condemnation of property for the
new reservoir project commenced on or about April 25, 1997. Commencement by the Town
of Hillsborough of its new reservoir project together with the adoption of the Eno River
Management Plan Agreement satisfy condition number 38 and resolve the question of the
availability of water. The change in the zoning of the property and the special use permit
effective date are March 31, 1998, the date of recording of this special use permit
The 410 single-family lots, the 216 multi-family units, and the 65,460 square foot commercial
complex shall be constructed in accordance with the Site Plan dated October 1985 and revised
January 2, 1986 and all commitments shall be as contained in the narrative statement of the
project all of which are incorporated herein and made a pan of this Special Use Permit
Copies of the final site plan and supporting documentation are on file in the Orange County
Planning and Inspections Department This Planned Development project is subject to the
following special conditions:
1. The grantee of this Special Use Permit shall post with Orange County, in a form
acceptable to the County Attorney, a bond or letter of credit in an amount equal to the
cost of all public improvements plus 10%. The amount shall be determined on the
basis of fully executed construction contracts or certification by a registered engineer
employed by the grantee of this Special Use Permit Security for construction of the
improvements in this project may follow phasing in the project Specifically,'as
improvements are completed in each phase a corresponding amount of money may be
released from the security instruments or the security instruments may be re-negotiated
based on the "yet to do" portion of the improvements.
2. Security shall be provided for the grading, paving and stabilization of all cleared areas,
streets and other vehicular tmvelways; sidewalks and other pedestrian walkways;
erection of street signs; utility installation and hookups; recreational facilities; and
landscaping.
3. All necessary easements to permit utility (electricity, telephone and cable television by
any cable television provider franchised by Orange County to serve this development)
installation, servicing and hookups to the developmentand to each unit within the
development shall be provided at no cost to the utility provider.
4. The grantee shall promulgate Articles of Incorporation governing tenancy in the
development and shall record a copy of the Articles of Incorporation and regulations
promulgated under this condition in the Orange County Registry of Deeds.
5. Roads, parking areas, walkways, street signs, utilities, recreation facilities and sites,
landscaping and mulching around multi-family units and commercial areas shall be

Bicycle paths throughout.
Open, grassed play area.
Adequate night lights for safety and security reasons.'
Appropriate landscaping.
C. Provide 10 parking spaces to serve the above activities within the 15 acre
recreation area.
d. Along either side of Nancy Hill Creek, designate 100 ft as open space/passive
areas with walking and hiking paths._ Provide public walkways (to be part of
the designated "open space area") to these areas from both Graham Drive and
Cameron Circle. Install bridges across the creek at either end and midway, in
conjunction with the public walkways. A pedestrian and non-motorized vehicle
easement shall be dedicated coterminous with the open space area.
e. Multi-family recreation facilities are to include an open grassed area and a
picnic.area (i.e.. tables, trash receptacles, grills).
f. Provide 13 parking spaces to serve the multi-family recreation facilities.
g. Install a fence around the pool for safety reasons:
h. Provide handicapped parking spaces and ramps within the parking facility for
the recreation area. The location of these spaces and ramps shall be approved
by the Zoning Officer and shown on the revised site plan. Construct all
walking and bicycle paths on slopes no greater than 5%.
28. All plans for drainage, soil erosion and sedimentation control shall be reviewed and
approved by Orange County and the site plan modified accordingly to satisfy the Soil
and Erosion specifications. In addition, Orange County shall inspect the installation of
control devices and the on-going work for the total project The project shall at all
times meet the requirements of the Orange County Soil Erosion and Sedimentation
Control Ordinance.
29. Construct and maintain stormwater devices to control the peak rate of runoff from the
commercial and multi-family tract. The detention devices shall be designed and
constructed so that the peak rate of runoff after development will not exceed the pre-
development rate for a 2(-year 24-hour storm and for storms of greater intensity.
30. Grading on the site shall be kept to a minimum. Existing vegetation shall be
maintained between units. Clearing shall only be conducted for purposes of installing
roads, utilities and other improvements until the improvements have been installed and
the developer conveys title to the property to the individual property owners
purchasing three or fewer lots. Reasonable care should be taken to retain all existing

19. All roads shall be named and the names not duplicate any other names within Orange
County. Road name signs to Orange County standards shall be erected at all
intersections.
20. A 10-foot non-access easement shall be provided along the rear of the lots'adjoining
Carolina Avenue and Second Street This easement shall be labeled so as to prohibit
driveway or vehicular access onto Carolina Avenue and Second Street.
21. Street lights approved by the Town of Hillsborough shall be installed throughout the
development as each phase develops.
22. The lift station at the southeast secti on of the project (lift station #1) shall be of
sufficient size, as determined by the Town of Hillsborough, to accommodate any
future connections by property owners along St. Mary's Road.
23. Prior to paving streets, utility service laterals shall be stubbed out to.the front property
lines of each lot. Sanitary sewer laterals shall be capped off above ground.
24. All water and sewer lines shall be installed according to plans approved by the N.C.
Department of Natural Resources and Community Development Division of
Environmental Management,
25. All water and sewer easements shall be shown on the site plan including easements to
adjoining property. All required easement documents shall.be recorded before final
plat approval.
26. The number and location of fire hydrants shall be approved by the Town of
Hillsborough prior to the effective date of the special use permit.
27. The following recommendations apply to the recreation area and facilities:
a. Provide a minimum of 15 acres recreational purposes (active and passive). The
passive recreation area would include the open space area along Nancy Hill
Creek
b. A minimum of seven (7) acres are to be developed for active recreational
purposes to include the following:
Tot lot/playground area with play apparatus for children, ages
pre-school to 14 (i.e.. swings, slides, climber, whirl) and benches for
adult supervision. Some shaded areas are to be provided within the tot
lot area.
One full-length basketball court.
Picnic area which includes a small shelter with 3-4 tables, 5-7
individual picnic tables scattered throughout the woods with 1 trash
receptacle and l grill per 2 tables.

RE: Churton Grove Community Amenities Issues
Dear Commissioners:
I reported upon concerns regarding the question of availability of amenities and the potential to
enjoy these amenities.as residents of Churton Grove community at the last board meeting on May
8,2002. On May 22,2002,a meeting with Churton Grove residents was requested by the
developer,with Jim Moore representing Churton Grove LLC. This meeting was held at the
Hillsborough Holiday Inn Express at 7:30 pm with many residents attending. Concerns about
safety regarding lighting and the configuration of paths were discussed. Also,a request for
names of those interested in being on certain committees,from which the developer would select
members, was made. There was also dialog about specific concerns regarding individual matters.
The next meeting is planned for August.
From my understanding,these were the issues discussed regarding completing and enjoyment of
the slurred amenities:
Issue: Request that developer meet"end of 2002" deadline for pool and clubhouse
availability:
The developer said that he"hoped"to have the clubhouse ready by the end of the year and the
pool, meeting local competition specifications,ready by"next spring." Mr.Jackson of Carolina
Aquatech Pool,who has spoken with Mr. Moore about building the Churton Grove pool,said that
if we do not see construction begin on the pool by sometime in August the pool would not be
ready in the spring.
Issue: Request that type and number of muldhousing units be identified:
The developer said that townhomes of two to four bedrooms,ranging in price from$130,000 to
$200,000,and in the quantity of 216, would comprise the multihousing component of our
community.
Issue: Request that the clubhouse and pool be of solid construction:
No mention was made of construction except to ensure that the pool would be of the proper
specification for participation in local swim competitions. My research with Carolina Aquatech
Pool,a company who builds many community and YMCA pools,makes these recommendations:
• Built with reinforced concrete.
• Use of Pentair filter.

• Use of Marlo,.i•pump (up to six lanes use a 7 %to 10 horse power pump; up to eight lanes use
a 10 to 15 horse power pump).'
Issue: Request that no memberships be sold outside our community:
The developer said that he projects selling 350 lots for detached homes and that Churton Grove
LLC holds 225 memberships to be sold"outside of our community"for use of the pool and
clubhouse. The developer said that he could provide those memberships as mandatory for those
who purchase townhomes. I concur with mandatory membership of the pool and clubhouse
amenities for the townhome residents,with the remaining nine memberships being unavailable
for purchase or other use. I base this recommendation on my research. Selling outside
memberships is not fair and reasonable, as this is not the method of business within
comparable communities in the RTP area. The communities included in my research are as
new as Churton Grove and offer houses in a similar price range and style,some of which also
offer townhomes or cluster homes:
