NON-PUBLIG HEARING ITEMS 9:00 057 1, Agricultural Business Options/Rural Enterprises - To receive a brief report on a proposal to allow a greater range of agricultural enterprises in the rural areas. Page 60: Under "Suburban Residential Areas. remove amendment date and paragraph which addresses lower residential densities [esuidng from tfie Southern Smaii Area Pian for certain areas ~in the Southern Triangle. c. Page 72: Under "Suburban Residential Areas. remove amendment date and paragraph which addresses lower resideritiai densities resulting from the Southern Small Area Plan for certain areas in the Southern Triangle. d. Following conclusion of the Public Hearing, the matter should be referred to the respective towns for decision and then to the Orange County Planning Board for a recommendation to the County Commissioners. We recommend that Exhibit A be amended to change the area to Rural Buffer as the expectation of future public water and sewer service is removed with the northward shift of the lJrban Services Boundary. Our preliminary recommendation is that the Orange County Commissioners, Chapel Hill Town Council, and Carrboro Board of Aldermen adopt the attached ordinance, amending Exhibit A of the Joint Planning Agreement. NOW THEREFORE, THE ORANGE COUNTY BOARD OF COMMISSIONERS, CHAPEL HILL TOWN COUNCIL, AND CARRBORO BOARD OF ALDERMEN HEREBY RESOLVE THAT EXHIBIT A TO THE JOINT PLANNING AGREEMENT BE AMENDED AS FOLLOWS: That the area bounded by Chatham County to the south, US 15/501 to the west, the Chapel Hill Extraterritorial Jurisdiction (ETJ) to the north, and Old Lystra Road to the east depicted as Transition shall be changed to Rural Buffer. U An area that has been classified as Transition from the outset of Joint Planning lies to the south of the Chapel Hill ETJ and is known as the Chapel Hill Southern Transition Area, It is bounded to the south by Chatham County, US 151501 to the west, the Chapel Hill ETJ to the north, and Old Lystra Road to the east., Amendments by the Town of Chapel Hill to its Comprehensive Plan in May 2000, and more recently, inclusion of the Water and Sewer Management, Planning and Boundary Agreement into the Joint Planning Agreement have resulted in this area being removed from the Urban Services Area - an area originally proposed far future public water and sewer service, As is the case with current development, future residehtial development will rely on private well and sewage systems resulting in a low density, rural residential pattern for the area. The joint planning staffs interpret this as a change in land use policy and recommend that the Joint Planning Area Land Use Plan and Map be amended to change the area from Transition to Rural Buffer.. The analysis for this recommendation is contained in the attached joint staff memorandum, FINANCIAL IMPACT: None identified. Joint Planning Basics Orange County-Chapel Hill-Carrboro Joint Planning is premised on two types of areas adjacent to the existing incorporated areas and ETJs: Transition Areas and Rural Buffer. This area is further defined as being in transition from rural fo urban or already urban in density. Urban services (public utilities and other town services) are now provided to this area or are projected to be provided to this area. Rural Buffer is defined as follows in section 1 2.G as being: That portion of the Joint Planning Area designated on the Joint Planning Area Land Use Map as such and designated in the Joint Planning Area Land Use Plan as Rural Residential, Agricultural, Public/Private Open Space, Resource Conservation, Extractive/Disposal Use and the overlay district designated University Lake Watershed Area. This area is further defined as being alow- densify area consisting of single-family homes situated on large lots having a minimum size of two (2) acres. The Rural Buffer is further defined as land which, although adjacent to an Urban or Transition area, is rural in character and which will remain rural, contain low-density residential uses and not require urban services (public utilities and other town services). Proposed Amendments to Joint Planning Area Land Use Plan and Map 1. Make the following amendments to the Joint Planning Area Land lJse Plan: a. Page 3: Amend map to change the designation of the Chapel Hill Southern Transition Area to Rural Buffer. b. Page 60: Under *Suburban Residential Areas, remove amendment date and paragraph which addresses lower residential densities resulting from the Southern Small Area Plan for certain areas in the Southern Triangle. c. The Southern Small Area Plan recommended that residential densities for the Chapel Hill Southern Transition Area be changed from one to five units per acre to one unit per acre for areas immediately east of US 15-501 and one unit per five acres for areas immediately west of Old Lystra Road; the SSAP did not recommend removing the area from that ultimately to receive urban services). Because of changed or changing conditions in a particular area of the County, B. To correct an error or omission in the Comprehensive Plan. C, In response to a change in policies, objectives, principles or standards governing the physical development of the County. Changes to the Urban Services Area referenced above represents a change in policies, objectives, principles or standards governing the physical development of the County. Proposed amendments to the Joint Planning Area Land Use Plan are evaluated against the Joint Planning Operating Principles, These policy statements are listed on pages 49-53 of the Plan. Open Space Principle: The existing open space system in Chapel Hill Township, which includes Duke Forest lands, the UNC buffer' around University Lake, the Morgan Creek Wildlife area, and existing agricultural and forest lands, should be protected from intrusion by incompatible land uses, Staff Comment: The proposed amendment is supportive of the principle. The Chapel Hill Southern Transition Area lies outside the open space features listed above, though it is worth noting that Wilson Greek, a tributary of Morgan Creek, flows through the area.. This indicates the need for additional scrutiny in the development review process generally resulting in increased huffers and setbacks, University Lake Watershed Principle: University lake water supply watershed should be developed in a manner which will protect the quality of the water supply, Very low density residential, low intensity commercial and agricultural land uses are appropriate in this area, The University Lake Watershed Area should be protected for reasons of water quality; developments should occur only at low densities, and water and sewer lines should not be extended into this watershed.. Staff Comment: This principle is not applicable to the proposed amendment as the area lies immediately east of the University Lake Watershed ridgeline. Higher Intensity UseslTransition Areas Principle: The more intensive land uses are most appropriately located within the towns and then within the areas adjacent to the Towns likely to become urban. A transition area should be designated, between existing developed areas and the rural buffer, as a target area for new development to occur. Staff Comment: The proposed amendment is generally supportive of this principle in that it recognizes that an area originally proposed for urban densities will not develop in this fashion due to a policy change regarding infrastructure. Existing residential development in the Chapel Hill Southern Transition Area is compatible with the Rural Buffer area to the east and changing the designation of the area to Rural Buffer will maintain this scale of development. Portions of the Chapel Hill ETJ to the north, lying outside the Urban Services Area and zoned Chapel Hill R-LD1, provide an intermediate density between this area and the higher densities of the Southern Village area, Rural Areas Principle: The rural residential and agricultural character of the Township outside the Towns and adjacent transition areas should be maintained. Rural lands currently existing between the Chapel HiIllCarrboro urban area and Hillsborough (rural buffer) should be preserved, Staff Comment: The proposed amendment is supportive of the principle. The urbanizing areas of the Towns are the major growth centers in the Township. The "infill" of existing urban areas is the guiding principle upon which the Chapel Hill Township Plan is based. "Infill" development of suitable vacant land within the Towns at existing or projected densities, as set forth the Towns' 1977 Land Use Plans should be encouraged. Staff Comment: The proposed amendment is generally supportive of this principle in That it recognizes that an area originally proposed for urban densities will not develop in this fashion due to a policy change regarding infrastructure. Amending the Joint Planning Area Land Use Plan and map to include it in the Rural Buffer area, and applying Rural Buffer zoning, will help maintain the existing rural character and inhibit urban sprawl. Utility Extensions Principle: The timing of utility extensions and the pace of growth should be coordinated. Water and sewer service should not be extended outside the boundaries of the Joint Planning Area. Staff Comment: The proposed amendment supports this principle b,y assigning the appropriate land use category fo an area no longer intended to receive water and sewer service. The amendment will bring closure to the process begun when the area was removed from the Urban Services Area. Allocation of Growth Principle: Areas where public facilities and services are available should be developed before areas where such services are not yet available. To the maximum extent feasible, no "spillover" growth from the two Towns will occur in Chatham or Durham Counties or in Bingham Township. In other words, all "spillover" development will be absorbed within the boundaries of Chapel Hill Township. The area north of Town is assumed to be most suitable for absorbing "spillover" because of transportation access, the large, efficiently sewerable area below the Morgan Creek-New Hope Creek divide, and existing growth patterns. The "Southern Triangle" area will develop only after all the suitable land south of and between the Duke Forest tracts has been developed. Duke Forest tracts will not be developed over the period 1980-2000. Staff Comment: The proposed amendment supports this principle by incorporating in the plan what has already been formalized in the Chapel Hill Comprehensive Plan and the Water and Sewer Management Planning and Boundary Agreement. It will protect Chatham County from "spillover" by maintaining the existing rural character of the area. Finally, it will remove the Chapel Hill Southern Transition Area from the "Southern Triangle,"making the entire area Rural Buffer. Chapel Hill as part of its Southern Small Area Plan has identified certain areas in the Southern Triangle as being suitable for densities not exceeding one (1) unit per acre for areas immediately east of U.S. 15-501 and densities not exceeding one (1) unit per five (5) acres for areas immediately west of Old Lystra Road. Delete *Amended 2/1/9.3 IIrbaa Residential Areas are similar to Suburban Residential Areas in terms of both housing types and public service availability. However, densities are higher, ranging from six (6) to thirteen (13) dwelling units per acre. Office-Institutional Areas is a category consisting of establishments which offer an array of financial, insurance, real. estate, legal, medical, and business services. Such areas generally have public utilities and services available and are located adjacent to heavily traveled streets. Future IINC Development is a category established for lands owned by the University of North Carolina, including Horace Williams Airport and adjacent parcels. Such lands are contemplated for expansion of the UNC campus, provided the Airport is relocated. Retail Trade Areas are limited in Transition Areas, including existing establishments at Starpoint and Calvander. Modest room for expansion is available in both areas. Light Industrial Areas are singular, consisting of the Chapel Hill Industrial Park on Eubanks Road. No additional industrial growth was projected in Transition Areas. Disposal IIse Areas consist of landfill sites, either existing or future. The existing landfill on Eubanks Road and the proposed site between Eubanks Road and Homestead Road are included in this category. *RUral Buffer and Conservation *Amended 4/2/90 2/3/92 (effective 2/24/92) The basic categories of Rural Buffer and conservation have been combined in the Joint Planning Area Land Use Plan to form a single land use classification - Rural Buffer. 60 ~b~ generally located throughout the Joint Planning Area using a neighborhood park one-half mile service radius. The parks are linked together by a system of greenways extending along drainageways, and pedestrian routes (sidewalks) along thoroughfares. Public/Private Open Space Areas Land areas owned or controlled by both public and private interests in the Transition Areas have been designated on the Land IIse Plan. These areas include UNC lands (excluding Horace Williams Airport and adjacent tracts) and a tract connecting the two landfill sites. These sites provide open space in the midst of areas planned for urban expansion. A Public/Private Open Space Area has also been designated along Interstate 40 in both Transition and Rural Buffer Areas to recognize the Major Transportation Corridor (MTC) district established to provide a 100-foot buffer along that route. The Plan recommends utilization of portions of the buffer to link proposed park and greenway areas together. New Hope Creek Corridor open Space Areas include some of the Resource Protection Areas and a portion of the Public/Private Open Space Areas which were designated as significant and worthy of protection according to the New Hope Corridor Open Space Master Plan completed in April of 1991. (See Master Plan Map following Strategy Maps). The areas are part of a system of open space in Durham and Orange Counties along New Hope Creek and its tributaries between Eno River State Park and U.S. Army Corps of Engineers land north of Jordan Lake. This category is made up of critical environmental areas such as stream beds, floodplains, steep slopes, and larger tracts of historic, educational, or recreational value. The New Hope Corridor Open Space Master Plan describes these areas in detail and makes specific recommendations as to how they should be protected or utilized for environmental, educational, and/or recreational purposes. *Suburban Residential Areas *Amended 2/1/93 ~ Delete Suburban Residential Areas include single-family homes, duplexes, apartments, condominium and townhouse projects. Areas designated as Suburban Residential are located where land is in the process of changing from rural to urban, suitable for urban-type densities and should be provided with public utilities ~, and services. Housing densities in the Suburban Residential category range from one (1) to five (5) units per acre. *However, densities may be lower than one dwelling unit per acre in Suburban Residential Areas. BACKGROUND: Amendments by the Town of Chapel Hill to its Comprehensive Plan in May 2000, and more recently, incorporating the Water and Sewer Management, Planning and Boundary Agreement into the Joint Planning Agreement in 2002 have resulted in a retraction of the area originally proposed to receive public water and sewer service, i.e., the Urban Services Area, The area affected by these changes is known as the Chapel Hill Southern Transition Area, It is bounded to the south by Chatham County, US 15/501 to the west, the Chapel Hill Extraterritorial Jurisdiction (ETJ) to the north, and Old Lystra Road to the east, It is triangular in shape and contains approximately 209 acres, The area contains 46 single-family dwellings (about one-third of which are manufactured housing) mostly along, or accessible from, Old Lystra Road, A concurrent Joint Planning Area Land Use Plan amendment (If approved) will change the land use designation of this area from Transition to Rural Buffer, As per the terms of the Orange County-Chapel Hill-Carrboro Joint Planning Agreement, Transition Areas are zoned by Chapel Hill and Carrboro for their respective Transition Areas, Chapel Hill R-LD1 zoning was approved for the Chapel Hill Southern Transition Area in 1993 following adoption of the Southern Small Area Plan, Changing the Land Use Plan designation of the area to Rural Buffer entails a shift to Orange County zoning -Rural Buffer zoning in this case.. Seventeen of these are less than one acre, 18 are between one acre and 1,99 acres, and the remaining 49 parcels are greater than two acres in size. This translates into 17 non-conforming lots under the current R-LD1 zoning and 35 non-conforming under RB zoning. Article 11.7.1 of the Orange County Zoning Ordinance states the fallowing concerning "Non-Conforming Lots For One-Family Detached Dwellings:" A one-family detached dwelling and customary accessory structures maybe erected, occupied and used on a separate non-conforming lot of record in accord with other requirements applying in the districts, A potential issue is parcels split by the Chapel Hill Extraterritorial Jurisdiction (ETJ) line. Of the 84 properties in the area, 40 are intersected by the line to varying degrees, Nineteen of these lots have more than 50% of their area in the Transition Area, For split properties with existing buildings, the side of the line on which the structure is located should be the determining factor regarding jurisdiction, Undeveloped lots will be determined by the proposed location of a new structure, Jurisdiction for larger undeveloped properties proposed for subdivision will have to be determined on a case-by-case basis with the possibility that one portion of a project might be subject to Orange County development regulations and the remainder to Chapel Hill's, FINANCIAL IMPACT: None identified. RECOMMENDATION(S): The Orange County Planning staff recommends approval of the proposed amendment to the Orange County Zoning Atlas contingent upon approval of the proposed amendments to the Joint Planning Agreement and Joint Planning Area Land Use Plan. The area affected by these changes is known as the Chapel Hill Southern Transition Area. It is bounded to the south by Chatham County, US 15/501 to the west, the Chapel Hill Extraterritorial Jurisdiction (ETJ) to the north, and Old Lystra Road to the east. It is triangular in shape and contains approximately 209 acres, The area contains 46 single-family dwellings (about one-third of which are manufactured housing) mostly along, or accessible from, Old Lystra Road. A concurrent Joint Planning Area Land Use Plan amendment (if approved) will change the land use designation of this area from Transition to Rural Buffer. As per the terms of the Orange County-Chapel Hill-Carrboro Joint Planning Agreement, Transition Areas are zoned by Chapel Hill and Carrboro for their respective Transition Areas. Chapel Hill R-LD1 zoning was approved for the Chapel Hill Southern Transition Area in 1993 following adoption of the Southern Small Area Plan. This translates into 17 non- conforming lots under the current R-LD1 zoning and 35 non-conforming under RB zoning. Article 11,7.1 of the Orange County Zoning Ordinance states the following concerning "Non-Conforming Lots For One-Family Detached Dwellings.." A one-family detached dwelling and customary accessory structures may be erected, occupied and used on a separate non-conforming lot of record in accord with other requirements applying in the districts. Jurisdiction A potential jurisdictional issue concerns parcels split by the Chapel Hill Extraterritorial Jurisdiction (ETJ) line. Of the 84 properties in the area, 40 are intersected by the line to varying degrees, Nineteen of these lots have more than 50% of their area in the Transition Area, For split properties with existing buildings, the side of the line on which the structure is located should be the determining factor regarding jurisdiction, Undeveloped lots will be determined by the proposed location of a new structure. If the agreement and plan are not amended to redesignate the Chapel Hill Southen Transition Area to Rural Buffer, the rezoning to RB cannot be approved. Process The three proposals listed above will be presented at a Joint Planning Public Hearing on Monday, March 29, 2004. The hearing will be held at the Southern Human Services Center, 2501 Homestead Road in Chapel Hill beginning at 7:30 P,M. A quorum of elected officials from the governing boards of Orange County, Chapel Hill, and Carrboro will be in attendance, Items 1 and 2 require a majority affirmative vote by all three boards, Rezoning the area to Rural Buffer requires a majority vote by the Orange County Board of Commissioners. BACKGROUND: In response to an increasing number of inquiries regarding accessory uses to bona fide farms and related uses that are agricultural in character, Orange County staff have been working together to examine, and where appropriate, revise county regulations regarding farm related uses. Discussion topics have included the following: Evaluating our current permitted land uses and accessory uses for bona fide farms; Identifying uses that are not allowed per our present ordinance but may be appropriate; Considering the needs of smaller operations; Addressing facilities that process andlor sell agricultural products, which may or may not be produced on site; Determining where such special agricultural operations and facilities are best suited, The overall concept is to categorize uses based on their link to an active farm and their land use intensity. Permitting procedures are to be based on the size and scale of the operation, and subject to performance criteria. Since the intent of the project is to facilitate the establishment of agricultural-related businesses the approximate length of the permitting process is shown, with arrows, at the bottom of the chart. BACKGROUND: From September 30, 2002 to May 22, 2003, the 23-member Chapel Hill Township Park and Educational Campus (CHATPEC) Work Group met to create a proposed Master Plan for this 193-acre County-owned site near the intersection of Eubanks Road and Old 86, This Master Plan project was the largest design project ever undertaken by Orange County and was undertaken using a process and set of guiding principles adopted by the Board. Significant attention was paid to the potential sharing of facilities between the educational campus and the park, and several playing field and parking areas are located with this in mind.. The design for the site, following site analysis and group discussions of needed/desired facilities, was accomplished via design charettes conducted with the two subcommittees of the Work Group (Educational Campus Subcommittee and Township Park Subcommittee), and subsequent discussions of the Work Group as a whole. On May 22, the Work Group held its final meeting and adopted the attached report, with the opportunity to submit subsequent proposed revisions to the report (these suggested changes were compiled over the summer by staff and are included as an appendix to the report), On June 26, a brief status report was presented to the Board, The Master Plan design contains a 96-acre park with a balance of low-impact and active recreation. While the majority of the total land area in the park is left in a natural state or proposed for low-impact recreation, there is a substantial active recreation portion of the G:\Comprehensivc Planning Div\GENE\2004 Public Hcarings\Mar 29 JPA\Twin Creeks\iCNfN-32904jpa Abs doe j ~ a~ ~r park. The design for the park would make this the largest active recreation node in the County. Six playing fields have been designed, along with a variety of court sports, a senior activities area, picnic shelters and other amenities.. Several meadow areas, in keeping with the Olmsteadian vision for the park, are also proposed for flexible open space uses. The proposed Educational Campus on the northernmost 76 acres features a co-located elementary and middle school with associated facilities. A separate "pod" in the campus was identified but not designed, and the Plan suggests that it could feature a second elementary school or another facility, to be determined at a later date. The remaining 21-acre part of the site (designated in the Pre-Concept Plan as "Potential School Site") was discovered to contain an archaeological site of some significance, and the Master Plan proposes only a tentative trail section in the perimeter of this area, pending further research. On December 9, the Board received the Master Plan report and selected a name for the site - Twin Creeks (Moniese Nomp*), The Board agreed to consider the Master Plan at a worksession after the first of the year, and asked staff to send the Master Plan to the Town of Carrboro, Once the Board of Commissioners have considered revisions and changes to the Master Plan, staff will prepare the materials for the required Conditional Use Permit application to the Town of Carrboro for phase I of the park.. Town review of this application is estimated to take 12 months. The remaining $800,000 is proposed for FY 2004-06.
