BACKGROUND: In a BOCC meeting in May 2002, Mr. Roy McAdoo of Efland asked the BOCC to direct County Staff to provide a sewer connection to a property on Fuller Road in Efland. The BOCC requested that staff provide a report outlining the issues of Mr. McAdoo's request. The County Engineer met with Mr. McAdoo subsequent to his appearance before the BOCC and had met with Mr. McAdoo on this issue on several occasions prior to this appearance. The resolutions and rules adopted by the BOCC during the process of creating the Efland sewer system required that the owners of all properties to receive a free sewer connect have execute a sewer request document during a sign up period which occurred in 1985. No one, including Mr. McAdoo, has been able to locate such a document for this particular property or even evidence that one ever existed. Therefore, according to the resolutions and rules adopted by the BOCC, the property is not entitled to a free sewer connection. Mr. McAdoo contends that the County made an error or errors during the sewer service sign-up process and when it failed to install a free tap on the property in question when the sewer system was constructed in 1985. Accordingly, he contends that the property is owed a free sewer service connection at this time, and he requests that the BOCC direct County staff to have such a connection installed without charge. Rl 2 FINANCIAL IMPACT: The cost for a sewer system connection is approximately$6,500, broken down as follows: $2,475 Town of Hillsborough tap fee; 2.6 acres at $1,000 per acre plus $600 per tap fee (total $3,200) to Orange County; and $825 to construct the tap itself. RECOMMENDATION(S): The Manager recommends that the Board receive the report as information. 3 MEMORANDUM TO: County Commissioners COPIES: John Link, County Manager Geof Gledhill,County Attorney FROM: Paul Thames, PE, County Engineer DATE: June 18, 2002 SUBJECT: Sewer tap requested by Roy McAdoo of Efland As per the request of the BOCC, for a report related to providing a sewer tap from the Efland sewer system to property belonging to Roy McAdoo and his family,the following information is provided. Over the past several years Mr. McAdoo has been in contact with County staff on several occasions about acquiring a sewer tap for a property belonging to him and his family(William R. McAdoo heirs property) on Fuller Street in Efland. It has generally been Mr.McAdoo's contention that the County should have installed a tap for this property when the Efland sewer system was originally constructed in 1987/88,but unaccountably failed to do so. Mr. McAdoo has been advised that, according to the resolutions and rules adopted by the BOCC during the creation of the Efland sewer system, each property owner desiring a free tap onto the system was required to sign a document requesting that tap during the customer sign-up process that took place in 1985. He was also advised that County staff have been unable to find evidence that such a document ever existed for this particular parcel(tax map number 3.32.13.11). Mr.McAdoo has likewise been unable to produce such a document. Mr. McAdoo has produced a number of documents related to condemnation process utilized by the County to acquire an easement across the front of the property for the purpose of installing the sewer main in Fuller Street(the property lines went to the center of Fuller Street and beyond,requiring that the County acquire an easement even though the line was installed in the center of the street). It appears that Mr. McAdoo's primary contention is that a member of County staff or a community volunteer working on behalf of the County during the Efland sewer sign-up process in 1985 failed to properly advise the McAdoo family as to the necessities of sign-up process or otherwise failed to have a sewer request document executed by the heirs. Accordingly,Mr. McAdoo contends that the property should now receive a sewer tap at no cost since the County's error led to the tap not being installed during the sewer construction process. The piece of property in question is 2.6 acres according to the County's tax data. Under the existing tap fee structure, the cost of a tap would be approximately$6500,broken down as follows: $2475 Town of Hillsborough tap fee; 2.6 acres at$1000 per acre plus$600 per tap fee(total $3200)to Orange County; and$825 to construct the tap itself If I may provide additional information, please advise.
