PURPOSE: To discuss topics of mutual interest between the governing boards of Orange
County and the Town of Hillsborough.
BACKGROUND:
Recreation Facilities in Waterstone and at Gold Park
The Hillsborough Board of Commissioners has expressed an interest in discussing with the
Orange County Board of Commissioners the possible future recreation facilities in Waterstone
Development and at Gold Park. The attached March 6, 2004 letter from Town Manager Eric
Peterson to County Manager John Link notes Hillsborough's desire to receive feedback from
the County on possible programming and /or maintenance that the County could provide at
these proposed facilities after construction has been completed.

2. Churton Grove Build -out Schedule
The Hillsborough Board of Commissioners has expressed an interest in discussing the possible
acceleration of the current permitted build -out schedule for the Churton Grove development
north of Hillsborough. Town Manager Eric Peterson, in the March 6, 2004 letter to County
Manager John Link, noted that the Town has previously dedicated water capacity for Churton
Grove that is currently sitting idle. The idle capacity is a potential revenue source for the Town
that is not being used, and any accelerated development of Churton Grove would generate
additional revenue for the Town, thereby hopefully diminishing the need for rate increases and
possibly even leading to a decrease.
Orange County Planning staff has provided a summary, for reference purposes, noting the
approved phases and development schedule under the Churton Grove Planned Development
Special Use Permit. The summary also details the status of the development's phases.

Status Report/Update on Waterstone Development
The Hillsborough Board of Commissioners has just recently approved the development permits
and plans for the Waterstone Development south of town between Interstates 85 and 40. A
discussion of the next steps associated with the development would be helpful for both Boards
and staffs.

4. Orange County Comprehensive Plan & Hillsborough Assistance
Orange County has been proceeding with the development of new Comprehensive Plan. The
attached March 9, 2004 letter from Town Manager Eric Peterson to County Manager John Link
indicates Hillsborough's desire for both Boards to receive a report on the County's efforts to
update the Comprehensive Plan. The letter also notes a desire for the Boards to discuss areas
in which Hillsborough may be able to assist the County.

5. Potential Joint Task Force for Coordinated Land Use Planning
Town Commissioner Mike Gering, in a March 16, 2004 email to Town Manager Eric Peterson,
noted a desire for the two Boards to discuss the possibility of establishing a joint Town /County
Task Force for Coordinated Land Use Planning. The Boards can discuss this concept and may
desire that Town and County staffs work together in the coming months to develop a proposal
which can reviewed and approved by both Boards.

6. Future Plans for Former Orange Enterprises /Current Alternative School Site
The Town of Hillsborough, after substantial coordination with the County and Orange County
Schools, was recently able to approve the location of an alternative school in a County -owned
modular building on property across from the Whitted Human Services Center at the
intersection of Hassel and Tryon Streets, Orange Enterprises was previously located on this
property in a building that has since been deconstructed, and the current modular facility had
housed the Orange County Library while renovation efforts were occurring in Whitted.
Town Commissioner Mike Gering has requested in a March 16, 2004 email to Town Manager
Eric Peterson that, for the benefit of the neighbors in the area, the Boards discuss future uses
of the property once the alternative school is moved to a permanent site and the current
modular structure is removed.

7. Information Kiosk at Old Courthouse
In the attached March 9, 2004 letter, Town Manager Eric Peterson details that Hillsborough
would like to discuss with the County the possibility of locating an information kiosk on County
property at the Old Courthouse. Downtown Hillsborough merchants have expressed an interest
in such a facility. Additional information may be available at the meeting on this proposal.

9. Updates and Potential Discussion Topics — Orange County
a) Outdoor Advertising Billboards on Interstates
During a recent meeting of the Orange County Legislative Issues Task Force, the question was
raised regarding the location of new outdoor advertising billboard signs along Interstates 85 and
40 within Orange County. It was the Task Force's general understanding that new signs were
not allowed within Orange County's jurisdiction, but there is uncertainty regarding the standards
within Hillsborough's jurisdiction along the interstates. Town staff was subsequently contacted
and, at the joint meeting, will update both Boards on Hillsborough's standards for outdoor
advertising signs along the interstates,

b) Transportation Improvements
The Orange County Board of Commissioners has indicated a desire for an update /discussion
with the Hillsborough Board on proposed transportation improvements of interest to both
Boards. The most recent version, dated March 18, 2004, of the DCHC MPO Regional Priority
List — Division 7 that relates specifically to Orange County is attached, and should provide a
basis for review and discussion by the Boards.

topics. There are no action items requiring formal Board decisions,

Dear John,
In preparation for the upcoming March 22nd joint meeting between the governing boards of Orange County and
Hillsborough, the Town's Board of Commissioners request that the following items be included on the agenda
for this meeting:
Recreation — In prior discussions, Orange County has indicated that if Hillsborough provided recreation
facilities (e.g., soccer and baseball /softball fields) that the County may be willing to provide
programming at these facilities. If Waterstone is approved, its developers indicate they will design
park facilities (with input from the Town) for the entire 10 -acre tract and then build a soccer field and
children's park on half of the tract within the first three years of the project The Town is responsible
for constructing whatever field and facilities would be placed on the other half'. Any feedback from the
Orange County Commissioners regarding their desire for possible programming and/or maintenance of
Town- owned /constructed recreational facilities will assist Hillsborough as it plans for future projects.
Gold Park is another potential site the Town is considering locating ball fields sometime in the future.
Churton Grove Build -out Schedule — The Town's Board of Commissioners would like to discuss this
topic to explore whether Orange County may have an interest in possibly accelerating (to some level)
the current permitted build -out schedule for the Churton Grove development. The Town Board's
interest in this matter is related to available water capacity for Churton Grove that is currently sitting
idle since it is dedicated to serve the future phases of this development. This idle capacity is a potential
revenue source that is not being used. If development at Churton Grove is somehow able to occur
faster it would direct more revenue into the Town's Water /Sewer Fund. This revenue would be used to
help prevent the Town's rates from growing higher and possibly allow for a rate decrease to occur.

Churton Grove has been constructed in accordance with the phasing schedule above -
The Developer has finished Phase I and II - -A and sold all lots to individual builders.
phase II-B (multifamily) was approved for two- and three -story buildings with a
maximum of 216 dwelling units for a density of 7.32 units per acre. During design of
the site it became apparent that the construction o1F216 units would overburden the
site. Therefore, the number of units in the entire multifamily phase has been reduced
from 216 units to approximately 170 -174 units for a density of 5.90 units per acre.
Section Otte will include thirteen `pad lots' that will be sold to Beazer Homes, the
contractor for the multifamily portion of the projert. Thirteen buildings will be
constructed on these lots. Each building will be a 3 -unit, a 4 -unit, a 5 -unit or a 6 -unit
two- story, multifamily structure. The 13 buildings will be further subdivided into 74
individual town homes. All units are to be For Safe. The ultimate number of dwelling
units will be dependent on the types of units that sell best. According to the Developer,
Beazer will submit plans before the end of January 2004 for two buildings consisting
of II units, with additional building construction to begin as pre - selling of the units
accelerates.
The name of the multifamily section will be Braddock Park at Churton Grove.

The Town Board requested that several other items be placed on the March 22 "d Joint
Meeting Agenda. I apologize for not being able to include all this information in one
letter. If possible, please add the following items for discussion:
• Update /discussion on new water restriction ordinance proposed by Hillsborough
• Report on Orange County's effort to update its Comprehensive Plan and areas in
which Hillsborough may be able to assist.
• Discussion regarding interest of downtown Hillsborough merchants to place an
information kiosk on County property at the Old Courthouse (Commissioner Eric
Hallman is getting me information on this topic that I'll forward to you for inclusion
as an attachment as soon as I receive something).
• Update /discussion on Fairview Park as well as progress regarding the proposed land
swap between the Town and County to address facility needs (e, g,, Town Motor Pool
facility).
• The Town will provide an update on the Riverwalk project.
• Discuss the Occaneechi Indian Village (one of the Town Commissioners heard that
they may be moving the village)

Eric,
I understand if it is too late, but I have several subjects I'd like to discuss at our joint meeting with the BOCC:
1. Plans for the site at Hassel and Tryon when the alternative school is relocated to a permanent site I
believe the neighbors need reassurance from the County about moving quickly to replace the temporary
buildings with something that enhances the neighborhood. When the county demolished the building that
was there, I believe the neighborhood was promised that It wouldn't be replaced by another parking lot.
2, Is there an interest In the BOCC for establishing a joint taskforce for coordinating land use planning? At our
retreat, this subject came up. Since Orange County Is In the process of revising their land use plan, it
would be a good time to start coordination with the county.

Section 8
SIGNS
8,1 Intent
it is the general intent of this Section to limit jsiM in the commercial districts in relation
to the intensity of the use of the district and its surroundings, to control the number area
and location of signs in other districts; and in addition to regulate or prohibit s_Gns of a
commercial nature in districts in which commerce is barred
82 Signs Subject to Control
All signs visible from the public right -of -way, both new and existing, shall be erected,
maintained, and operated in accordance with this Ordinance and other relevant controls
unless specifically exempted The definition of "sign" also includes those messages
inside a building specifically oriented to persons outside the building The provisions of
this section do not apply to window displays of merchandise
8 3 Zoning Compliance Permit Required
Before any si n, except those specifically exempted from such a requirement, shall be
erected or structurally altered, a Zoning Compliance Permit must be obtained
In the case of a multi- tenant development, the zoning compliance permit shall be issued
in the name of the owner or the multi- tenant development or his agent rather than in the
name of any individual tenant thereof, and it shall be the sole responsibility of such
owner or agent to allocate among the tenants the permissible sign surface area An
allocation report shall be submitted to the Planning Department before each new
freestanding sign is erected.
84 Signs Not Subject to Permit Requirements
The following signs are not subject to the permit requirements of this Ordinance, but are
subject to Historic District requirements for Certificates of Appropriateness when located
in the Historic District.
a) Non - illuminated signs not exceeding two (2) per lot and six (6) square feet each in
area, of a non - commercial nature and bearing only property identification
numbers and names, post office box numbers, and names of occupants of the
premises Signs two (2) square feet in area posted on private property relating to
private parking, warning the public against trespass or danger from animals.
b) Flags or insignia of any governmental or non - profit organization when not
displayed in connection with commercial activity or promotion One flag of the
United State and the State of North Carolina may be displayed in connection with
a commercial activity without being subject to the permit requirements of this
section.
c) Legal notices, identification and informational signs and local traffic directional
signs erected by or on behalf of a governmental body.
d) Memorial signs or tablets, and names and construction dates of buildings when
cut into any masonry surface
e) Signs not exceeding four (4) square feet and bearing no advertising matter
directing and guiding traffic on multi- family or non - residential property

f) At any entrance to a subdivision or multi- family development, there may be not
more than two (2) suns identifying such subdivision or development A single
side of any such sign may not exceed sixteen (16) square feet, nor may the total
surface area of all such signs exceed thirty -two (32) square feet
g) Internally lighted or unlighted church or governmental bulletin boards and
identification signs, not exceeding one (1) per abutting street and not to exceed
thirty -two (32) square feet,
h) Announcements by public or non - profit organizations of fund raising events,
special events or activities of interest to the general public, other than political
signs. Signs maybe erected up to 2 weeks prior to the event and shall be removed
within 48 hours after the event. Such signs shall be of rigid construction (not
banners) and shall not exceed 8 square feet in area. Signs shall be limited to 4 per
event and displayed at different locations. No more than 2 signs advertising
different events may be placed at one location For purposes of determining the
number f signs, the use of a banner permitted by Section 8.5.f shall count as one
of the 4 allowable signs, but shall not limit the placement of two additional signs
for different events at the banner location Signs maybe located within the public
right-of-way, but not in intersection site triangle.
i) Temporary real estate sign for lots of less than five (5) acres, a single sign on
each street front The sign shall not exceed four (4) square feet in area and may
contain the message that the property is for sale, lease, or rent and the name,
address, and phone number of the agent. For lots of five (5) acres or more in area
and having a street frontage in excess of four hundred (400) feet, a second sign
not exceeding thirty -two (32) square feet in area may be permitted.
j) construction site identification signs whose message is limited to identification of
the project, the architect, engineer, contractor, and /or other individuals or firms
involved with the construction, the intended use of name of the building, and the
expected completion date. Not more than one sign may be erected per site The
sign may not exceed four (4) square feet in area for single family or duplex
construction or thirty -two (32) square feet for multi - family or non- residential
construction. The sign may not be erected prior to issuance of a Building Permit,
and shall be removed within seven (7) days after of issuance of a Certificate of
Occupancy.
k) Yard or garage sale signs announcing yard or garage sales, provided such —Las do
not exceed one (1) sign per zoning lot and four (4) square feet in area per display
surface, and are removed within seven (7) days of erection.
1) Temporary si ns announcing grand openings of new businesses only which may
be a banner erected for 30 continuous days
m) A company's logo used on its building as an adomment shall not be considered
part of their sign allotment.
n) Temporary political signs advertising candidates or issues, provided such si ns do
not exceed nine (9) square feet in area per display surface, are mounted on stakes,
and are not erected prior to thirty (30) days before the appropriate election, and
are removed within seven (7) days after the election (in cases of run -off election,
the political signs of the run -off candidates may remain until seven (7) days after
the run -off election). Political signs may be located within the public right -of -way
and setbacks provided that they do not intrude on the sight reservation WaDgl_e
nor shall any sign be affixed, attached, or painted upon any utility pole, any tree,

rock, or other natural objects. The Street Department and /or Planning Department
is authorized to remove signs that are placed in illegal locations and/or are not
removed as stated above,
o) Banners or flags that are decorative or seasonal in nature or that are displayed in
connection with the observance of holidays or other special events, including
Olympic banners or flags, not to exceed three (3) per lot located in any zoning
district This does not include special We events of for - profit organizations.
8.5 General Limitations
a) Freestanding si�riM shall be securely fastened to the ground or to some other
substantial supportive structure so that there is virtually no danger that either the
sin or the supportive structure may be moved by the wind or other forces of
nature and cause injury to persons or property
b) All non - exempt signs shall comply with the construction requirements of the
North Carolina State Building Code Trailer mounted signs do not meet these
requirements, Temporary s_ians, both new and existing, other than those expressly
allowed in this Ordinance, are prohibited.
c) Portable signs are also prohibited
d) New off - premises signs signs that draw attention to or otherwise communicate
information about a business, service, commodity, accommodation, attraction, or
other activity that is conducted, sold, or offered at a location other than the
premises on which the sign is located) are prohibited. Existing off- premises suns
can remain if erected before August 19, 1985..
e) Devices consisting of flags other than those exempted by Section 8.4, banners,
streamers, pennants, windblown propellers, balloons, strung light bulbs, rotating
or other moving or apparently moving installations are prohibited.
f) Banners of a community service, non - commercial nature may be installed at
locations established by the Town Manager for a period not to exceed two (2)
weeks, although extensions may be granted. The Zoning Officer has the authority
to review applications for conformity to this section, issue banner permits to each
applicant, and grant time extensions if necessary. Banners shall conform to
written standards and safety guidelines as established by the Zoning Officer
8.6 Traffic Safety Precautions
Notwithstanding any other provisions in this Ordinance, the following practices in
relation to signs are prohibited in order to preserve the safety of pedestrian and vehicular
movement.
a) No permanent signs shall be erected so that any part of it obstructs the view of
traffic through the sight preservation triangle
b) No privately owned sign shall use words such as "stop ", "slow ", caution ",
"danger ", or similar admonitions which could be confused with traffic directional
suns erected by government agencies.
c) No sign shall be erected so that, by its location, color, nature, or message, it would
tend to be confused with or obstruct the view of traffic signals or suns or would
tend to be confused with the warning lights of an emergency or public safety
vehicle.

87 Restrictions on Illumination
a) Unless otherwise prohibited by this chapter, signs may be illuminated if such
illumination is in accordance with this Section.
b) No sign within one hundred fifty (150) feet of a residential zone may be
illuminated between the hours of 12 midnight and 6:00 am, unless the impact of
such lighting beyond the boundaries of the lot where it is located is entirely
inconsequential.
C) Lighting directed toward a sign shall be shielded so that it illuminates on the face
of the sign and does not shine directly into a public right -of -way or residential
premises.
d) Internally illuminated suns may not be illuminated during the hours that the
business or enterprise advertised by such sign is not open for business or in
operation. Notwithstanding any other provision of this Ordinance, existing
situations that violate the provisions of this subsection shall not be regarded as

e) Subject to subsection (g), illuminated tubing or strings of lights that outline
property lines, sales areas, roof lines, doors, windows, or similar areas are
prohibited.
f) Subject to subsection (g), no sign may contain or be illuminated by flashing or
intermittent lights or lights of changing degrees of intensity, except signs
indicating the time, date, or weather conditions
g) Subsections (e) and (0 do not apply to temporary signs erected in connection with
observance of holidays.
h) Within the CC district, neon signs shall not be permitted For purposes of this
subsection, the term "neon sign" includes all signs in which illuminated tubing
constitutes or forms all or part of the message of the sign, as well as signs in
which the message area of the sign is outlined, underlined, or otherwise
highlighted by illuminated tubing
8.8 Determining the Number of Signs
For the purpose of determining the number of sips permitted, a sign shall be considered
to be a single display device containing elements organized, related, and composed to
form a unit,
Without limiting the generality of the above, a multi -sided sign shall be regarded as one
sign
8.9 Billboards Along Interstates 85 and 40
Billboards within one hundred (100) feet of the right -of -way along these principal roads
are prohibited, with the exception of existing billboards located there on the date of
adoption. These pre - existing billboards shall be subject to the following restrictions:
a) shall not be enlarged or expanded,
b) a signed statement with the name and address of the owner and current leasee for
each sign shall be kept on file with the Zoning Officer,
C) shall be subject to yearly inspections,
d) shall conform to the requirements set forth in G S 1:36 -126, et seq.
M.
The Zoning Officer shall inspect on an annual basis all off - premises signs and billboards
which fall under this Section to ascertain the physical condition of the sign, specifically
the structure, surfaces, lighting, and general appearance
8 10 Computation of Sign Area
a) The surface area of a sign shall be computed by including the entire area within a
single, continuous, rectilinear perimeter of not more than eight (8) straight lines,
or a circle or an ellipse, enclosing the extreme limits of the writing,
representation, emblem or other display, together with any material or color
forming an integral part of the background of the display or used to differentiate
the sign from the backdrop or structure against which it is placed, but not
including any supporting framework or bracing that is clearly incidental to the
display itself.
b) If the sign consists of more than one section or module, all of the area, including
that between sections or modules, shall be included in the computation of the sign
area
c) With respect to three dimensional or multi -sided siM the surface area shall be
computed by including the total of all sides designed either to attract attention or
communicate information
d) Any sign integral to a wall or structure is exempt from the square footage
requirements if displayed on the effective date of this amendment
8.11 Total Sign Surface Area for Wall Mounted Signs
a) Unless otherwise provided in this Section, the total siM surface area devoted to
all signs on any lot shall not exceed the limitations set forth in this Section, and all
signs except temporary signs shall be included in this calculation.
b) Unless otherwise provided in this Ordinance, the maximum sign surface area
permitted on any lot in an AR, R -10, R -15, R -20, R -40, W, and ME? District is
eight (8) square feet.
e) Subject to the other provisions of this Section, the maximum sign surface area
permitted on any IgL excluding freestanding signs, in a HIC, GC, OI, NB or GI
District shall be determined as follows
1) For every street the building faces, there may not be more than 5 square
feet of sign surface area per linear foot of building frontage
2) Regardless of the building frontage requirements, a minimum of thirty-two
(32) square feet of sign surface shall be available to every building
3) The sign surface area of any sign located on a wall of a structure may not
exceed twenty -five (25) percent of the total surface area of the wall on
which the sign is located.
d) In the CC districts, the maximum sign surface area shall be 3% of the building
facade area or 32 square feet, which is lower. This limit shall apply to all wall
mounted signs, including exterior, interior, awning, and hanging types "Facade"
shall include all planes facing the same direction regardless of structural offsets
"Building" shall be determined by property boundaries unless information is
provided about interior fire walls dividing a structure into multiple components,.
