Physical Description:
The southern portion of the site is open pasture, defined by a series of mild teraces.
The northern potion of the site is a mixture of small hardwoods on gently sloped terrain.
A 100-foot wide Duke Power transmission line crosses the site(from east to west) near the
central section.
• No drainageways orfloodplaln areas are associated with site.

Roads:
• The subdivision will be accessed from Davis Road (SR 1120).
• Linnet Drive will be public and constructed to NGDOT standards.
Five feet of additional rightof-way offered along Davis Road
• Road does not have to be extended since no potential far further development.

The applicant has self-imposed a 100-foot building setback buffer along Davis Road. (There
is no building buffer requirement for conventional subdivisions. Septic systems may be
placed within 70 feet of this buffer.)

A 30-foot Type-A Land Use Buffer(semlopaque: intermittent visual obstructions from the

• Requests for agency review were sent to NCDOT, Recreation and Parka, Orange County

the Fire Marshal. Comments are attached.
Planning Staff Commentts
The Preliminary Plan meets the conditions placed on the Concept Plan approval.
Revisions to the concept plan Include:
✓ Compliance with the Nauss River Basin miss Nat have been adopted since Concept Plan
approval.
✓ Delineation of private recreation area in area central to all proposed lots.
Development Process Schedule and Acton
• First Action: Planning Board to consider Concept Plan
The Planning Board approved the conventional development concept plan for Davis
Farts on October 3,2001 with the following conditions:
1. Linnet Drive shall be a public right-of-way constructed to NCDOT standards with additional
five (5)feat utility easements on each side. Sight distance mangles(to'x 70')shall be
delineated on the plat far the intersection of Linnet Drive and Davis Road.
2. Lots t and 4 shall not have access to Davis Road but shall exit onto Linnet Drive. The
driveway access points for lob 1 and 4 shall be a minimum of IOO feet from the intersection
with Davis Read.
3. If an entrance sign is anticipated and will not be placed within the land use buffer area or
directly behind It a sign presented must be reserved within one of the residential lots. If the
ownerlapplleant does not establish a Homeowners Awooidon restrictive covenants shall
include provisions for entrance sign maintenance.
4. All common areas intuiting land use buffers must be clearly identified on the preliminary
and Mal plats. If the mrierlappllrand does not establish a Homeowners Assocaton,
provisions for the maintenance of all common areas or land use buffers shall be specilled In
restrictive covenants or conservation agreements. The common areas cannot be
subdivided or recombined with adjacent lots. Draft forms of Ne Homeowners Association
documents and/or restrictive covenants and conservation eeaemenb that contain use and

maintenance provisions for the open space and buffers must be submitted for review by the
County Attorney as part of the preliminary plat approval process.
5. The preliminary and final plats shall contain a note restncling further Subdivision.
6. Each lot shall contain an adequate area for septic disposal and a repair area as approved by
the Orange County Division of Environmental Health.
7. The preliminary plat shall indicate areas for on-site infiltration of storm water that
demonstrates compliance with Article 6.23.3a of the Orange County Zoning Ordinance.
B. The preliminary plat shall show the location of tree protection fencing and contain a note
requinng the installation of Was protection fencing prior b any grading M ensure the
protection of vegetation within all buffers and open space.
9. The applicant shall dedicate a minimum of 6,585 square feet(1/57 acre per residential lot)
for public recreation space,or pay an im iei fee (of$2,730), as part of the preliminary plat
approval process. (Section IV-B4-b Recreation Sites, Orange County Subdivision
Regulations).
10.The applicant shall provide a minimum of 20,370 square feet for private recreation space as
par[of the preliminary plat approval process. (Section IV-B.7-b Recreation Sites, Orange
County Subdivision Regulations)
11.All street names to be reserved with GIS section of Planning Department pdor to submittal of
preliminary plat subdivision request.
• Second Action: Planning Board to consider Preliminary Plan
The Planning Board recommended approval of the Preliminary plat for the Davis Farm
Subdivision on May 1, 2002 In accordance with the attached Resolution for Approval.
• Third Action:
Board of County Commissioners consideration of Preliminary Plat
1. The Board shall considerme application within a reasonable amount of time.
2. During deliberations and consideration of the application,the Board may defer
consideration at any point to pursue additional analysis and review.
3. If the Preliminary Pia[is approved by the County Commissioners, the applicant shall
have one(1)year to prepare and file a Final Plat or to request a one-year extension from
the Planning Director.
FINANCIAL IMPACT: A placed Impact Analysis is not required for projects proposing less than
10 residential lots.

DAVIS FARM SUBDIVISION PRELIMINARY PLAN

The Board of County Commissioners hereby approves the Preliminary Plan for Davie Farm
Subdivision as shown on the preliminary plat dated February 19, 2002 and subject 0 fulfillment
Of reguimments specified herein.
At roads shall be irrevocably dedicated to no general public and be constructed d standards of
the North Caroline Department of Transportation (NCDOT). The approval of this resolution
authgnzes and directs the Orange County Manager to accept for the County, and on behalf of
the public generally, the offer N tletlication of Linnet Drive. This acceptance of dedication to the
general public shall be without maintenance responsibility. These made shell be maintained by
the ownerjappli ant (Homer Davis) Must such time as Ney are accepted for catchal ce by
NCDOT or some other governmental body. At easements for drainage, pedesdan access or
other purposes, all private open space shall likewise be maintained by the awneoappti®nt until
such time as they we transferred to Me control of a Homeowners Assouaton, individual lot
owners through deed restrictions, or are accepted for maintenance by the County.

1. Linnet Drive shall be constructed 0 NCDOT minor total slznbms with a 50f
nglHgf-way and 51 utility easements on each side. Construction shall he
InspeGed and approved by NCDOT.

A letter of credit or scarce agreement or other security shall be submitted to
secure construction of Linnet Drive to NCDOT standards. An estimate Of the
pdmsmuction cast must be prepared by a rartifed4lcensed engineer or grading
contractor and submitted to the Orange County Planning Department and
approved by the County Engineer. The financial guarantee must reflect 110
percent d that estimate and be Issued by an accreaited financial institution
licensed to do business in North Carolina. The document describing
development restriction to be recorded with the Final Plat shall state that the
financial guarantee will not be released until the road construction has been
Inspected and approved by NCDOT.
2. An erosion control plan for the entire project, including Linnet Drive, shall be
Submitted by the applicant to the Orange County Erosion Control Division for
review and approval prior to any disturbance an the site. The Erosion Control
Plan shall include a stonnestar management plan tat meets the reauirern2nts of
both the County and the Nause River Basin mks.
3. Prior to any construction or any alteretlw of any existing access within the right-
of-way, Davis Road (SR 1129), the developerlowner shall secure a trial
permit fain the NCDOT District Once. A copy of the NCDOT-approved permit
and letter to the Planning Department shall be submitted M the same time as Me
request for Planning Department signatures On the Final Plat Eght distance

4. Access to all lots shall be from Linnet Drive. Driveway ruts for lots 1 and 4 shall
be a minimum of 100 feet ham the rightaf-way, Intersection with Davis Road.
This restriction shall be sktM In a document to be prepared by Planning Staff
and recorded wmwrnhuy with the final plat Non-vehicular access easements
(NVAH-areas where driveways shall not be located—shall also be shown on the
final plat.
5. Street name shall be approved by Land Records prior to submittal of final plat.

T The proposed six-ot subdivision is located whin to Cheeks District Park
Service Area. As par to decision of the Board of County Commissioners, cash
in"amount of$2.730(Willits)shall be paid to Orange County as payment in-
Haiti parkland dedication.
2. The developer is reserving 20,370 square feel of open spare easement on Lot 6.
This Important area shall be designed with common ownership among the six(6)
property pwrers. Appropriate legal documents shall also provide for tTta six(6)
Property paters to share maintenance responsibilities for the open space area
and shall be submitted along with the final plat for legal rev'lew by to County
Aftomey.

F. Miscellaneous
1. The Final Plat shall contain a title blcd and vicinity map in accordance with
Section V-D-2 The Big& and V-D-3 Vicinity Map of the Orange County
Subd'ivisicn Regulations.
2. The buffers, building semaces, easements,open space, and conservation areas,
shall be stated on the plat and in a document describing development restrictions
and requirements b be prepared by Planning Stan and recorded concurrently
with the Final Puts
3. Drainage easements shall be provided as required by section 0. Item 2. outlined
above.
4. The Final Plat shall contain a note restricting any further subdivision.
5. If a subdivision sign Is angctpi reserve an easement location on either Lot t
or Lot 4.
S. If any condi cin of this Pleasanton shall be had invalid a void, the Resolution
itself shall be void and of no effect.
O. CerYTications
1. A Certificate ar Survey and Accuracy signed by a Professional Land Surveyor
shall be notarbad an the face of the Final Plat.

6-b of the Orange County Subdivision Regulations signed by the landaaners and
developer shall be on the face of the plat and Included In a annument describing
development reactions to be recorded concurrently with the Final Plat.
3. The North Carolina Department M Transportation shall certlfy that all roads have
been constructed id State standards or that constr ion plans have been
approved.
4. A Certificate of Approval signed by fine Orange County Planning and Inspections
Department.
