PURPOSE: To consider adopting a Water Conservation and Demand Management Ordinance
related to Orange Water and Sewer Authority (OWASA) customers within the unincorporated
area of Orange County.
BACKGROUND: OWASA has requested that Ciampono, Chapel HIII and Orange County adopt
an ordinance providing for the year round conservation of water and for temporary water use
restrictions during water shortages and emergencies. Canton adopted the requested
ordinance on Mamh 5, 2002. Chapel Hill adopted the requested ordinance on March 25, 20D2.
Both Carrboro and Chapel Hill have only one public water supplier, OWASA, and therefore the
adoption of the requested ordinance was a relatively straightforward mal for both towns.
Orange County, on the other hand, has a number of public water supply providers, including
OWASA, the Town of Hillaborough, the Orange Alamanco Water System, the Town of Mebane
and the City of Durham. Furthermore, Orange County Is the owner of a public water supply
reservoir and is responsible for managing the Upper Eno watershed allocation system that was
implemented some years ago as the result of the overdrawing of water from the Upper Eno
River system that occurred in the past OWASA is a part of that water system because
OWASA is connected with the water system of the Town of Hillsborough in a way that permits
transfer: between OWASA and Hillsborough. Indirectly OWASA is further connected to the
Upper Eno because it is connected to the public water system of the City of Durham and the
City of Durham's public water system is now connected to the Hillsborough public water system.
Further, Mere are now in place interconnections between the Town of Hillsborough and the
Orange Amoral system and through Orange Alamance between Hillsborough and the City of
Mebane. All of these interconnections and water transfer options and possibilities make
Orange County ultimate response to the OWASA proposed Water Conservation and Demand
Management Ordinance considerably more difficult, particularly since Orange County's existing
Water Conservation Ordinance accounts for some of these interconnections.

Preliminary discussions have occurred involving County staff to determine how to address the
interconnection issue and the impact the interconnections may have on a water conservation
ordinance affecting OWASA customers. Further, because of the interconnection between
Hillsborough and Durham and the new Hillsborough reservoir, additional work is needed to
update Orange County's water conservation and allocation ordinance. It is not possible to
predict presently haw long that work will take and when it will be completed.
What is proposed for the Board Of Commissioners consideration is the interim Water
Conservation and Demand Management Ordinance rotated to OWASA customers that is
attached to this agenda abstract. If adopted by the Board, it will be effective when adopted
Simultaneously, Orange County's Ordinance Providing For Water Conservation, Restricting The
Use Of Water And Water Withdrawals And Allocating Augmented Slreamllow From Reservoirs
will be suspended insofar as It relates to water usage by OWASA customers, the water level of
University Lake and any raw water supply within Orange County used by OWASA other than
the Upper Eric River system.
FINANCIAL IMPACT: The financial impact of adopting this ordinance is not expected to be
greater than that associated with the present Orange Cou ny Water Conservation Ordlnance.
RECOMMENDATIONI The Manager and the Attorney recommend that the Board adopt AN
INTERIM ORDINANCE PROVIDING FOR THE YEAR ROUND CONSERVATION OF WATER
AND FOR TEMPORARY RESTRICTIONS DURING WATER SHORTAGES AND
EMERGENCIES RELATED TO ALL ORANGE WATER AND SEWER AUTHORITY
CUSTOMERS LOCATED IN THE UNINCORPORATED PART OF ORANGE COUNTY.
AN INTERIM ORDINANCE PROVIDING FOR THE YEAR-ROUND
CONSERVATION OF WATER AND FOR TEMPORARY RESTRICTIONS
DURING WATER SHORTAGES AND EMERGENCIES RELATED TO ALL
ORANGE WATER AND SEWER AUTHORITY CUSTOMERS LOCATED IN
THE UNINCORPORATED PART OF ORANGE COUNTY
Section 1. Pumase
This ordinance is reacted to support the fonowiag prupary water conservation and
demand management goals:
1. To reduce the rate of growth in overall water use so as to maximize the commutury's
existing and clamed water supply sources; and
2. To reduce the upward trend of seasonal peak day demands that drive the costly
expansion cf aAr treatment,storage,W transmission facililics; and
3. To provide an orderly process for reducing community-wide water demands during
periods of water shortage or emergencies.
Section R. Year-Round Practices
1. All Orange Water and Sewer Authority(OWASA)cossmmem are encouraged to
excricise voluntary water conservation practices at all times during tbe year,regardless
of atersbormgeoremergmcyconditions. OWASAshallperiodicallyprovide
informational guidelines and conservation tips to its cusmmes.
2. All newly iustahed or subscomal) ire proved irrigation systems that an:equipped
with automatic timers and which use OWASA-supplied potable water shall be
equipped with autonni c rain or sail molmure sensors that are activated an prevent Lae

Section III. Determination of Wager Sbortane or Emeremev

extent allowable with regard to indoor air quality standards and employee health
and safety requirements.
Section Mandatnry Conservation During Stage H Water Shortage

2. Water service my be discontinued or reduced,as determined by OWASA's
Executive Director, at designated portions of be OWASA service area through the
manipulation of valves,pumps,and other appurtenances in order an preserve the
availability of water for public health and safety facilities. such as Machine,medical
clinics,sec.,fire poi ax and other critical cammunity needs.
3. IINC and any other customers that ase OWASA-sapplied potable drinking water for
heating/cooling systems shill reduce the hcatir*cooling demmd in all but the most
essential facddies to the extent allowable with regard to indoor air quality standards
and employee health and safety regvuemrnm.
Serdlon VIII. Penalties Intl Home lks
1. Aviolation of my of the provisions of this Conivavice shall constitute a misdemeanor,
perishable as provided to O.S. 144.
2. Aviolation ofmyofthe provisions of this Ordnance shall subject be offender to
civil penalty of twenty-five dollars for the first offense, fiPy dollars for the second
offense within a tarty-day,period,and one hundred dollars for the land or my
additional offense that occurs wititin any thirty-day period.If a person fails to pay this
penalty agent ten days after being cited for a violation,be County may seek to
recover the penalty by filing a civil action in be nature of debt.
3. The County may sack to enforce this Ordnance through any appropriate equiable
action.
A. Each day that a violation continues after the offender has been notified of the
violation shall constitute a separate offense

Section lY Severebllity
If any section,subdivision,clause,or provision of this Article shall be adjudged invalid,
such adjudication shall apply only to such section,subdivision,clause,or provision so
adjudged,and the remainder of this Article shall remain RA17 valid and effective.

Dear Bob:
Enclosed is a cony Of the Crdinance adopted by orange
County regarding water conservation rvation together with all of the
amendments that se far asl =ad determine have been made to that
Ordinance. As you can spa nothing has been done with it since
1937. The ordinance arose from the severe e drought in 1386 and
a
the fact that the Eno River was "pumped dry" Hillsboaough.
The State, principally in itscdpacity as riparian land owner
(the Eno River State Park) , threatened to take over the Eno
River by designating is a capacity 'csewater system. under
Chapter 143 of the North Caroline General statutes. A vclwoary
allocation plan and the water c n rvation ordinance that is
enclosed were the local response to the State's threat.

County, pursuant to North Carolina General Statutes Section

a misdemeanor, punishable upon conviction by a fine net to exceed
$50.00 or imorisonmant not to exceed thirty days, as provided by
N. C. General Statute Section 14-4. Any much violation may be
enjoined, restrained, or abated as provided by M. C. General
Statute Section 153A-123 (4) and 153A-123(e) .
B. If any section, subdivision, clause or provision of this Ordi-
a such shall be adjudged invalid, adjudication shall amply
only to such section, subdivision, clause, r provision
adjudged, and the remainder Of this ordinance shall be deemed
valid and effective.
C. All Ordinances and clauses of Ordinances in conflict herewith are
repealed on the effective date of this ordinance. The ordinance
entitled "AN ORDINANCE PROVIDING FOR THE CONSERVATION OF WATER
DURING A WATER SHORTAGE, AND ME RIOTING THE USE OF WATER DURING
MORE SEVERE SHORTAGES" and as amended, is repealed an the affec-
tive date of this Ordinance. The adootion of this Ordinance,
however, shall not affect nor prevent any pending or fu'
presecution o£, or action to abate or enjoin, an existing vii
ticn of said Ordinance.
D. This Ordinance shall become effective when adopted. t)

• HACXGROUND: The Division of Water Resources has recomputed elevation
water below Lake Orange spillway. The existing ordinance
computed elevation of water below Lake Orange Spillway whirl
did not include the "dead pool" (water that can net be drain:
from lake.. The new computations from the State include the
dead peal and a occur for the flashboard,. which raises Lake

'Pursueat to the provisions of the ORDINANCE PROVIDING FOR THE
".CONSERVATION OF WATER DIIRUNG A WATER SHORTAGE,RESTRICTING THE USE
OF WATER AND WATER WTTHDRAWA ,AND ALLOCATING AUGMENTED
STREAM FLOW FROM RESERVOIRS,
I, Stephen Halkiotis, Chair of the Board of County Commissioners, having been provided
with irdonnation that the water level of Lake Orange is more than l]inches below full do hereby
vi ue this PUBLIC PROCLAMATION declaring to all persons that a stage IF water shortage
WARNING is now in effect applicable to more of water from the public water system supplied
by the Orange Alamance Water System,Inc. and the Town of Hillsborough. The fallowing
mandatory water conservation mstrictiov are now applicable:
R shell be unlawful to use water form the public water system supplied by the Change-
:Absorption Water System,Inc. and the Town of Hillsborough and from any mw water supply
within Orange County used by the Orange-Alamance Water System,Inc.and the Town of
Hillsbomugh for the following purposes:
I. To water lawns,grass,shrubbery, trees,flower and vegetable gardens except between the
hours of 6:00 p.m. and 9.M p.m.on Saturdays and Sundays.
2. To fill newly constructed swimming and/or wading pools or refill swimming and/or wading
pools which have been drained. A minimal amount of water may beaddedmmamain
continued operation of pom.L which are in operation at the time Live provisions of a stage M
WARNING are placed into effect -
3. To operate water-cooler air conditioners or other equipment that dues not recycle cooling
water,except when health and safety,are adversely affected.

4. To wash automobiles, trucks,Unions, boats.airplanes.or any other type of mobile 42
equipment, including commercial washing.
5. To wash down outside areas such as street>,driveways, smite station aprons,parking lots,
office buildings, exteriors of existing or newly constructed homes or apartments,_
sidewn!kN,or patios, or to use water for other similar purposes.
6. To operate or introduce water into any ornamental fountain,pool or pond or other structure
making similar use of water
]. To serve drinking water in restaurants,nofever as or other food establishment,except upon
request
8. To use rater fmm pubic or private fire hydrants for any purpose other than fire
suppression or other public emergency.
9 To use water for dust control or compacting.
10. Tomtantionallywastewarer. The owner or occupant of any land or building which
receives water from the Omnge-Alamnce Water System,Inc. or the Town of Hillsborough
and that also utilizes water from a well or supply other than that of Orange-Alamance
Water System.Inc. or the Town of Hillsborough that post and maintain in a prominent
place thereon a sign furnished by Orange County giving public nodre to the use of the well
or other source of supply.
This proclamation,and the mandatory conservation restrictions imposed pursuant to it,
shall be in effect until the Ordnance entitled "AN ORDINANCE PROVIDING FOR THE
CONSERVATION OF WATER DURING A WATER SHORTAGE,RESTRICTING THE
USE OF WATER AND WATER WITHDRAWALS,AND ALLOCATING AUGMENTED
STREAMFLOW FROM RESERVOIRS" is amended or repealed or until the Chair by Public
Bacchanalian, declares that the Stage M Water shortage WARNING is over By order of
