BACKGROUND: Historical Context. On December 11, 2001, the Board of Commissioners adopted a Regulated Recyclable Materials Ordinance (RRMO). That act ion represented the culmination of the vision of the BOCC-appolnted Construction and Demolition (C&D)Recycling Task Force that met from late 1999 through mid 2000 and presented its report and recommendations to the BOCC in August 2000. Chaired! by Commissioner Jacobs,the Task Force worked with a guiding "Statement of Principles'(Attachment 1)that shaped its recommendations. Foremost among the eleven recommendations in the Task Force's report was the enactment of an Orange County ordinance that would mandate recyGing or reuse of various categories of C&D waste. Key to the Task Force's efforts was the recognition that the C&D waste stream,which comprises about one-ihiN of the County's annual waste stream of about 90,000 tons entering the landfill,was largely untapped for mcwtirmlreuse potential. 2 Many years ago, the BOCC adopted a goal of reducing by 2006 the amount of solid waste landfilled annually,on a per capita basis, by 61 percent(other significant waste reduction and C&D management activities and milestones are listed In a chronology of Attachment 2). That represented a more aggressive target than the State mandated goal for all North Carolina local governments of 40 percent per capita solid waste reduction by 2005. It is worth noting that Orange County governing boards, local government staffs, and citizens have cooperated to make tremendous progress towards solid waste reduction goals. Accord ing to the State's most recent annual Solid Waste Management Report for FY 2000-01, Orange County has decreased its per capita solid waste disposal by 36 percent(from 1.36 tone per parson to 0.89 tone per person)since the 1991-92 baseline year. Orange Countys achievement is even more noteworthy in light of the statistic that statewide,per capita solid waste landfilled has actually increased by 12 percent since the baseline year(from 1.08 tons per person in 1991-92 to 1 21 tons per person in 2001-02). With substantial progress already made in Orange County towards the State and BOCC solid waste reduction goals, Implementation of the RRMO provides the opportunity to achieve additional significant reductions In the waste stream that ends up being landfllled In Orange County. The C&D Task Force estimated that only about l 5 pament of the 31,000 annual tons of C&D materials were being selvaged from the landfill face. With He focus on removal of clean wood waste and metal from the waste stream (and with the potential to regulate additional categories of waste at a later date through ordinance amendments), the RRMO will lead to measurable C&D waste reduction in FY 2002-03. Among its major provisions, the RRMO requires: Mandatory recycling of various waste materials • Construction site separation of regulated materials Recyclable Material Permits be obtained to accompany all building permits ' • Licensee for haulers of regulated materials • Certlflcation of facilifies handling commingled categories of waste The adoption of the ordinance necessitates the construction of C&D recycling facilities at the landfill,the acquisition of equipment to manage and haul the materials to market, and new personnel to operate the equipment, to Inspect the incoming loads for compliance, for education and enforcement, and to Issue.permits and licenses. The FY 2001-02 Solid Waste departmental budget included funding for an Education and Enforcement position which already has been established and for which the selected candidate began work an April 15r". The recycling facilities are currently out for bid (see attachment 6). The equipment has all been bid and is malting Board bid award approval. Staffing heads Given the time required to complete the recruitment and selection process for the new positions, and b ensure that the necessary personnel are trained and In place so that the ordinance can be implemented on October 1, 2002, it is important to obtain Boad authorization for the additional positions necessary to support the ordinance and its associated services. These three positions were discussed in the memorandum presented to the Board[ at the October 1, 2001 Solid Waste work session and In prior and subsequent discussions of the ordinance, most recently at the May 23 work session. 3 Two of the positions are to be located in the Solid Waste Management Department. These are a Solid Waste Materials Transfer Operator at Grade 63 and a Landfill Inspector at Grade 63. Salary Grade 63 has a hiring range from $25,281 to $30,729. The third position Is an Administrative Assistant 11 at Grade 62 to be located in the Planning Department. It is proposed that half of this position be funded by Solid Waste and dedicated to regulated recyclable materials administration functions to he carried out in the Planning Department and that half of the position be used to address the present heavy customer service workload In Planning. Salary Grade 62 has a hiring range from$24,070 W $29,266, Attachment 3 provides summary of the duties of each position. Solid Waste Transfer Operator The Solid Waste Materials Transfer Operator will haul various materials to market. Presently, about 600 tons of scrap metal are hauled by a contractor to market each year. This position will assume hauling to market that which is currently contract hauled, plus an estimated additional 1,300 tons annually of metal caused to be available by the ordinance. Currently no wood is hauled for hoilar fuel, however, 4,000-5,000 tons could be hauled annually as the result of the ordinance. Additionally,the 730 tons of white goods currently hauled by a contractor per year will be hauled by the new position. It is also estimated that the cardboard compactor will be hauled to market 2-3 tlmeatweek. Landfill Inspector The new Landfill Inspector position will have responsibility for examining all loads of segregated C&D materials delivered for recycling. It is estimated that approximately 6,000-7,000 new tons of material will be delivered far recycling, which must be Inspected. This position also has responsibility for operating equipment necessary to load the materials into tmilerslcontainam for delivery to market. Administrative Assistant The new Administrative Assistant I I will educate permit applicants on the Recyclable Materials Ordinance at the time they apply for building permits and will eliminate the need for citizens to travel to the Solid Waste Office in Chapel Hill to obtain their Recyclable Materials (RM) Permits. An estimated 4,500 RM Permits will be issued and receipted annually. Additional duties and explanation of the position is provided in the attached "Summary of Duties for Positions' document. Staff Recruitment and Training For the new staff to be trained and prepared for an October 12002 implementation, it will be necessary to have the positions filled by September 1. It also is anticipated that much of the regulated community will be trying to transition to the new requhaments prior to the October effective data Thus it is necessary to have shelf available in advance for such functions as Issuing licenses, becoming familiar with permitting process and work Flow, gaining profeasional certifications, being trained on a variety of equipment, leaming recyclable materials market requirements,familiamabon with Orange County ordinances and state regulations, etc. Equipment Needs The following equipment required for the implementation of the Regulated Recyclable Materials Ordinance (RRMO) has been bid by the Purchasing Department based on specifications jointly developed with the Solid Waste Department. The Board may also note that additional a information about each piece of this equipment was included in a Manager's Memo dated April 9, 2002. Each of these items was considered as a separate bid and was advertiaad pursuant to state law. The bids were advertised both in the newspaper and on the County's website. Horizontal Grinder The implementation of the recently adopted RRMO will result in significant add tonal wood waste grinding requirements for the Solid Waste Management Department (twill be possible to produce a variety of recycled wood products utilizing this grinding machine, These include various types of mulch and boiler fuel. Additionally, it gives the County significant capability to manage large quantities of vegetative debris as the result of hurricanes or other types of severe storms. The machine is transportable, but this mobility is limited to a crertain event by bridge weight limits and ingress/egress constraints due to its physical size. Finally, in the event the County becomes actively involved in composting, this machine would be available to produce compost feedstocks. Current grinding services are more limited in nature and are provided by a primate contractor 2-3 times annually. It is estimated that this machine should provide a high level of samce for a period of approximately 10 years. A pre-bitl conference was held and was attended by one vendor, Bids were solicited from ten vendors on Orange County Bid number 234, with four bidders responding. Pursuant to the attached bid tabulation, Pioneer Machinery LLC of Senior, North Carolina submitted the lowest responsible bid that was responsive at a delivered mat of $501 382.76 for Petersen Pacific model 7400A. Staff had previously considered proposing a "piggyback" bid on another local government's purchase for this piece of equipment. However, soliciting a separate Orange County bid at BOCC suggestion resulted in additional savings of about$8,000. Trommel Screen The trommel screen will produce varying sized material to be utilized as boiler fuel to meet differing market requirements. The screen may also be used in future composting processes. A pre-bid conference was held and was allended by four vendors. Bids were solicitetl from twelve vendor;on Orange County Bid number 233,with five bidders responding. The attached tabulation reflects that Screening &Shredding Systems of Winston Salem, North Carolina submitted the lowest responsible bid that was responsive at a delivered cost of$132,210.00 for a Finley 790 Tremmel Screen. Live Floor Trailer Bids were also solicited for a 102 cubic yard "live-floor trailer. 'Live-floor is a type of floor designed for self-unloading. It does not require a pushing cylinder, tipping, mother mechanical means of emptying. This trailer will be used b transport processedrecycletlmaterialto market, for example delivering boiler fuel to different vendors and potentially delivering mulch to major users. Bids were solicited from seven vendors on Orange County Bid number 235, with five bidders responding. No pre-bid was required for this equipment. As reflected In the attached tabulation, Canam Steel Corporation of Points of Rock, Maryland submitted the lowest responsible bid that was responsive at a delivered cost of$46,872.00 for a Mani Model 36248100. 5 Crawler Loader The crawler loader nuns on flat tracks, unlike a bulldozer, which has cleared tracks. This provides it with a much greater pushing ability than a wheel loader;while still offering the operator the ability to load certain vehicles or equipment without having to wont'about what materiel the operator is running over, The loader will be used to push the wood waste material to the wood waste grinder, load the grinder and trommel screen, load the stacking conveyor and push the piles of wood waste material or finished mulch product Into piles. A pre-bid conference was held and was attended by two vendors. Bids were solicited from seven vendors on Orange County Bid number 231, with two bidders responding. Due to the environment in which this equipment will be used, It was determined by shelf that the unit would require seal guards to keep wire and other debris from ruining the once seals and to help protect the undercarriage and bottom of this machine. The bid submitted by R.W. Moore was determined to be non-responsive since they were unable to provide the seal guards. As reflected on the attached tabulation, Gregory Poole of Raleigh, North Carolina submitted the lowest responsible bid that was responsive at a delivered cost of$204,803.00 which includes a 5-year aztended warranty for a Caterpillar 963C, Stacking Conveyor The stacking conveyor is utilized to load mulch and other products into the °Ilve-floor trailer for delivery to market No Pre-bid meeting was required. Bids were solicited from twenty-three vendors on Orange County Informal Bid number 1268, four bidders responded. Pursuant to the attached bid rs tabulation, Powecrean Mid-Atlantic of Kemetsvllle, North Carolina submitted the lowest responsible bid that was responsive at a delivered cost of$29,447.00 for a Powerscreen T5032D. Solid Waste Management will provide funding for IS of the Administrative Assistant II position. The Solid Waste positions will be covered entirely with enterprise fund revenue. Most of the coal of the Administrative Assistant position would be offset by proposed program fees. The FY 2002-03 Solid Waste Management fee schedule has been submitted as pad of the proposed departmental budget. Equipment The financial impact associated with acquisition of each place of equipment is summarized In the table below. The more expensive pieces of equipment are to be financed through a local bank at an estimated Interest pate of 3.75%, for a period of 59 months. Instead of relying completely on a drawdown of existing reserves,financing over this period of time will spread the capital cost over multiple budget years and reduce the immediate impact on the Solid Waste Management enterprise fund reserves. Conducted a Request for Expression of Interest for a Construction and Demolition Waste Reclama0on, Recycling and Reuse Facility in September 1996. Received two proposals, both of which were inadequate. • 1997—Staff developed first draft of a C&D Ordinance similar in scope to the ordinance adopted by the BOCC In 2001. Held a public forum on C&D waste management in Chapel Hill on January 22, 1997. Adopted state mandated Solid Waste Management Plan, which included waste reduction goals of 45 percent by 2001 and 61 percent by 2006. C&D wastes subject of numerous public discussions throughout the year. • 1998—C&D landfill site search authorized and initiated. Several, freely offered sites identified and evaluated. Issue discussed at numerous public meetings and a Public Hearing was conducted in September on the county's need for C&D management and on possible locations for a new C&D landfill. Options to purchase were executed on two parcels, however none were ultimately pursued. • 1999—Landfill aging discussions continued with focus on property adjacent to the existing landfill on Eubanks Road. C&D management issues discussed at numerous public meetings. BOCC created a C&D Recycling Task Force. SOCC adopts Goals and Objectives which include waste reduction goal of 46 percent by 2001 and 61 percent by 2006. 2000— C&D Recycling Task Force Final Report issued. Facilities Master Plan adopted which Includes C&D landfill and C&0 recycling facilities on Eubanks Road solid waste management property. 10 Attachment 3 Summary of Duties for Positions To Support Implementation of the Regulated Recyclable Materials Ordinance Solid Waste Materials Transfer Operator Transport to market the separated regulated recyclables generated from the construction and demolition waste or other reusable materials delivered to the landfill. Operate any equipment necessary to transport, manage and process these materials, • including roll-off trucks,forklifts, bobcat type loader, compactors, balers, etc. • Communicate directly wdh buyers/receivers of materials about the specifications and delivery requirements. • Maintain awareness of market specifications to improve product quality. Landfill Inspector . Inspect incoming loads of reardable C&D materials to ensure they meet separation requirements and either process loads or issue penalties, instructions or directions to haulers whose loads don't meet specifications, • Explain all C&D rules and regulations to patrons, as well as rationale, and origin as appropriate. • Determine and recommend surcharges, fines and penalties for improperly prepared loads, keep photographic records of non-complying loads. Enforce licensing requirements. • Physically manage and process for market the separated regulated recyclables generated from the construction and demolition waste stream and other related recyclables or reusable materials delivered to the landfill, • Operate equipment necessary to manage and process these materiels, including forklift, bobcat type loader and large rubber limd loader, track loader, compactors, balers, etc. • Keep accurate records of materials delivered, processed and shipped for recycling. • Maintain awareness of market specifications to improve product quality • Assist weighmasters in waste characterization matters. Administrative Assistant II • Answers all callalinquines requesting information about Recyclable Material Permits (RMP), required by the Regulated Recyclable Materials Ordinance (RRMO). • Answers calls/inquldes requesting information about obtaining a building permit. Currently this area receives an average 5453 phone calls(incoming and outgoing) per month, ranking 5" on percentage of phone calls received by county departments. Log all RMP Applications of day of receipt. Check for completeness to avoid delays due to incomplete applications. _ u • Initialize all building, electrical, mechanical and plumbing permits while applicant is in office, estimated total 02-03: 1300 Building permits 1592 electrical permits 894 plumbing permits 1087 mechanical permits Recyclable materials permits as associated to each permit above. • Distributes permit applications to current planning and-for building plans review. • Assist applicants by explaining miss for building-related waste management and requirements of the RRMO. • Accept payments and issue receipts for Building Permits, impact fee, RMPO fees, and re- inspection fees. Reviews all applications for RMP's; approve, reject, or defer to the Solid Waste Management Department all permit applications and convey this decision to the applicant. • Provide cursory counter review of Building Permit applications and related documents for completeness and accuracy to eliminate time delays and citizen frustration. • Maintain records of ell RMP's. • Forward all records of RMP applications and issuances to the Solid Waste.Management Deparmentdaily. • Provide general information regarding the RRMQ, including penalties, licensing requirements, and recycling facility certification.
