Draft Personnel Ordinance Revision Extension 2550 TELEPHONE NUMBERS: Hillsborough 7328181 Chapel Hill 0604501 Durham 880-7331 Mebane 3362274031 PURPOSE: To consider a revision to the Orange County Personnel Ordinance to change the name of the Personnel Advisory Board to the Personnel Heading Boat. as requested by the Boat of Commissioners. BACKGROUND: As provided under N.C. General Statute 153A-05,me Boat of Commissioners established the Personnel Advisory Boat to serve as a hearing board for an employee appeal of a dismissal, disciplinary suspension or disciplinary demotion. As pad of considering appointments to the Personnel Advisory Boat at the March t B, 2002 Boat of Commissioners meeting, the Boat of Commissioners asked the Personnel Director to bring back to the Board for consideration a Personnel Ordinance revision to change the name of the Personnel Advisory Boat to the"Personnel Hearing Boat". The purpose of the name change Is ro clarify that the function of the Board is t serve as a hearing boat for an employee appeal of a dismissal, disciplinary suspension or disciplinary demotion. The attached draft Personnel Ordinance revision changes the name of the Personnel Advisory Boat to the Personnel Hearing Board. FINANCIAL IMPACT: None RECOMMENDATION($): The Manager recommends that the Boat approve the attached Personnel Ordinance revision effective June 4, 2002. 2 Attachment Draft Orange County Personnel Ordinance Revision Article VIII,The Appeals Process and the Grievance Procedure (Changes shown In bold type.) 4.0 Personnel Adiefsery Hearing Board The Commissioners, as authorized by G.S. 153-95 will appoint an A9v aery a Personnel Hearing Board to conduct hearings on employee grievances involving demotions, suspensions, and dismissals. The Personnel Hearing Board will make determinations on employee grievances and forward be recommendations tc the Manager, who will make final determinations. Personnel Heading Board determinabons on employee grievances in the SherifPe Department and Register of Deed's Office will be forwarded to the Sheriff and Register of Deeds, respachvsly,with a copy sent to the County Manager. The Sheriff and Register of Deeds will make final determinations in their respective departments. Draft Personnel Ordinance Revision Article VIII, Section 3.0, Procedure (Changes shown In bold type.) 3.3 Stao 3 If the grievance is not seMed In Step 2, the employee will appeal by giving written notice to the Manager within (5) complete working days after receipt of the Department head's determination. Within two (2) complete working days, the Manager will advise the employee in writing of the determination. The employee will sign and date a copy of the Manager's response to acknowledge receipt thereof, or the Manager will make a notation in the employee's personnel file that the employee has been informed of the Managers response. The Managers decision *11 be final and there will be no action therefrom, except that an employee may appeal to the Aeviesry Personnel Hearing Board any decision involving demotion, suspension, or dismissal. 3a An employee who is demoted, suspended, or dismissed by the Manager may appeal the decision to the Adviseet Personnel Hearing Boom within Win (10)complete working days after receipt of the Managers decision. The Manager will forward all papers and information used in making a decision to the Personnel Hearing Board within five (5) complete working days after receipt of the appeal to the Board. The Personnel Hearing Board will conduct a hearing within ten (10) complete working days of receipt of papers and information from the Manager. It will notify the employee in writing of its findings and recommendations within five (5) complete working days after the hearing. The Personnel Hearing Board may find (1) that the grievance is without merit or (2) that the grievance has met and that certain administrative adore should be undertaken.3.5
