PURPOSE: To consider a resolution urging the Orange County legislative delegation to
support making permanent the existing 2% advance disposal tax for scrap tires.
BACKGROUND: During the Board's work session on solid waste matters on May 23, 2002,
Commissioners indicated the desire to review and adapt a resolution that would support
elimination of the planned sunsetting of state law that provides for a 2% advance disposal tax
on the sale of tires in North Carolina. The proceeds of that tax are distributed to North Camlina
counties to provide funding for scrap tire management activities. Staff have prepared the
accompanying resolution for the Boards consideration.
FINANCIAL IMPACT: There is no direct financial impact associated with this resolution.
However, continuation of the advance disposal tax would ensure that Orange County has a
reliable, dedicated source of funding for its successful scrap fire management program.
RECOMMENDATION(S): The Manager recommends that the Boom adopt the proposed
resolution.

A RESOLUTION TO SUPPORT CONTINUATION OF THE EXISTING
SCRAP TIRE ADVANCE DISPOSAL FEE AND TO REMOVE
THE SUNSET PROVISION THAT WILL REDUCE THE FEE FROM 2%TO 1%
.EFFECTIVE JUNE 50, 2002
WHEREAS, the 2%Advance Disposal Fee is the central component of the North
Carolina State Scrap Tire Program', and
WHEREAS, the program has been highly effective in Orange County and
throughout the state; and
WHEREAS, when the fee was previously 1% and found to be inadequate to fund
the essential programs related to managing scrap tires; and
WHEREAS, the fee supports abatement of nuisance tire collection sites and has
been utllized successfully in Orange County for that very purpose; and
WHEREAS, the fee supports and encourages scrap tire recycling activities; and
WHEREAS, the fee directly contributes to the significant red potion in illegal
dumping of scrap tires across the state by providing and fully funding a program
that efficiently and effectively manages this waste material
NOW THEREFORE BE IT RESOLVED THAT Me Orange County Board of
Commissioners fully supports the continuation of the 2% advance disposal fee
and urges the Orange County legislative delegation to support making the
existing Scrap Tire Disposal Program permanent.
