PURPOSE: To conduct a public hearing and approve submission of the Annual Public
Housing Agency Plan for the Orange County Housing Authority.
BACKGROUND: The U,S. Department of Housing and Urban Development Department (HUD)
requires all agencies operating the Section 8 Existing Housing Assistance Program to prepare a
Five (5) Year Public Housing Agency (PHA) Plan and an Annual Plan, The County's
Department of Housing and Community Development administers the Section 8 Program that
provides rent subsidies to low income families in the County,
The PHA Plan is a 5-year plan that describes the mission of the Agency and the Agency's long-
range goals and objectives for achieving its mission over the next five (5) years, The Board of
Commissioners approved this plan on January 18, 2001. Each year, this plan must be updated
via an Annual Plan that provides details about the Agency's immediate operations, program
participants, and programs and services and the Agency's strategy for addressing the needs of
the community in the upcoming fiscal year.
Currently, the Section 8 Housing Program serves approximately 623 families throughout the
County including the towns of Carrboro, Chapel Hill and Hillsborough, The program currently
has a waiting list of approximately 494 applicants. A complete status report for the program is
attached to this abstract.
HUD provides a template for the plan and the County's Annual Plan is provided with this
abstract. The plan will be made available for public comment for the period March 1, 2004 to
April 15, 2004 as advertised in the Chapel Hill Herald. There are no substantive changes
proposed in the Annual Plan since the 5-Year Plan was approved last year.

This plan must be filed with HUD and must contain the attached Certification of Compliance/
Board Resolution signed by the Chair of the Board of Commissioners in order to continue to
administer the Section 8 Existing Housing Assistance Program,
FINANCIAL IMPACT: There is no immediate impact,
RECOMMENDATION (S): The Manager recommends that the Board conduct a public hearing
and approve submission of the Annual Public Housing Agency (PHA) Plan far the Orange
County Housing Authority and authorize the Chair to sign the Certification of Compliance/Board
Resolution on behalf of the Board.
Orange County Section Eight Housing Voucher Choice Program
Status Report -March 2004
Background
The Section 8 Housing Choice Voucher Program is a federally funded rental assistance
program administered by public housing authorities (PHAs) or other government agencies. The
programs' primary purpose is to provide rental assistance to low-income families with affordable
decent, safe, and sanitary housing. Tenants take the voucher and use it to rent homes in the
private market, Families interested in the program apply to a local housing authority or other
government agency for a Section 8 tenant-based voucher- a voucher that "stays" with the
tenant..
Currently, Section 8 helps more than 1.4 million households in the United States by paying
private landlords the difference between what the household can afford and the rent for the unit..
In Orange County, the program is administered by the Orange County Housing and Community
Development Department and serves approximately 623 families countywide,.
The administering housing authority or government agency is also responsible for inspecting the
selected housing unit to make sure it complies with the Housing and Urban Development's
(HUD) Housing Quality Standards and ensuring that the rent charged is reasonable for the local
housing market.
The following information provides summary information regarding the current status of the
Section 8 Program in Orange County.
Funding Capacity
The U.S. Department of Housing and Urban Development provides funding for the Section 8
Program.. The approved Section 8 budget for Fiscal Year 2003-2004 is $4,319,160. This
budget authority is projected to fund approximately 623 units. However, due to increasing rental
rates and the bedroom composition of our participants our actual costs are beginning to exceed
the budget authority, thereby, necessitating a need to request amendment funds from HUD.
The necessary funds have been granted to date in order to allow us to meet our expenses,
however, a pending Congressional Bill, if passed, may radically change HUD's budgeting
practices.
Current Program Characteristics
~ Approximately 269 property owners lease property to 623 on average.
~ The majority of the rental units are in the Carrboro/Chapel Hill area (Southern
Orange County).
~ Racial family composition: approx.60% African-American; 37% Caucasian; 3%
Other.
~ Most non-elderly heads of households are working families,
~ Most families lease two-bedroom units.
~ Current waiting list totals 494 families and was closed to new applicants in
October 2001.

Why Closed?
In October 2001, the Department suspended receipt of new Section 8 applications because
of the anticipated lengthy wait for assistance -three to four years based on a turnover rate
of approximately 25% per year. With such a massive waiting list and associated waiting
period, department staff considered it unfair to continue to accept applications when rental
assistance may be years away. At that time the Greensboro Office of HUD was consulted
and they concurred with our assessment..
Between October 2001 and August 2002, there was no significant turnover in the program
and thus no available vouchers. In other words, clients did not leave the program to "free
up" a voucher for another client's use. Therefore, we were not able to select any applicants
from the waiting list far potential assistance during that time. The program did begin to
experience turnover in September 2002 and we began making selections from the waiting
list.
Why not purge?
The waiting list was last purged in the Fall 2000. It is customary that most housing
authorities purge the list every two -three years. Since the County has not accepted
applications for the past 20 months last year, we essentially have athree-year-old waiting
list. It is anticipated that it would be disastrous to purge the list with a closed waiting list
thereby not allowing applicants an opportunity to reapply for assistance should they be
purged from the list. Therefore, logistically, purging should occur at a time that the waiting
list is open. Thus, purging the waiting list will be re-examined at the time of waiting list
review - at the end of the fiscal year.
In the interim, we have been making selections from the list as people have left the program
and new vouchers have become available. Waiting list selection is essentially a form of
purging since those persons are removed from the list. Since September 2002,
approximately 543 applicants have been selected from the list, thus the current waiting list
totals 494.
Waiting List Selection
Selections are made from the waiting list according to date and time of application and
preference ranking.
The program presently has maintained the following Waiting List Preferences for the
applicants that are:
a. Involuntary displaced;
b, Living in substandard housing to include homeless families;
c. Paying more than 50% of their income for rent and utilities; and
d. Elderly and/or Disabled,
Additionally, the program has the following Local Preferences for:
a. Families who live, work, or have been hired to work in the jurisdiction.
b. Families who are graduates or participants in an education and training program
to prepare far self-sufficiency.
c. Graduates of transitional housing programs for homeless persons; substance
abusers; and victims of domestic abuse.
Of the current applicant families on the waiting list, less than 5% have preferential
placement.
Project Based Assistance Update
In November 2002, the BOCC approved a Section 8 Project Based Program in Orange County.
This policy was approved in anticipation of the potential future development of rental housing
complexes far families and individuals with special needs. A project-based program will provide
for the allocation of Section 8 assistance to specific, existing or new dwelling units serving
persons with disabilities with incomes less than 50% of the median income. This is in contrast
to the current tenant-based program that allows low-income persons to receive rental subsidy
regardless of location.
In January 2003, OPC Foundation for Mental Health submitted an application for 24 project-
based vouchers for the new Club Nova apartments to be built in Carrboro. That application was
submitted to the Greensboro HUD office on February 13, 2003 for review. On December 5,
2003, the County received notification of the approval of 24 project-based vouchers for the Club
Nova Apartments. It is important to note that the approval of these project-based vouchers
means that these vouchers are taken from our existing voucher pool and does not represent a
new allocation of vouchers. Thus, designating 24 vouchers for the Club Nova Apartments will
reduce the number of tenant based vouchers available countywide. During the year of 2004, all
vouchers that "turnover" or are returned to the County will be reserved in order to have 24
vouchers available in October 2004 when the Club Nova Apartments are expected to be
available for lease. With no new voucher allocations, the number of vouchers available under
the tenant-based program will be reduced to 599.

I. The streamlined Annual Plan is consistent with the applicable comprehensive housing affordability strategy (or any streamlined
Plan incorporating such strategy) for the jurisdiction in which the PHA is located.
2. The PHA has established a Resident Advisory Soard or Boards, the membership of which represents the residents assisted by
the PHA, and provided this Board or Boards an opportunity to review and comment on any program and policy changes since
submission of the last Annual Plan.
3- The PHA made the proposed streamlined Annual Plan, including policy and progran revisions since submission of the last
Annual Plan, and all information relevant to the public hearing available for public inspection nt least 45 days before the hearing,
published a notice that a hearing would be held and conducted a hearing to discuss the streamlined Plan and invited public
comment.
4 The PHA will carry out the streamlined Annual Plan in conformity with Title VI of the Civil Rights Act of 1964, [he Fair 1-lousing
Act, section 504 of the Rehabilitation Act of 197.3, and title H of the Americans with Disabilities Act of 1990.
5 The PHA will affirmatively further fair housing by examining their programs or proposed programs, identify mry impediments to
fair housing choice within those programs, address those impediments in a reasonable fashion in view of the resources available
and wod< with local jurisdictions to implement any of the jurisdiction's initiatives to affirmatively further fair housing that require the
PHA's involvement anti maintain records reflecting these analyses and actions.
6. For streamlined Annual Plans that include a policy or change in policy for site-based waiting lists:
The PFIA regularly submits required data to HUD's MTCS in an accurate, complete and timely manner (as specified in P[H Notice
99-2);
The system of site-based waiting lists provides for full disclosure to each applicant in the selection of the development in which
to reside, including basic information about available sites; and an estimate of the period of time the applicant would likely have to
wait to be admitted to units of different sizes and types at each site;
Adoption of site-based waiting list would not violate any court order or settlement agreement or be inconsistent with a pending
complaint brought by HUD;
The PHA shalt take reasonable measures to assure that such waiting list is consistent with affirmatively furthering fair housing;
The PHA provides for review of its site-based waiting list policy to determine if it is consistent with civil rights laws and
certifications, as specified in 24 CFR part 903.7(6)(2)-
7. The PHA will comply with the prohibitions against discrimination on the basis of age pursuant to the Age Discrimination Act of
1975.
8. The PHA will comply with the Architechrml Barriers Act of 1968 and 24 CFR Part 41, Policies and Procedures for the Enforcement
of Standards and Requirements for Accessibility by the Physically Handicapped.
9 The PHA will comply with the requirements of section 3 of the Housing and Urban Development Act of 1968, Employment
Opportunities fbr L,ow-or Very-Low Income Persons, and with its implementing regulation at 24 CFR Part 1.35,
!0. The PHA has submitted with the streamlined Plan a certification with regard to a drug-free workplace required by 24 CPR Part
24, Subpart F.
I I. The PHA has submitted with the streamlined Plan a certification with regard to compliance with restrictions on lobbying required
by 24 CFR Part 87, together with disclosure forms if required by this Part, and with restrictions on payments to influence Federal
Transactions, in accordance with the Byrd Amendment

section l2 of the United States Housing Act of 1937 and the Contract Work Hours and Safety Standards Act.

program requirements.

l8 The PHA will comply with the policies, guidelines, and requirements of OMB Circular No, A-87 (Cost Principles for State, Local

19. The PHA wilt undertake only activities and programs covered by the streamlined Annual Plan in a manner consistent with its
streamlined Annual Plan and will utilize covered grant funds only for activities that are approvable under the regulations and
included in its streamlined Plan.
20 All certifications and attachments (if any) to the streamlined Plan have been and will continue to be available at all times and all
locations that the PHA streamlined Plan is available for public inspection. All required supporting documents have been made
available for public inspection along with the stmamlincd Plan and additional requirements at the primary business office of the
PI1A and at all other times and locations identified by the PHA in its streamlined Annual Plan and will continue to be made
available at least at the primary business office of the PHA.
