PURPOSE: To receive authorization to submit the Quarterly Public Hearing Legal
Advertisement for publication of the May 28, 2002 meeting.
BACKGROUND: The next regular quarterly public hearing is scheduled for May 28, 2002.
A summary of the hem proposed for public heading is provided. Staff is available to research
and answer questions prior to the public hearing.

A. SCHOOLS ADEQUATE PUBLIC FACILITIES ORDINANCE
Purpose: To conduct a second public hearing on the Schools Adequate Public
FacJli0es Ordinance Memorandum of Understanding (MOU)and ordinance to
address modifications suggested through previous public headings, Schools and
Land Use Councils(SLUC), attorney, and administration comments. The
revisions specrically address the timing of issuance of a school Cedificate of
Adequate Public Facilities (CAPS)to new development and a process for annual
reevaluation and update to the technical school capacitylmemberehlp formula. A
few other matters were addressed in the proposed MOU.
Residential growth has increased sharply in Orange County over the past decade,
in large part due to the well-known quality of the public schools in the County.
Concern has been expressed by elected officials that overcrowding in the schools
could jecpar ize the quality education that is a linchpin of the quality of life In
Orange County. In 1999, a joint committee of elected officials, staff members from
the County and Towns of Cambers, Chapel Hill, and Hillsborough and both school
discrete began the process of designing ways to maintain proper levels of

educational service by synchronizing residential growth with educational capital
'facilities. TMS method has been used effectively In other areas of the country
where residential growth Is over-burdening public facilities.
This committee began to look at me issue of linking new development to the
capacity of schools as a way to help ensure quality schools In Orange County.
From this committee was developed a model MOU and a model ordinance. This
MOU and ordinance have been refined through previous public input including a
public heading conducted in Orange County on November 27, 2000. Based upon
recommendations from public comment, the Joint Schools and Land Use Council
has amended the YOU and ordinance Into Its current forth at its November 2001
meeting. Because of substantive changes made to both documents, It is required
that they come to a public hearing a second time.
FINANCIAL IMPACT: Thera is no financial Impact associated with this decision.
Advertisement costs are Included in the departmental budget for County Initiated items.
RECOMMENOATIONI The Administratbn recommends approval of the proposed May 28,
2002 Quarterly Public Heading legal advartlsement.

NOTICE OF PUBLIC HEARING
ORANGE COUNTY BOARD OF COMMISSIONERS
A public hearing will be held in the Judge F. Gordon Battle Supol Courtroom of Me
New Orange County Courthouse, 106 E. Margaret Lane, Hillsborough, North Carolina, on
Tuesday, May 26, 2002, at 7:30 PM for the purpose of giving all interested citizens an
oppadunity to speak for or against the following item:
A. SCHOOLS ADEQUATE PUBLIC FACILITIES ORDINANCE

of this growth management strategy_

Changes may be made In the advertised proposals that reflect debate, objections,
and discussion at the hearing.
Accommodations for individuals with physical disabilities can be provided if the
request is made to the Director of Planning at least 48 hours prior to the Public
Heating by calling the appropriate number listed bales. The full text of the
changes may be obtained after May 21, 2002 from the Planning Department. Also,
the text may be obtained at the County website www.co.orampanc.us at the
Aerating and Reports link prior to the meeting.
