PURPOSE: To discuss several opportunities for collaboration related to planning and
development and the environment.
BACKGROUND:
a) Courtesy Review
The purpose of this item is to consider a revised courtesy review agreement between the Town
of Hillsborough and Orange County. This hem was previously discussed at a joint meeting
between the Boards on January 31, 2001.
A few issues were unresolved at that time, such as fire size or threshold limit activating review
of a pmject. These Items have since been discussed and negotiated by a Joint staff work group
consisting of John Link, Orange County Manager, Craig Benedict, Orange County Planning
Director, Edo Petersen, Hillsborough Town Manager, Demetric Potts, Assistant Town
Manager/Public Works Director, and Margaret Hal Town Planning Director.
A revised agreement is now presented for consideration. The primary difference tram the
previous agreement involves setting a threshold for project review of five acres for land use
amendments, rezonings, special use permits,conditional use permits and annexations,or a
project with a 50-unit residential component. These thresholds include both residential and
non-residential (i.e. commercial, offices, industrial)projects. As with the previous agreement
the area includes the water and sewer service area boundary bath in Orange County and the
Town of Hillsborough jurisdiction.
The process for distribution of development project review material in each local government is
not included in the agreement because It is an internal process. The agreement does include

the five working day tlmeframe for return of comments. This timeframs is important because It
may allow time for review and comment while still permitting both parties to adhere to adopted
agenda review and distribution schedules. The timeframe of a five-0ay'lurnaround"for
comments can be difficult In some cases, so an Increased timeframe may be warranted for
certain projects. This issue can be discussed at the meeting. Possibly, a request could came
forward from either jurisdiction asking for an additional but limited time extension in certain
cases of interest.
Either jurisdiction may request a joint meeting of the elected boards to discuss a development
proposal subject to a courtesy review. The request shall be made in writing by the reviewing
jurisdiction when comments are submitted or in writing by Me approving jurisdiction upon receipt
of comments. When either party requests a joint meeting, the approving jurisdiction agrees to
delay its approval process for the project in question in order to accommodate the joint meeting.
If such a meeting is scheduled,the developer will provide five(5)additional copies of the a
development proposal application.
b) Coordinating County Comprehensive Plan & Hillsborough Strategic Growth Plan
Orange County is updating as Comprehensive Plan which includes many aspects of planning and
goal setting forotherpublio seMcesaM facilities. Since many aspects of planning births future do
not easily followjuns lictlon boundaries,the had!for coordination and consistency between local
governments is inportars to promote an orderly,tax efflclent growth plan which prudently allocates
resources, Since Change County and Hillsborough are preparing plans for future growth,this could
serve as a good opportunity to"compare notes'and tune the land use development potandal. The.
consistent intent of both jurisdictions where Interests overlap such as the outer reaches of
Hlllsborough's possible and primary water and sewer service area add economic development
districts should be sought. Orange Cou rys planning staff Is willing to facilitate this coordinated
Effort at Me appropriate time through staff Interaction or a short farm task force.
c) Watershed Protection—Cedar Grove Reservoir
Watershed! Protection and water quality have been at the forefront of considering the impacts of
development, Accordingly,within Orange County'sjuradiction,watershed zoning overlays have
been setto reduce impervious areas antl, In some cases,Me reduction of residential density to
preserve critical and protected watersheds. These watersheds and the reservoirs,Mardi serve the
primary needs ofpublic water provision in the urban areas of the county. With the addition cf Cedar
Grove(West fork of the Eno)reservoir by Hinsborcugh, similar interests lie sigh Orange County to
continue their long standing commitment 0 improve water quality in Me region through various
methods.
With input and support from Me Town of Hillsborough, Orange County ran examine ways to
evaluate the Upper Eno Watershed to promote water quality and, thereby, reduce eventual
water treatment costs, and heighten the environmental health of the Eno River system.
d) Schools Adequate Public Facilities Ordinance
Staff will provide a report on the status of the proposed implementation of the Schools
Adequate Public Facilities Memorandum of Understanding (MOU)and Schools Adequate Public
Facilities Model Ordinance.
Residential growth has increased sharply in Orange County over the past decades, in large pad

process of designing ways to ensure superior schools without unduly jeopardizing growth.
This committee began to look at the issue of linking new development to the capacity of schools
as a way to help ensure quality schools in Orange County. This committee was developed a
School Adequate Public Facilities Memorandum of Understanding (MOU)and model ordinance.
This MOU and model claimants have been refined and approved as of November, 2001, by the
Joint Schools& Land Use Councils into their current form.
The MOU and model Schools Adequate Public Facilities ONinance in Its present form have
been recommended far approval to the four jurisdictions considering the ordinance. Before the
ordinance can take effect, seven issues must be agreed upon:
1. Level of service limits at each school level (MOU Sealed 11
2. Membership determination date (MOU Section f e)
3. Building capacity (MOU Section 1b)
4. Capital Improvement Plan (MOU Section l c(f)
5. Student Growth Rata (MOU Section 1c(ii))
6. Student Projection Method (MOU Section Icong
7. Student Generation Rate per Dwelling Unit (MOU Section Ic(iv))
The MOU can be approved with the issues noted above as being resolved/addressed prior to
the actual ordinance being added to the land development regulations
FINANCIAL IMPACT: There is no financial impact associated with discussion of these issues.
RECOMMENDATION($): The Manager recommends that the Board discuss these issues and
concerns and provide any necessary comments to staff.
