PURPOSE: To consider five (5) untimely applications far granting exempt status from
ad valorem taxation for the 2003 tax year,
BACKGROUND: The Rifai Marufi Order of America submitted an application for property tax
exemption on October 17, 2003 for parcel # 666464, Empowerment, Inc. submitted
applications on December 1, 2003 for tract # 701953 and tract # 766273. Affordable Rentals,
Inc, submitted applications on November 26, 2003 far tract # 766099 and tract # 766100. North
Carolina General Statutes state that applications for exemption must be filed during the normal
listing period, which is during the month of January
NCGS 105-282.1(a)(5) does allow some discretion. Upon a showing of good cause by the
applicant for failure to make a timely application, an application for exemption or exclusion filed
after the close of the listing period may be approved by the Department of Revenue, the board
of equalization and review, the board of county commissioners, or the governing body of a
municipality, as appropriate. An untimely application for exemption or exclusion approved
under this subdivision applies only to property taxes levied by the county or municipality in the
calendar year in which the untimely application is filed.
The Rifai Marufi Order of America is applying for exemption based on NCGS 105-278,3, which
allows exemption for real and personal property used for religious purposes, Empowerment,
Inc, and Affordable Rentals are applying for exemption based on NCGS 105-278.6, which
allows exemption for real and personal property used for charitable purposes providing housing
for individuals or families with low or moderate income, Based on the information supplied in
the current applications and the above referenced general statutes the applicants can be
approved for 2003, The opinion of the Assessor is that the information provided to date
satisfies the good cause requirement of NCGS 105-282.1,(a)(5), and that the five (5) properties
should be approved for exemption,
FINANCIAL IMPACT: The reduction in the County's tax base associated with approval of these
exemption applications will result in a reduction of 2003 taxes due to the County, municipalities,
and special districts in the amount of $4,080.98.
RECOMMENDATION(S): The Manager recommends that the applications for 2003
exemption be approved.

Whereas, North Carolina General Statutes 105-282. I empowers the Board of County
Commissioners to approve applications for exemption after the close of the listing period, and
Whereas, good cause has been shown as evidenced by the information packet provided,and
Whereas, the Assessor has determined that the applicants could have been
approved for 2003 had applications been timely.
NOW, THEREFORE, IT IS RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF ORANGE COUNTY THAT the properties applying for exemption for
2003 are so approved as exempt.
Upon motion duly made and seconded, the foregoing resolution was passed by the following

With this letter, we are respectfully aslting that you approve our late application as a
religious organization and exempt us from the tax bill we recently received for property
we own on Mebane Oaks Road. This property, PIN 9820-26-9214, tract number 666464,
was formally transferred to our church, Rifai Marufi Order of America, by deed recorded
on September 25, 2002 (deed reference 2723/450). It was donated to us by a member of
our congregation, Deborah Amaral, who had received minor subdivision approval from
Orange County in order to make a donation of this parcel of 4..37 acres from a larger
parcel she owned. We incorrectly believed that the legal transfer of the land to our
congregation also effected its formal designation as church property for tax purposes.
We regret that we did not follow through to ensure that this tools place.. We enclose
several documents attesting to our status as a religious organization, including our
Articles of Incorporation from the State of North Carolina, our acceptance as a 501(c)3
organization, a letter noting a change of mailing address, our church by-laws, and a
brochure we put together for other purposes that explains a little about who we are and
what we are about.
In speaking with Gail Jones in the Assessors Office, she suggested that we show our
intention for and use of the land thus far'. Our intention is to build a Universal Center of
Light that can be used for worship, music, and dance. We intend to make this space
available to people of all faith communities, An architectural rendering of the planned
building, designed by congregation member and registered architect Geoffrey L,ee, is
attached.
In late September 2001, we held a dedication ceremony on the land during our fourth
annual Rumi Festival of Chapel Hill. We attach a photo of the laying of a stone tinder the
intended building site. On September 29, 2002, Deborah Amaral presented the deed for
the property to our minister, M. Sherif Catalkaya, also during that year's Rumi Festivah
This transfer of deed was witnessed by local members and guests from azound the
country. Since that time, we have obtained a letter of site plan approval and also
approval of our erosion control plan, We had hoped to begin building this summer, but
were unable to obtain sufficient funding to get started. We have asked .Tolm H, Wilson
and Son of Mebane, NC to propose a bid far the grading, erosion control, and
construction ofdriveway and parking area. We still hope to be able to begin this initial
stage of building before winter,
We are very cony that this request is coming to you after the fact. We hope you will find
away to allow us to be registered as anon-profit church for tax purposes for this and
future yeazs, and retroactively, We love the land Ms. Amaral has bequeathed to us, and
we intend to use it with respect for the beauty of the natural surroundings, and for the
benefit of humanity,
