BACKGROUND: A list of planning initiatives in the Efland/Buckhom EDD/Cheeks is noted below: 1. Resolution Establishing Rules and Regulations for Me Operation of a Sewer Collection Treatment System to Serve the Efland Area of Orange County(adopted November 19, 1985) with amendments thereafter 2. Water and Sewer Policy, Orange County, North Carolina(adopted April 3, 1989) (However,this policy is not part of Comprehensive Plan which would couple land use policy decisions with water and sewer polidea.I 3. Efland Small Area Planning Study(adopted in 199 1) 4. Buckhon Economic Development Districts (EDD)(adopted 1994) 5. Reaffirmation of Overall System Plan of the Adopted Efland Area Sewer System (element of aforementioned Item 1) (reaffirmed April 17, 2001) 6. Resolution Outline Efland Sewer System Issues Related to Extensions to Undeveloped Properties (approved May 15,200 1)[Attachment of 2 The overall system plan of the adopted Efland Area Sewer System was reaffirmed at the April 17, 2001 meeting to include Phase I West and East and Phase II and other minor amendments. Due to the county's strong commitment to comprehensively plan for growth, an overall review of land use and zoning and its public service impacts depending on the density or intensity of a project was evaluated by such and now is to be discussed by the BOCC and the community. Complementary public services of public potable water, public sewer, and fire suppression are guiding elements of appropriate growth planning. Therefore,there is need for coordination between all public service providers such as Orange County on behalf of the Efland Area Sewer System, Orange Alemence Weer System (OAWS), City of Mebane, Town of Hillsborough and county and local fire districts. The next step is to evaluate issues regarding the Efland Sewer operation. The Mies were originally adopted in the mid 1980's with several amendments thereafter. What conditions have changed that may warrant further amendment to the resolution? The Outline of Issues attached (Attachment a) Identifies those Issues that reflect changing policy conaideiaticns. In summary, the focus of this meeting report is to elaborate on the need to proceed on the design of the 1997 Bond Efland Sewer Area and discuss related matters in pursuit of that initiative. PRELIMINARY STAFF RECOMMENDATION(S): 1. Determine Urban Service Line in and around Phases 1A mad,existing), 1B (peach). 2 (yellow), 3 (green) and 4 (blue). 2. Bid final design of 1997 Band Area with urban service area noted above in mind for potential future expansion. 3. Examine Urban Service Line in Buckthorn EDD/Cheeks Area. 4. Continue more formal discussions with City of Mebane In Study Map areas 1, 2, 3 (not related to any aforementioned phasing). 5. Consider changes to land use designation in all study areas as part of Comprehensive Plan to be consistent with Village Growth Boundary. FINANCIAL IMPACT: None at this time related m planning studies, but eventually bond expenditures to Pursue Efland sewer expansion will be necessary. RECOMMENDATION(B): The Manager recommends that the Board consider the report and offer direction for further staff research, committee creation, RFP design services and/or agenda Item preparation. The Rules and Regulations for the Operation of a Sewer Collection Treatment System to Serve the Efland Area of Orange County make a clear distinction between connecting - to the System and exten81on9 Of the System to sera undeveloped land. _ A. Cennactions Of existing lots to the System do not implicate policy and are generally accomplished with Payment Of necessary fees, an application for sewer service end an acknowledged Efland sewer System sewer Easement and Agreement. E. Retenaiona of the System into undeveloped land do implicate policy and are controlled by Section IX of the Rules and require that the extensions: 1. be consistent with the Overall system. Plan; 2 . be consistent with (1) goal 9.3 of the Orange County Land Use Plan which goal prohibits the establishment of public water and sewer services in the areas designated water quality critical areas, _ cept to address emergency situations and 8 � (2). any water end sewer policy the County has adopted as part of its Comprehensive Plan; 3. be approved by the County.engineer if 1. and 2. are accomplished and if all zoning, subdivision, land use plan and comprehensive plan regulations of orange county or the Town of Hillsborough, if applicable, .are met. Before the County. engineer can approve,an extension of the system to serve undeveloped land, a subdivision preliminary plan - must be approved by the County which preliminary plan includes approved preliminary plane for the system extensions. II. Temporarily Ceasing artersions of the System to serve undeveloped land will provide the Beard of conmiiacionere With of opportunity to address the following. issues: A. whether end to what extent to allow extensidm of the System where the homes in the development to which the System is extended will be served by private wells; B. whether and to what extent to allow extension& of the system where the homes in the development to which the System is extended will be Served by private water systems; C. whether and to what extent to allow extensions of the System where the homes in the development to which the . 9 system is extended will he served by a public water System) III. Issues to be addressed related to public water Systems providing public water to homes served by a System extension include: A. COOSieoency with State law regarding interbaein transfers; - B. Pon River Capacity Use Agreement revisor; C. the .extent and the impact of augmenting Surface water Supply with large capacity wells; D. the existence of a State approved water supply plan for the public water supply System; S. to the extent it can reasonably he determined, the impact on ground water resources including recharge Capabilities of ground water resources in the area of public water supply system wells augmenting surface water supply; F. the following issues with respect to the Orange Alamance Water System: 1. Land Use and Zoning: uses plans to Coordinate its efforts with Orange County Land Use plan, Zoning Regulations and Efland Area Sewer System Rules. 2. Neater Plan - long Range System Plan and Design a. Status of State action on Water Supply Plan. 10, b. OAWS participation with orange County/ Hillsborough/Nebene in combined efforts to r the Efland-Cheeks Area and in the Mend area small area planning process with other stakeholders.. 3. EFLAND/BUCKHORN EDD/CHEEKS PLANNING AREA STUDY FY 2002-2003 GOAL OUTLINE Conduct a comprehensive study and recommendation for the development of Me EflandlBuckhorn EDDICheeks to examine all facets of growth including environmental impact,water, sewer,traffic, urban/rural growth patterns.
