MINUTES OF THE BOARD OF COUNTY COMMISSIONERS
April 1, 1963
The Orange County Board of Commissioners met in regular session on Monday, April
1, 1963, at ten o'clock a.m. in the Commissioners room at the courthouse in Hillsboro,
N. C.
Members present: Chairman Donald Stanford, Commissioners Harvey D. Bennett,
Gordon Cleveland, Carl M. Smith and Henry Walker.
Members absent: None
The minutes of the March meetings were read by the Clerk and approved by the
Board.
Upon motion of Commissioner Walker, seconded by Commissioner Bennett, and
unanimously adopted, the Clerk was ask to write a letter of appreciation for
Walter Wrenn, former Veterans Service Officer.
The Mayor and Town Alderman of Carrboro had submitted the following names as
prospective members of the Carrboro Planning and Zoning Board. From these names the
Commissioners were to appoint two members to the Planning and Zoning Board. The
names submitted were: Don Lowe, Calvin Burch, George Cole and Boyd Ellington.
There bad been also submitted for appointment to the Carrboro Board of Adjust-
ment the following names: Fred Wright, Aubrey Harward, Jesse Basnight and Ken
Riggsbee. Tbese._terms were to be one appointment for a one year term and the.-other
appointment for a two year term. No action was taken on this matter.
A. H. Graham, called the attention of the Board to the matter of unpaid fines
and costs which presently exist in the Recorder's Court. He suggested that the
docket should be cleared of the old cases in order to bring the court up to current
status. The Chairman and the County Accountant were ask to discuss this matter with
the new Judge.
Chairman Stanford thanked Mr. Graham for the service he had rendered to the
County in the position of Judge of the Recorder's Court and for his other services
in the past.
Chairman Stanford began a discussion of proposed legislation which was contained
in the _Legislative Bullentin from the North Carolina Association of County Commis
sioners?Commisaioners reached the following conclusions concerning the proposed
legislation.
SB 27 would allow counties to assess the cost of construction of water and
sewer lines against benefited property.
Upon motion of Commissioner Smith, seconded by Commissioner Cleveland, and
unanimously adopted, it was agreed that Orange County should be included under SB 27.
Chairman Stanford requested opinions concerning the Medical Care Development
sometimes referred to as M.A.A. This Board did not feel inclined to support the so
called M.A.A. proposal.
Property tax on manufacturing inventories was discussed. This proposal would
exempt manufacturing inventories from taxation. The Board opposed this proposal.
Welfare Legislation suggested was to increase the size at option of the county
from a three man board to a five man board. This proposal was approved.
School Construction Action Needed, this would provide for state assistance in
school construction. This proposal was approved.
One of the bills pending in the legislature is the one pertaining to relief
for counties who have State owned properties. This proposal was approved.
The following department officials presented reports for the month of March
1963:

Upon motion of Commissioner Cleveland, seconded by Commissioner Walker, and
unanimously adopted, action on the appointment for the Carrboro Planning and Zoning
Board and the Carrboro Board of Adjustment was tabled.
G. Paul Carr, Supt, of the Orange County Schools, and members of the Orange
County Board of Education were present and presented the following act relating to
per diem and mileage of certain officers of Orange County.
"Section 1. Section 115-46 of the General Statutues as amended by Section 1
of Chapter 281 of the Session Laws of 193, (is hereby further amended by deleting
the words and figures "eight dollars ($8.00)" from the 19.53 Amendatory Act and
inserting in lieu thereof the words and figures "Fifteen dollars ($15.00)", and
by deleting the words and figures "seven cents (7¢)" from the 1953 Amendatory.Act
and inserting in lieu thereof the words and figures "ten cents (10¢)".
Section 2. Payment of per diem to members of the Board of Education of orange
County of ten dollars heretofore made is hereby validated.
Section 3. All laws and clauses of laws in conflict with this Act are hereby
repealed.
Section 4. This Act shall be in full force and effect from and after its
ratification.
Approval moved Delmar Brown, seconded by John E. Hawkins, and passed.

The Commissioners approved.tbe request submitted by the Orange County Board
of Education.
Letters of application for the position of Recorderts Court Judge were reed
by Chairman Stanford. A discussion ensued concerning this appointment.
Upon motion of Commissioner Smith, seconded by Commissioner Cleveland, and
unanimously adopted, Marshall Smith of Chapel Hill was appointed as Judge of the
Recorder's Court to complete the unexpired term of the Honorable L. J. Phipps.
L. J. Phipps, Representative for Orange County, was present. Chairman Stanford
thanked Mr. Phipps for the services he had rendered to the county in the capacity
lof Judge of the Recorder's Court.
The Board then discussed with Representative Phipps the proposed legisation
which would be coming before the House and expressed to him their interest in
certain of these proposals. A copy of the act relating to per diem and mileage of
certain officers of Orange County which bad been presented by the Orange County Board
of Education was given to Representative Phipps.
Dr. Garvin, District Health Officer, requested that orange County be included
with the provision of Article 6 of Chapter 87 of the General Statutes Relating to
Water Well Contractors. Dr. Garvin pointed out the need for such sction within the
county.
Upon motion of Commissioner Smith, seconded by Commissioner Cleveland, and
unanimously adopted, Representative Phipps was requested to bring Orange County under
the provision of Article 6 of Chapter 87 of the General Statutes of North Carolina.

Prange County Agricultural Building.
There being no further business the meeting was adjourned.
