Resolution PURPOSE: To consider the adoption of a resolution approving changes to the Code of Ordinances to authorize the addition of a second youth delegate non-voting member to the Orange County Parks and Recreation Council (PRC). BACKGROUND: At its May 3, 2022 Business meeting, the BOCC approved the addition of a non- voting youth delegate position on the Orange County Parks and Recreation Council. The Council, now comprised of 13 appointed members including the previously-approved non-voting youth delegate, has expressed an interest in adding a second youth member in a non-voting capacity. This second non-voting member would also be an applicant between 13 and 17 years of age to be appointed by the BOCC. The addition of a second youth member will require a change to the Code of Ordinances section that governs the PRC. A memorandum from the PRC, a resolution, and the proposed changes to Article 26, subsections 26-115 and 26-117 of the Code of Ordinances are attached. If approved, the PRC would work with the Clerk to the Board's Office to recruit applicants. FINANCIAL IMPACT: There is no identified financial impact associated with this item. SOCIAL JUSTICE IMPACT: The following Orange County Social Justice Goals are applicable to this item: • GOAL: ENABLE FULL CIVIC PARTICIPATION Ensure that Orange County residents are able to engage government through voting and volunteering by eliminating disparities in participation and barriers to participation. • GOAL: FOSTER A COMMUNITY CULTURE THAT REJECTS OPPRESSION AND INEQUITY The fair treatment and meaningful involvement of all people regardless of race or color; religious or philosophical beliefs; sex, gender or sexual orientation; national origin or ethnic background; age; military service; disability; and familial, residential or economic status. 2 An additional youth PRC member would provide input on issues and concerns relating to youth participation in recreation activities and County parks and serve as a colleague to the previously- approved youth position. ENVIRONMENTAL IMPACT: There is no Orange County Environmental Responsibility Goal impact associated with this item. RECOMMENDATION(S): The Manager recommends that the Board adopt and authorize the Chair to sign the attached resolution approving changes to Article 26 of the Code of Ordinances, adding a second non-voting youth delegate member to the Parks and Recreation Council. 3 Attachment 1 ORANGE COUNTY PARKS AND RECREATION COUNCIL MEMORANDUM TO: Orange County Board of County Commissioners FROM: Parks and Recreation Council DATE: December 8, 2022 RE: Parks and Recreation Council Youth Delegate Member Position Proposal The Parks and Recreation Council (PRC)thanks the Board of County Commissioners for creating the first youth delegate position for the PRC on May 3rd, 2022. At its October and December meetings, the Parks and Recreation Council (PRC) developed a recommendation for the current youth delegate, and as part of this conversation discussed the value and benefit in an additional second non-voting"youth delegate"member on the Council. We understand that this would require another small amendment to the Code of Ordinances (Article 26)to be approved by the Board of Commissioners. The PRC recommends that another youth delegate be authorized and solicited. This would become the 14th member of the Council but like the previous be a non-voting position, to be held by an Orange County resident youth(13 to 18 years of age)who has an interest in parks and recreation activities in Orange County. The addition of a second youth delegate member position to the PRC council would bring more valuable insight to decisions relating to parks and recreation, from one who participates in recreation activities and/or visits parks regularly with their family. It would also provide a colleague for the newly-created position. Thank you for your consideration of this proposal. There is hereby created an Orange County Parks and Recreation Council composed of 12 residents of Orange County as voting members plus ene two non-voting youth delegate delegates,to be known as the Orange County Parks and Recreation Council. Each member of the Council shall be a county resident appointed by the county board of commissioners. The county parks and recreation council shall be composed of seven members representing the seven townships in Orange County,plus one each from the cities of Chapel Hill, Carrboro,and Hillsborough with two members at-large and one two non-voting youth delegate delegates being between the ages 13 and 17. Amended: February 5, 1979 June 4, 2002 April 21, 2015 May 3,2022 February 7,2023 6 RES-2023-010 Attachment 3 RESOLUTION OF AMENDMENT A RESOLUTION AMENDING CHAPTER 26 OF THE ORANGE COUNTY CODE OF ORDINANCES Be It Resolved by the Board of Commissioners of Orange County, North Carolina: WHEREAS, on the 3rd of May, 2022, the Board of County Commissioners adopted an amendment change to allow an additional non-voting youth member to the Orange County Parks and Recreation Council; and WHEREAS, the Orange County Parks and Recreation Council, an advisory board to the Board of County Commissioners, has proposed an amendment to the Orange County Code of Ordinances to allow a second additional non-voting youth member; and WHEREAS, the Parks and Recreation Council sees the value of having the perspective of a second youth member on the Council, as youth are a large part of the constituency and users of County recreation programs and facilities; and WHEREAS, the value of having a second youth representative to collaboratively work with their colleague to help advise and provide unique feedback on County recreation activities and park facilities is desirable, along with promoting a diversity of age for the Council's review and deliberations, both of these factors making the case to amend Chapter 26 of the Orange County Code of Ordinances accordingly; NOW THEREFORE BE IT RESOLVED that the Orange County Board of Commissioners amends the Code of Ordinances, Orange County, North Carolina, Chapter 26, to add new language to subsections 26-115 and 26-117 as shown in the attached, to provide for the addition of a second non-voting youth member to the Parks and Recreation Council for the reasons stated above, with applications for such new member to be solicited by the Clerk to the Board's Office for future consideration and appointment. This Amendment shall become effective on February 28, 2023. Adopted by the Orange County Board of Commissioners this the 7th day of February, 2023.
