The Board has requested that staff provide an update on the progress of
the TDR Feasibility Study. Since the contract with the study consultant,
The Louis Berger Group and the UNC -Charlotte Urban Institute, was
signed in April, the consultants have set to the tasks outlined in the Scope
of Services. To date these tasks have included the following items:
1, Expert Interviews: Most of the readily available
interviewees have been completed.
2, Legal Analysis: Some additional work may be desirable,
depending on the specific areas of concern, A legal
decision tree and additional legal review are ongoing.
3, Case Studies: A slide presentation is being prepared with
some additional formatting required.
4. Economic Review. and
5. Decision Matrix: This will incorporate the legal decision
tree and will include graphic and detailed text.
In May, the Board appointed ten citizens to the TDR Task Force. The
citizens include the following: Betty Cross, Marge Limbert, Hervey
McIver, Scott Radway, Martin Rody, Jason Jolley, Monica Evans, Pamela
Paul, Robert Dowling, and Martha Hoylman.
Attachment 1, a two-page memorandum from the consultant, summarizes
the five items listed above..

Glenn,
The following is our second status report for the Orange County TDR Feasibility
Study project, The schedule for our deliverables has slipped considerably, by at
least 10 weeks, in large part due to delays in assembling and convening the Task
Force. Along wi#h this transmittal is our first major technical report that covers
items such as legal considerations, program decision tree, economic
assessment, and summaries of case studies and stakeholder interviews, The
contents of these were prepared without the benefit of a Task Force meeting,
which, as I understand, has not been scheduled as yet, As a result, I think that
we have actually progressed to a considerable degree into Phase II with some
of our work.. However, I did not feel that it was appropriate to continue to wait
for a Task Force meeting before we submitted our first, draft deliverables on
these items..

Phase I -Background Research ~ Status
Data Gathering _
A. Meet with County Planning Staff (2) Three meetings with staff have been completed
to date. Additional meetings have not been
scheduled.
B. Collect & Review Documents and Data 95% Completed. Tracking down water/sewer GIS
Files data (other than OWASA) has been a significant
challenge; the staff has been passed to different

C. Conduct Key Person Interviews 90% Completed and submitted in draft form
(8.12.2005). Some interviews remain, especially
private development interests, who are not
returning numerous phone calls. We will not be
able to complete interviews with County
Commissioners besides Barry Jacobs, according

D. Analyze Property Values & Market Trends Completed in draft form submitted (8.12.2005).

schedule is no longer valid, and must be updated prior to providing a
comparison to existing progress.
