SUBJECT: Amendment to the Contracts of the Attorney and Clerk

PURPOSE: To amend the contracts of the employees directly hired by the Board of
Commissioners to clarify retirement benefits.
BACKGROUND: In advance of the 2022 performance evaluations of the Clerk, Manager, and
Attorney, the County Attorney noticed that retirement benefits are not adequately specified in
the contract documents for two of these employees. (the county manager received a separate
retirement benefit in 2019.) Specifically, the documents are lacking language that the two
employees are to receive the same access to the same retirement benefits available to other
County employees with similar time employed with Orange County. If satisfactory to the Board,
the following change to the contract language would accomplish this goal.

SECTION 11: RETIREMENT
Employee will continue to participate in the North Carolina Local Governmental
Employees Retirement System, with the County contributing the employer's share to that
retirement program at a rate consistent with other county employees.
To:
SECTION 11: RETIREMENT
Employee will participate in the North Carolina Local Governmental Employees'
Retirement System, with the County contributing the employer's share to that retirement
program at a rate consistent with other County employees. Should Employee retire from
Orange County, the Employee shall receive the same Orange County retirement and
retiree health benefits available to other County employees per Orange County Code of
Ordinances Section 28-36 as adopted at the time of this Amendment.
FINANCIAL IMPACT: There is no immediate financial impact associated with this action.
SOCIAL JUSTICE IMPACT: There is no Orange County Social Justice Goal impact associated
with this item.

ENVIRONMENTAL IMPACT: There is no Orange County Environmental Responsibility Goal
impact associated with this item.
RECOMMENDATION(S): The Chair recommends the Board approve the amendment language
as shown above, authorize the County Attorney's Office to prepare contract amendments
reflecting the amended language, and authorize the Chair to sign the contract amendments for
contracts of the Clerk and County Attorney.
