Resolution Authorizing the Sale and Management Services, 919-245- Upset Bid Process for 0.27 Acre 2658 Property, GIS PIN #985833971 PURPOSE: To approve a resolution authorizing the sale of a County-owned 0.27 acre property, GIS PIN #9779088613, Hillsborough, NC, through a negotiated offer, advertisement, and upset bid process. BACKGROUND: The County owns a 0.27 acre property, GIS PIN #985833971, in Hillsborough. The property is comprised of a narrow slice of land that of little value to the County (Attachment 1 - Map of Property). The Orange County Tax Administration Office has valued the land at $3,800 (Attachment 1). Daniel and Jean Ricca, adjacent property owners, approached the County with an offer to purchase for $4,000 and have submitted the proper documents and a certified check for $200. This property was originally created when the surrounding subdivision was approved and recorded in 1996. The developer deeded the fee simple ownership to Orange County and Parcel Identification Numbers (PINs)were assigned. The subject parcel was never reserved or dedicated as a public or private right-of-way. It was common practice in the 1990s to create these lots as "place holders" in the event that adjacent tracts were developed and connectivity was needed. In accordance with North Carolina General Statute 160A-269, public property may be sold through a negotiated offer, advertisement, and upset bid process. All offers for the purchase of County property must be presented to the Board of County Commissioners for consideration. Attachment 3 is a resolution authorizing the sale of the property through an upset bid process. Should the Board approve the offer for the sale of this property in this manner; a notice of sale will immediately be placed in a local paper and on the County's Purchasing web page. The notice shall contain a general description of the property, the amount and terms of the offer, and a notice that within ten 2 days any person may raise the bid by not less than ten percent (10%) of the first one thousand dollars, and five percent (5%) of the remainder. When a bid is raised, the bidder shall deposit with the County five percent (5%) of the increased bid, and the County shall re-advertise the offer at the increased bid amount for an additional ten days. This procedure shall be repeated until no further qualifying upset bids are received, at which time the Board may accept the offer and sell the property to the highest bidder. The final offer will be brought back to the Board for consideration and approval. FINANCIAL IMPACT: Sale of this land will convert a non-productive capital asset into at least $4,000 that may be re-allocated to other County needs. SOCIAL JUSTICE IMPACT: There are no Orange County Social Justice Goal impacts associated with this item. ENVIRONMENTAL IMPACT: There are no Orange County Environmental Responsibility Goal impacts associated with this item. RECOMMENDATION(S): The Manager recommends that the Board 1) Review the offer to purchase the property; and 2) Approve and authorize the Chair to sign the attached resolution authorizing the sale of 0.27 acres of land, GIS PIN #985833971, Hillsborough, NC through a negotiated offer, advertisement and upset bid process, in accordance with North Carolina General Statute 160A-269. The Orange County Board of County Commissioners authorizes the sale of the property described above through the upset bid procedure of North Carolina General Statute 160A-269. 2. The Orange County Purchasing Agent shall cause a notice of the proposed sale to be published. The notice shall describe the property and the amount of the offer, and shall state the terms under which the offer may be upset. 3. Persons wishing to upset the offer that has been received shall submit a sealed bid with their offer to the office of the Purchasing Agent, located at 405 Meadowlands Drive, Hillsborough, NC, within 10 days after the notice of sale is published. At the conclusion of the ten day period, the Purchasing Agent shall open the bids, if any, and the highest such bid will become the new offer. If there is more than one bid in the highest amount, the first such bid received will become the new offer. 4. If a qualifying higher bid is received, the Purchasing Agent shall cause a new notice of the upset bid to be published, and shall continue to do so until a 10—day period has passed without any qualifying upset bids having been received. At that time, the amount of the final high bid shall be reported to the Orange County Board of County Commissioners. 5. A qualifying higher bid is one that raises the existing offer by not less than ten percent (10%) of the first $1,000 of that offer and five percent (5%) of the remainder of that offer. 8 6. A qualifying higher bid must also be accompanied by a deposit in the amount of five percent (5%) of the bid; the deposit may be made in cash, cashier's check, or certified check. The County will return the deposit on any bid not accepted, and will return the deposit on an offer subject to upset if a qualifying higher bid is received. The County will return the deposit of the final high bidder at closing. 7. The terms of the final sale are that: - The County must approve the final high offer before the sale is closed, which it will do within 30 days after the final upset bid period has passed, and - The buyer must pay with cash at the time of the closing. 8. The County reserves the right to withdraw the property from sale at any time before the final high bid is accepted and the right to reject at any time all bids. 9. If no qualifying upset bid is received after the initial public notice, the offer set forth above is hereby accepted. The County Manager is authorized to execute the instruments necessary to convey the property to Mr. Rica, 200 Dumont Drive, Hillsborough, NC.
