State administrative laws and regulations regarding child day care facilities
have continued to evolve and change since the County Board last
amended its zoning regulations in 1991, Planning staff has met with
representatives of the North Carolina Division of Child Development in
May 1999 and again on July 21, 2Q05 to discuss the difference in
language between Orange County and State child day care regulations,
Consensus of the groups is that amending the language of the child care
provisions and definitions of the Zoning Ordinance would be the
appropriate way to deal with this issue,
Prospective child care providers face confusing language differences in
the Orange County Zoning Ordinance and respective licensing provisions
of the North Carolina General Statutes. Confusion results from unlike
terminology and standards. Zoning Ordinance language in Sections 4,3
Permitted Use Table, 6,27 Large Day Care Homes, 8,8,16 Day Care
Facilities, Section 1Q.4 Off-Street Parking Requirements, and Article 22
Definitions are dissimilar to those found in Article 7, Chapter 110 of the
General Statutes, Child Care Facilities, as amended.
A map of the facilities will be available for review at the August 22
meeting,
Staff is looking for direction on this zoning and subdivision issue
