CHCCS Elementary#9 Construction Capital Project Ordinance PURPOSE: To receive an update on CHCCS Elementary School #9 and allocate November 2001 bond funds for the Design and Construction Phase of the new school (including site work, construction and associated start-up costs), in accordance with Commissioner approved Policy on Planning and Funding School Capital Projects. BACKGROUND: On February 21, 2002, the CHCCS Board of Education approved a single prime contract bid award to Resolute Building Company to construct Elementary School #9 at Meadowmont. The base amount of the bid totaled $10,830,000. With the acceptance of twelve alternates, the total contract price is $10,921,250. This bid included costs for site work/grading and construction of the school. CHCCS has requested that the BOCC approve an amended capital project ordinance for Elementary #9 that will bring the anticipated final CHCCS/County cost for the project to $12,560,784. The November 2001 school bond referendum included $12.8 million for construction of Elementary #9. In November 2000, the Board of Commissioners approved a Policy on Planning and Funding School Capital Projects. That policy identifies two levels of school construction projects — Level 1 and Level 2. Level 1 projects are those projects that have a relatively 2 small scope of work and can be accomplished using a single prime contractor, in-house staff or entail purchasing equipment and vehicles. Level 2 projects are major projects that require several phases to complete. For these projects, the Commissioners approve project funding in four phases: • Concept/Pre-Planning Phase — includes preliminary programming and design work that would result in conceptual drawings and preliminary cost estimates. • Planning Phase — includes siting the facility, construction of infrastructure, and preparation of construction documents in preparation for bidding process. • Design and Construction Phase — includes final design, facility construction and purchase of equipment, furnishings, technology, and one-time start up items. • Final Accounting Phase — provides a reconciliation of actual project expenditures with approved budget. As defined in the policy outlined above, construction of Elementary School #9 in the CHCCS district is a Level 2 project and therefore requires that the Board of Commissioners approve the project at the various phases outlined above. Funding for the school, to be constructed at the Meadowmont subdivision in Chapel Hill, comes from a combination of pay-as-you-go monies and the voter approved November 2001 bond referendum. Attachment 1 of this abstract, Chronology of Elementary #9, outlines the project's activity to date. It is important to note that, per an agreement between CHCCS and the Town of Chapel Hill, the project bid includes upgrading the originally planned multi- purpose room to a community gymnasium. The Town of Chapel Hill has agreed to provide the District with a total of $750,000 to offset costs associated with the upgrade. In addition, the bid includes construction of playing fields associated with the Town's planned park at Meadowmont. Per an agreement between CHCCS, the Town and East West Partners (developers of Meadowmont), East West Partners plan to provide $824,052 to offset the cost of the playing fields. As with all new construction projects, there are many uncertainties. For example, there is a potential that as site work begins, contractors may encounter large rock beds that require a significant amount of work over and above the current contract price. As outlined in the School Facilities Planning and Funding Policy, the final phase of level 2 projects is the Final Accounting Phase. At the close of the project, this phase will reconcile actual project expenditures with the approved budget and provide the Board with a "final accounting" of the project. If a project balance exists at the completion of the Elementary#9 project, CHCCS has indicated that they would like the Commissioners to consider establishing a Future Projects Planning Fund. That mechanism would allow project balances remaining after the final accounting phase to be used for preliminary planning for other high priority approved Capital Investment Plan projects. It would also permit the District to proceed on schedule with the project prior to total project funding being identified and secured. RECOMMENDATION (S): The Manager recommends that the Board of County Commissioners receive the project update for CHCCS Elementary School #9 and adopt the attached Elementary School #9 Construction Capital Project Ordinance. . 5 THIS PAGE INTENTIONALLY LEFT BLANK. 03/14/02 6 Attachment 1. Chronology of CHCCS Elementary#9 Located at Meadowmont • Concept/Pre-Planning Phase December 2000 - The Commissioners appropriated $132,184 in funding for the initial phase, Concept/Pre-Planning, for this project. Funding for this phase came from savings in the Smith Middle School construction project. The appropriation provided funding for conceptual drawings (schematics) and preliminary permit fees (for the Town of Chapel Hill) for the school. • Planning Phase February 7, 2001 — Per the Commissioner approved policy, the Board of County Commissioners should appoint a representative to work directly with the Board of Education as it plans and constructs a new facility. The Board appointed Chair Halkiotis as its Commissioner.representative. March 6, 2001 - CHCCS staff presented preliminary plans to the Board of Commissioners for review. Those plans adhered to the County's Elementary School Construction Standards and included a multipurpose room instead of a gymnasium. At that time, the Commissioners appropriated an additional $440,462 for the Planning Phase of the project. Funding for this phase came from Smith Middle School construction project savings ($247,816) and an appropriation of$192,462 from the School Capital Project Fund Balance. Specifically, this phase entailed: • Refining the schematic plans; • Developing construction and site work details; • Producing project drawings that fix the building size and characteristics (including building elevations, exterior finishes, and mechanical, electrical and plumbing systems). During the Town of Chapel Hill approval process last spring, the Chapel Hill Town Council requested that the CHCCS Board of Education include a full-size community gymnasium instead of the multipurpose room. Estimated costs associated with this upgrade are $750,000. July 2001 - The CHCCS Board of Education approved the concept of including ,the gym in the design plans providing that the District and the Town could agree on how to compensate CHCCS for the additional construction costs. September 24, 2001 - During the joint meeting of the two school boards and the Commissioners, CHCCS staff presented revised plans for Elementary #9 that included the gymnasium. At that time, the Town and Board of Education had not agreed on the specifics of how Chapel Hill would compensate the district for the gymnasium cost. One proposal included the Town re-instating its financial 7 support of school resource officers and offering the district a joint-use agreement for the proposed Homestead Center aquatic center. Under that particular plan, the Town would have scheduled additional time for the district's high school swim teams. After reviewing the plans, the Commissioners asked the CHCCS Board of Education to request full funding of the gym construction cost from the Town of Chapel Hill in lieu of accepting the proposal of dedicated swim time. Since that time, the Town Council has agreed to reimburse the district in three annual installments of$238,000 beginning in fiscal year 2002-03 for a total of $714,000. In addition, the Town has agreed to credit the school system $36,000 for plan review fees. November 6, 2001 -Voters approved the November 2001 bond referendum that included $12.8 million to complete Elementary#9. November 26, 2001 The Town of Chapel Hill approved a Special Use Permit for Elementary#9. December 11, 2001 — County Commissioners appropriate $235,000 of recently approved bond funds to cover three project components — construction bidding, pre-grading of the site and project contingency. Mullin, Director of Facilities Management MEMORANDUM TO: Steve Scroggs FROM: Bill Mullin SUBJECT: Elementary School #9 Construction Bids DATE: February 15, 2002 On February 7, 2002, bids were opened for the construction of Elementary School #9. The project received excellent participation from contractors. Competitive bids were received from ten general contractors, six plumbing contractors, eight mechanical companies, eight electric companies, and five companies that bid on the fire protection sprinkler system. State law permits projects of this scope to be bid as a single and multi prime project and Elementary School #9 was bid in both formats. The bid documents were prepared with alternates. This structure offers flexibility in awarding contracts within the project budget and provides a mechanism for selecting desired upgrades. Additionally, alternates identify the cost associated with speck aspects of work. The attached Bid Tabulation prepared by the architects lists each contractor's submitted costs. The low single prime contractor bid submitted by The Resolute Building Co. in the amount of$10,830,000 is recommended. Accepting 12 of the 14 alternates is also recommended. Alternate #2, specifying a contractor to perform door and hardware work, is not recommended due to cost. Alternate#10, an ice storage system, does not meet the life cycle cost analysis criteria established prior to the bid and is not economically viable. The total cost of the recommended bid with 12 altemates is $10,921,250 and is within budget. 10 As stated, the project was also bid as a multi prime project. The comparative cost of the multi prime bids is $10,869,500. The single prime contract has a small premium of $51,750. This represents less than half a percent higher cost but is outweighed by the coordination and control benefits associated with a single prime project. The architects and Facilities Management believe that a single contractor will bring value to the process by simplifying decision-making and response time. As we work with the Town of Chapel Hill and the developers, East West Partners, these attributes will be very beneficial in controlling costs and maintaining schedule. The construction bid submitted by The Resolute Building Co. includes 11.5% minority participation. This represents a high minority participation rate compared to other major projects bid by the district in recent years. Additionally, the contractor is responsible to provide documentation regarding the efforts used to solicit minority contractors and the actual contractors who will participate in the work. The project bid includes upgrades and work that will be reimbursed by the Town of Chapel Hill and East West Partners. The Town will provide $750,000 to upgrade the multi purpose room to a community gymnasium and East West Partners is providing $824,052 to construct the Town play fields and associated amenities. This work is included in the recommended contract with The Resolute Building Co. The number of participating contractors produced a competitive bid. The base bid cost for Elementary School #9, adjusted to reflect the reimbursements, is $101.74 per square foot. The building is 35% more energy efficient than building code and includes features such as daylighting, solar domestic hot water, photovoltaic panels, and rainwater recovery system. Another of the school's features, that is not normally included in school construction, is the-fire safety sprinkler system. The project design team and Facilities Management recommend acceptance of the bid from The Resolute Building Co. with alternates totaling $10,921,250. Section 1. The project authorized provides funds to construct Elementary School #9 for the Chapel Hill Carrboro City Schools. Funding for the project comes from savings from the Smith Middle School Construction Project, an appropriation from the School Capital Project Fund Balance, and proceeds from the November 2001 voter approved bond referenda. Section 2. The officers of the County are hereby directed to proceed with the project within the budget contained herein. Section 3.
