PURPOSE: To approve an agreement between Orange County and the State of North
Carolina to share GIS data.
BACKGROUND: The County has developed numerous parcel maps and databases on its
Geographic Information System (GIS). The State desires to have an agreement with the
County to put the County's maps and data in the public domain for free access on a State
website. In return, the County will be able to obtain State maps and databases free from the
State's GIS Office (Center for Geographic Information and Analysis, CGIA) and technical
support for disseminating and metadata creation. Metadata is data about data (i.e., when the
database was created, who created the database, and its accuracy). The County proposes in
the Agreement to restrict the re-sale of its GIS maps and databases for commercial purposes.
FINANCIAL IMPACT: The County will be providing GIS mapping and information to the State
once each year. Although the State will be providing free access to the data, the loss in
revenue to the County will be minimal, definitely less than $500.00 per year, since most users of
the GIS data require up-to-date, time-sensitive information that will only be available from the
County. Regarding the benefit of obtaining free access to maps and databases from the State's
GIS Office, the savings for the County will total approximately $200.00 per year based on past
annual GIS data purchasing activities.
RECOMMENDATION(S): The Manager recommends that the Board 1) approve the
-Agreement between the County and the State of North Carolina on sharing GIS maps and data
and 2) authorize the Chair to sign the Agreement subject to final review by staff and the County
Attorney.

To
ENABLE AND ADVANCE THE SHARING OF STRATEGIC GEOSPATIAL DATA
RESOURCES AND ASSOCIATED DOCUMENTATION BETWEEN THE AGENCIES
AND AMONG THEIR DATA USERS
WHEREAS, geospatial base map and other strategic thematic data about North Carolina are currently
produced and maintained by numerous state,federal and local government organizations;and
WHEREAS, representatives of local, regional, and statewide public programs and private citizens now
expect up-to-date and accurate geospatial information to be readily available;and
WHEREAS, geographic information system software tools and maps on the Internet are increasingly vital
to public and private business processes;and
WHEREAS,numerous business processes require the integration of geospatial data from disparate sources
to support display and analysis using the Internet and GIS, and include but are not limited to examples such
as, tax mapping, flood insurance rate mapping, census mapping, hazard mitigation, highway design, open
space/farm preservation,and water quality protection,among others; and
WHEREAS,data sharing among primary data sources is recognized as the key to the success and efficiency
of many business applications that require geospatial data;and
WHEREAS, primary government data sources of geospatial data in North Carolina are municipalities,
counties,lead regional organizations,state and federal agencies; and
WHEREAS,user demand for access and regional integration of base map and thematic data is expected to
increase and thus will further challenge government organizations to develop effective policies and
technical methods to efficiently share geospatial data and associated documentation;and
WHEREAS, the "Strategic Plan for Geographic Information Coordination for North Carolina," adopted in
1994 by the Geographic Information Coordinating Council, calls for the development of a statewide
corporate geographic database that includes geospatial data that are produced, distributed, used, and
maintained by local,regional,state,and federal agencies and other organizations in the state; and
WHEREAS, the statewide corporate geographic database has been implemented through numerous
partnerships and is administered in the public domain by CGIA;and

DATA AVAILABLE FROM CGIA
Data available from CGIA is administered as part of the North Carolina Corporate
Geographic Database (CGDB). The CGDB contains over 100 statewide layers of
geospatial data that are developed and/or maintained on varying schedules. The
CGDB is jointly supported by numerous organizations by either cost-sharing, in-kind
services, service/maintenance agreements, or direct contributions.
All data contained in the CGDB is part of the public domain.
The North Carolina Geographic Information Coordinating Council, a statewide multi-
jurisdictional policy board, guides the development of the CGDB.

CGIA_ACCESS/TRANSFER MECHANISM:
The preferred mechanism to access data from CGIA is through the Internet. At his
time, the number of layers available at the CGIA Internet Web Site
(www.ncmapnet.com) is under 15 but is expected to grow as CGIA places more
emphasis on its Internet Mapping capacities. Unless otherwise noted at the time
of request, CGIA responses for off-line transfers will be handled in a reasonable
period of time, subject to the availability of staff resources.

WHEREAS,CGIA's primary focus for`NO FEE' access to geospatial data is the Internet;and
WHEREAS, in order to fulfill the goals for a statewide corporate geographic database and to serve the
growing geospatial data user community in North Carolina with better maps and data,effective data sharing
partnerships must be in place;
NOW THEREFORE,the UNDERSIGNED,
AGREE that geospatial data sharing between ORANGE COUNTY,NC and CGIA is an important business
practice that furthers shared agency goals for effective use of public information; and
AGREE to identify a primary point of contact for data sharing in ATTACHMENT; and
AGREE to identify sharable data layers,associated documentation(metadata),transfer formats,transfer
media, schedules for transfer,and disclaimers(if any)in ATTACHMENT; and
AGREE to waive agency fees,if any, for data sharing between the agencies; and
AGREE that data shared under this agreement may be further redistributed with applicable metadata by
either agency WITHOUT FEES in the public domain and without restriction,unless otherwise noted
herein* and/or unless otherwise subject to public laws of governing authorities; and
CGIA further AGREES to develop Internet capabilities as the primary mechanism for NO FEE access to
the corporate geographic database, including community data shared under this agreement; and
CGIA further AGREES to provide training and assistance,if requested and when resources are available,
to ORANGE COUNTY,NC in the area of metadata creation and dissemination as part of the North
Carolina Geographic Data Clearinghouse.
*The paragraphs above and below not withstanding,no commericial sale or re-sale of Orange County
map coverage or data provided to the State by this Agreement is allowed without written permission of
the County or the payment of fees to the County as established in its product fee schedule.
This agreement is effective upon signature by the authorities, and is valid until rescinded. It may be
amended by mutual agreement or rescinded by either agency at any time during the effective period with 60
days written notice.
