WITNESSETH: THAT WHEREAS, the County and Provider entered into a contract dated March 18, 2022, (hereinafter the "Original Agreement"), for the provision of services for Gravelly Hill Middle School — Stormwater Wetland Conversion, with an internal designation of 2022-118; and WHEREAS, the County and Provider desire to amend the Original Agreement while keeping in effect all terms and conditions of the Original Agreement not inconsistent with the terms and conditions set forth below. NOW THEREFORE, for and in consideration of the mutual covenants and agreements made herein, the parties agree to amend the Original Agreement as follows: 1. The Scope of Work and Basic Services shall be expanded to include all services described in Attachment 2, "Additional Services(Tasks 5, 6, and 7)." 2. The compensation for the additional work included in this Amendment shall be TWO THOUSAND DOLLARS ($2,000.00) for completion of Task 5, SIX THOUSAND FIVE HUNDRED DOLLARS ($6,500.00) for completion of Task 6, and FOUR THOUSAND FIVE HUNDRED DOLLARS ($4,500.00) for completion of Task 7. Article 5a of the Original Agreement is amended to reflect a maximum payable not-to-exceed amount of THIRTY SEVEN THOUSAND FIVE HUNDRED SIXTY FIVE DOLLARS ($37,565.00). 3. Notwithstanding the payment terms in Article 5 of the Original Agreement,the additional sums associated with the individual completions of Task 5,Task 6, and Task 7 may become due and payable as individual lump sum payments in direct proportion to satisfactory services performed and work accomplished for 100% completion of Task 5,Task 6, and Task 7. These additional services shall have a Milestone Date of June 30, 2022 for 100%completion of Task 5, Task 6, and Task 7. 4. Except for the changes made herein,the Original Agreement shall remain in full force and effect to the extent it is not inconsistent with this Amendment. In the event there is a conflict between the terms of the Original Agreement and the terms of this Amendment,this Amendment shall control. We appreciate being selected for the project and look forward to working with Orange County on this project. This proposal for an addendum to the current scope of work includes providing additional survey for future improvements including walkways and observation platforms and to prepare a conceptual exhibit of the proposed completed wetland to depict the future improvements for school use. The purpose of the project is to provide a design and construct a stormwater wetland that meets state and local guidelines for stormwater management to provide water quality and quantity benefits to the County while taking the opportunity to educate students and the public about stormwater issues and wetland benefits in the process, both during and post construction. The following tasks are proposed in support of the project objectives as an addition to the current scope. Task 5—Additional Survey 1. Perform field survey of areas provided in Figure 1 to further define the project area. a. Field survey includes: i. Preparation of a field run topographical survey, specifically: 1. locations of visible improvements 2. storm pipe alignments with invert data (including one structure outside of limits); and 3. surface indications of subsurface utilities ii. Contouring at a 1' interval. iii. Topographic limits will include the area shown. iv. Deliverable will be a CAD and PDF file to the County in NCSPF NAD 83 horizontal and NAVD88 vertical. Task5............................................................................................................................................$2,000 Task 6—Conceptual Planning& Exhibit 1. Develop a conceptual layout of the site that includes future improvements as determined by the County with support from Timmons. 2. Incorporate wetland design (deep pools, shallow land,etc) into conceptual layout. 3. Design elements are expected to include: a. Walkway around the perimeter of the wetland b. Viewing area north of the wetland in an open area near the field c. ADA accessible ramps to viewing area d. Walkway/bridge across the wetland between the forebays and main water body. 4. Present up to (2)two draft concepts to the client for review. Draft concepts may include precedent images to convey design intent. 5. Provide final concept plan on a 36"x 48" color figure mounted on fiberboard. 6. Meet with the client to present the final concept Task6................................................................................................................................$6,500 Task 7—Geotechnical Analysis Our proposed scope of geotechnical services consists of performing shallow hand auger borings and preparation of a geotechnical exploration report. Field Exploration The field exploration will consist of the following: • A geotechnical professional will perform a site reconnaissance and locate exploration locations using GPS equipment. • Contact NC 811 to mark existing public underground utilities near boring locations. • Perform Three shallow hand auger borings to a depth of 4 to 6 feet. Boring depths are referenced to the existing ground surface. Borings will be performed to indicated depths, or hand auger refusal, whichever occurs first. • Within hand auger borings, samples will be classified in the field. Upon completion of borings, borehole water levels will be recorded, and the boreholes will be backfilled with drill cuttings up to the original ground surface.Soil samples will be returned to our office for laboratory testing.All excess spoils will be disposed of on site. Laboratory Testing We will perform laboratory testing on representative soil samples for the purpose of classifying the soils and estimating geotechnical engineering properties. We plan to perform Atterberg limits, grain size analyses, and natural moisture contents testing. Geotechnical Exploration Report A geotechnical exploration report will be prepared based on performed borings, laboratory testing, and our engineering analysis.The report will include the following: • Site plan showing boring locations of the exploration. • Description of the exploration sampling methods as well as hand auger boring logs. • Water levels encountered in the borings. • Depths to hand auger refusal, if encountered in the borings. • Laboratory test results. Design and Surveying Fees Timmons Group proposes to complete the tasks outlined above for a Lump Sum Fee of$13,000. Exclusions The following items are excluded from the proposed services herein. 1. Establishing boundary lines and locating existing easements for survey tasks 2. Survey of areas outside of boundary provided on Figure 1. Assumptions The geotechnical scope assumes the following conditions. If conditions vary from those assumed below adjustments to the fee may be required: • Based on preliminary observations of aerial imagery, large portions of the site appear to clear of trees. No clearing fees are included in this scope. • The site will be accessible by a two-man crew with hand tools. If difficult access conditions are encountered to access boring locations, additional fees will apply. • Work can be performed during standard work hours(8am to 5pm) Monday through Friday. • We assume the client will coordinate site access through any locked gates. • The client will coordinate location of any private underground utilities that are currently located on site.
