PURPOSE:
1. To approve the Capital Project Ordinance authorizing the expenditure of $275.000 in
housing bond funding to Residential Services. Inc.:
2. To authorize the execution of a Development Agreement with Residential Services, Inc.
on behalf of the Orange County HOME Consortium for the development of the
proposed Cominuing Care Center by the County Manager upon the approval of the
County Attorney.
BACKGROUND: Residential Services, Inc. (RSI) proposes to develop a Continuing Care
Center for elderly persons with developments) disrbili5es. The Center will be located on
Mourn Herman Church Road and will contain 15 units for persons with developmental
disabilities. All of the individuals will be Medicaid eligible and have incomes well below 30% of
Orange County'a median income level. The Orange County Boat of Adjustment approved a
Special Use Permit for this project on July 9, 2001. A copy of the minutes of their meeting is
attached to this abstract.
In May 2081, 1 requested $385,419 in housing bond funding to assist wit the and
development and construction costs. In June 2001, the I awarded $275,000 in bond
funds to the project. In order to facilitate this expenditure, the BOCC must approve a Capital
Project Ordinance appropriating funds to the project. A Capital Pmject Ordinance has been
- prepared no accomplish this task and Is included with this abstract for the Boat's
consideration.
Additionally, in May 2001, He Orange County HOME Consortium awarded$100,000 in HOME
funds to this project as well
A Development Agreement must be executed between the County and Residential Services,
Inc. that secures and governs the bond funds and the HOME Program funding. A

Development Agreement has been developed by County staff for review by the Board and the
County Attorney and is attached.
FINANCIAL IMPACT: In November 1997, voters approved a $1.$ million Affordable
Housing Bond. The appropriation to RSI bangs the total appropriated 1997 bond funds to
$1,365,000 leaving $435,000 available for future appropriations to other agencies.
Approximately $100,000 of FV 2001 HOME Program funding would be used to cover the
additional funds naweed by RSI to complete the Continuing Care Center.
RECOMMENDATION$):
The Manager recommends the fallowing:
1. Approval of the Capital Project Ordinance authanzing the expenditure of $275,000 in
housing bond funding to Residential Services, Inc.;
2. Authorization of the execution of a Development Agreement with Residential Services,
Inc.on behalf of the Orange County HOME Consortium for the development of the
proposed Continuing Cam Center by tthe County Manager upon the approval of the
County Attorney.
