PURPOSE: To amend the existing contract with Safety-KIrs n (TS), Inc. to extend the provision
of household hazardous waste collection services through June 30, 2002.
BACKGROUND: The Household Hazardous Waste (HHW) collection program, established in
1994 as a cooperative program between local governments, currently collects hazardous waste
from residents of Chathem. Durham. Orange and Wake counties. This contract was originally
warded to Lallaw Environmental Services (TS), Inc. by competitive bid in 1994 and extended
by the Town of Chapel Hill for 3 additional years in 1997. On October 17, 2000 the contract
was modi0ed to remove Chapel Hill as a parry to the contract and to extend the agreement
through the 2001 fiscal year. At the August 14, 2001 meeting the BOCC again extended the
agreement, from July 12001, through November 2001. This extension has proven to be
insufficient to complete the process of acquiring a new vendor.
The Department of Solid Waste Management has issued a Request for Proposal (RFP) for the
HHW Program, and asks for the current contract with Safety-Kleen to be extended through the
end of June in order to have enough time to solicit, receive and review the submitted proposals,
select a vendor and negotiate a contract. In order to be able to proceed with the scheduled
March 2 HHW event, the Safety-Kleen contract must be extended. It will not be possible to
have anew vendor in place to service the Marchand April events. Alternatively,scheduled
HHW events could be cancelled until anew vendor is chosen and a new contract is executed.
The Amendment allows Orange County to terminate the Contract within 10 days in the event a
new vendor can be chosen and a new contract can be in place before the end of this Fiscal
Year. There will as no change in the price for services or any other conditions of the
agreement, except for the term extension.
FINANCIAL IMPACT: Full budget for the HHW Collection Program has been approved by
5000 for services through June 2002. The protected cost of services to be Wormed under
the extended contract is appmximetely $50,000.
RECOMMENDATION(S): The Manager recommends that the Board approve the Amendment
to the contract with Safety-Kleen (TS), Inc. and authorize the Chair to sign the adached
Amendment subject to final review by Staff and the County Attorney.
