HomeMy WebLinkAbout2022-114-E-Plannng-Schnabel Engineering South-Contract Amendment #1 – Lake Orange Gate and Spillway Channel RepairsRevised 06/21 NORTH CAROLINA CONTRACT AMENDMENT #1 ORANGE COUNTY THIS CONTRACT AMENDMENT (“Amendment”) is made and entered into this 8th day of February, 2022 by and between ORANGE COUNTY (hereinafter referred to as “County”) and Schnabel Engineering South, P.C. (hereinafter referred to as “Provider”). WITNESSETH: THAT WHEREAS, the County and Provider entered into a contract dated August 30, 2020, (hereinafter the “Original Agreement”), for the provision of services for Lake Orange Gate and Spillway Channel Repairs, with an internal designation of 2020-561; and WHEREAS, the County and Provider desire to amend the Original Agreement while keeping in effect all terms and conditions of the Original Agreement not inconsistent with the terms and conditions set forth below. NOW THEREFORE, for and in consideration of the mutual covenants and agreements made herein, the parties agree to amend the Original Agreement as follows: 1. The Scope of Work and Basic Services shall be expanded to include all services described in Attachment A, “Task 6 (Additional Services)”. 2. The Term of the Original Agreement in Section 4.a. of the Original Agreement shall be revised to be from August 20, 2020 to July 31, 2022. 3. The compensation for the additional work included in this Amendment shall be ELEVEN THOUSAND DOLLARS ($11,000.00) for completion of Task 6 (Additional Services). Article 5 of the Original Agreement is amended to reflect a maximum payable not-to-exceed amount of FIFTY THOUSAND ONE HUNDRED DOLLARS ($50,100.00). 4. Notwithstanding the payment terms in Section 5.a for the Basic Services of the Original Agreement, the additional sum associated with the completion of Task 6 (Additional Services) may become due and payable as single lump sum payment in direct proportion to satisfactory services performed and work accomplished for 100% completion of Task 6 (Additional Services). These additional services shall have a Milestone Date of April 5, 2022 for 100% completion of Task 6 (Additional Services). 5. Except for the changes made herein, the Original Agreement shall remain in full force and effect to the extent it is not inconsistent with this Amendment. In the event there is a conflict between the terms of the Original Agreement and the terms of this Amendment, this Amendment shall control. We prepared this proposal in response to our phone conversations on December 11, 2020 and January 7, 2021, and based on your requested modifications via email on January 21, 2022. Our proposed scope of services, anticipated schedule, and basis of compensation are described below. PROJECT DESCRIPTION Lake Orange Dam (ORANG-005) is located in Cedar Grove, North Carolina and impounds the East Fork of the Eno River. The dam and reservoir is owned by Orange County and is used for recreation and potentially water supply. According to the North Carolina Department of Environmental Quality (NCDEQ) Dam Safety inventory, the dam was constructed in 1969. The dam is an approximately 30-foot high, 1,100-foot long earthen embankment that impounds an approximately 140-acre lake at normal pool and has a maximum storage capacity of approximately 1,640 acre-feet. The dam is regulated by NCDEQ Dam Safety as a medium-size, high hazard structure. Flows from the reservoir are controlled with an intake tower structure with four sluice gates at various elevations, a fifth sluice gate is used to regulate flow from the intake tower into the outlet conduit. The auxiliary spillway is a concrete side-channel style trapezoidal chute spillway, located on the left abutment. The control section of the auxiliary spillway is regulated by removable flashboards. Schnabel entered into an agreement with Orange County on August 25, 2020 to inspect the concrete auxiliary spillway and coordinate with a commercial diver (In-Water Services, Inc. (In-Water)) contracted by Orange County to inspect the concrete intake tower. During the intake tower dive inspection, and summarized in a Dive Inspection Memo by In-Water dated November 30, 2020, the intake tower was observed to be in generally poor condition with concrete spalls up to 6-inches in depth in the 12-inch thick wall sections with no visible rebar; and exposed rebar in the interior of the intake tower. This proposal includes additional inspections and evaluations of the intake tower to help obtain a better understanding of its condition prior to moving forward with sluice gate replacement. OBJECTIVE AND SCOPE OF SERVICES Our existing scope of services are organized into five tasks and they are described in our existing agreement. The proposed additional services are presented below as Task 6. The objective of the Task 6 services is to gather additional information on the intake tower condition. Task 6 services are organized into two subtasks and will be performed under the responsible charge of a Professional Engineer licensed in the state of North Carolina. Task 6.1 – Additional Dive Inspection Observation It is our understanding that Orange County plans to contract with In-Water to bring them back onsite to further observe the tower. A Schnabel representative will coordinate with and direct the In-Water diver to gather additional observations and measurements of the intake tower and low level outlet structure. We have assumed this would include a single day on-site with a memo summarizing the observations. Task 6.2 – GPR to Locate Reinforcing Steel in the Intake Tower Since no steel reinforcement (rebar) was observed in the concrete spalls on the exterior of the intake tower, Schnabel recommends utilizing ground penetrating radar (GPR) to locate rebar in the intake tower walls. This work will consist of two Schnabel representatives accessing the intake tower via a boat launched from the upstream slope of the embankment to visually inspect the above-water portions of the intake tower and locate the rebar using GPR when the reservoir is lowered to for other repairs to the dam. The objective of the GPR survey will be to identify the typical pattern of rebar within the intake tower concrete walls including the configuration, orientation, spacing, and approximate depth of rebar within the wall. Schnabel personnel plans to perform the GPR survey at one location on each of the four exterior tower walls for a total of four locations, but will adjust the approach based on observations in the field. GPR data will be collected on a 2 ft by 2ft grid at each location. We have included as Attachment 1 a data sheet with additional information on the use of GPR to evaluate concrete reinforcing steel. We will mark the locations on the concrete surface, will photo document our markings. The effectiveness of GPR is dependent on many factors, such as cultural features, concrete age, concrete materials, moisture contents, additives and overlays, and metallic objects on top of and within the concrete. Results may vary depending on actual site conditions; from our understanding of the site conditions for this project, the GPR method is well suited for the objective here. If a reinforcing bar is located directly above and parallel to a deeper reinforcing bar, the deeper bar will be shadowed by the top bar and may not be observable in the GPR data. While we do not anticipate metallic interference being an issue for identifying the rebar within the intake walls and measuring wall thickness, it is important to note that GPR signal does not penetrate metallic objects, such as sheet metal or wire mesh reinforcing with spacing less than about 2 inches. Smaller metallic objects, such as individual pipes or reinforcing bars, reflect part of the GPR signal and may allow the remainder of the GPR signal to pass around the object, penetrating deeper into the subsurface. The resolution of the GPR is such that we expect to identify the depth to the reinforcing steel bars and slab thickness to within ¼ to ½ inch of their actual depth. Upon completion of the GPR survey we will prepare a memo summarizing the GPR survey procedures and results. Based on the rebar configuration observed we will include in the memo a qualitative assessment of the structural adequacy of the intake tower or provide recommendations on structural analyses that could be done to confirm the adequacy of the intake tower to withstand hydraulic and gate loads. It is our understanding that it is likely funds associated with our current contract could be re- allocated to perform these analyses. LIMITATIONS  Progress of on-site work may be dependent upon weather and reservoir conditions, or other factors beyond our control.  We may not be able to identify all the reinforcing steel. In particular, steel at the edges of intake tower may not be under the path of the GPR antenna sufficiently to detect it. In addition, the ability to see steel at depth will be dependent on which frequency antenna we can use (based on available space) and the amount the GPR signal attenuates in the concrete.  The effectiveness of the proposed geophysical methods is dependent on many environmental factors; results from these methods may vary depending on actual site conditions. EXCLUSIONS Services not specifically identified above are not included in the scope of services under this agreement. The following services are not included in our proposed scope, but we can be provide a proposal for these services upon request:  Hydrologic and hydraulic analyses of the dam;  Structural or stability analyses of the intake tower or auxiliary spillway;  Preparation of breach inundation mapping and an Emergency Action Plan (EAP);  Preparation of an Operation and Maintenance (O&M) Manual;  Environmental studies or permitting;  Surveys; and  Attendance at meetings. SCHEDULE The work detailed herein will be performed at a time agreeable to both parties and when the reservoir level and weather conditions will allow. FEES Our lump sum fee for the Task 6 services described herein is $11,000. The fees for work requested beyond the scope of services included herein will be based on our current unit prices at the time the work is authorized or a negotiated lump sum. Services will be billed for the lump sum fee upon completion of scope of services detailed herein and delivery of the deliverable. Instruments also become smaller and smaller as computersalso shrink in size, making GPR very portable and feasible to collect data in difficult to reach locations.GPR consists of an antenna, a control unit, and a computer data recorder and GUI. Data is collected by moving theantenna across the concrete surface. Radar signals from the antenna reflect off of reinforcing steel and return tothe antenna where they are received and recorded. The information can then be processed and displayed either asa cross-sectional depth profile or combined to create a three dimensional block of data that can be viewed in plan.The figure to the bottom right is an example profile of GPR data and the figure below is a horizontal slice through a3D block of data shown in plan view.Schnabel Geophysicists obtained the data below, shown in plan view, for quality control on precast elements toconfirm that reinforcing steel was placed properly and had the specified minimum cover.
