BACKGROUND: LocaGgn: Northwest Intersection of St. Mary's Road (SR1002) and Baldwin Road (SR 1554): Property is identified on Orange County Tax Records as Eno, Township, Map 14, Lots 21 and 21A. Bequest: Applicant requests approval to renew a Special Use Permit, Class A to operate a gilt and garden shop/greenhouse under Article 8.8.24 of the Orange County Zoning Ordinance for the broad category of Historic Sites Non-Residential Rausa/Mixed Use. There is a Special Use Permit, Class A originally approved by Board of County Commissioners on February 12, 1996 in effect on the property now. The 1996 approved permit, by hindrance guidelines, is valid for six (8) years and will expire on February 12, 2002. The Special Use Permit may be renewed by the Board of Commissioners after receiving a report from the Planning Department that the use is, and has been continuously-since it was issued, in compliance with the previsions of the Special Use Permit The Special Use Permit, Class A was recorded on August 23, 1996 at Book 15D3, Page 367. Proper Owner: Laura G. Baldwin Bite: 58.24± acres Comprehensive Land Use Classification: Agricultural Residential Area Adjacent Propertv Zoni AR (Agricultural Residential) and PD-H-R2 (Churton Grove Subdivision) to the west Current Conditions . The business is located in a former farm building on a historic site known as Sunnysitle. • The farm building is approximately 200 feet from the Baldwin Road right-&-way. • Two greenhouses are located behind the building. • The site has numerous hardwood trees on the site. • The property is not located within a Watershed Protection Overlay District. . Nancy Hill Creek (aka Shrouds Creek) foes through the southwest comer of the property on its way to the Eno River. • There is an outdoor material stockpile/storage area near the northern end of the property shown on the site plan. Future Repudiate As a pan of the application, the applicant has requested a separation of the business property from the historic residence. As indicated at the Public Heaing, this land use is a reuse of an historic property. Without the historic property zoning designation for the entire tract, Reba and Roses would not be permitted to operate under the current ordinance. Staff is currently working on a reclassification of these types of quasi- farrnlretail uses to determine the zoning perimeters and site considerations under which uses such as these should operate. A report is forthcoming this spring from a worogroup composed of the Economic Development Director, Agricultural Extension Director, Planning Director, Zoning Officer and Agricultural Economic Development Specialist. Also, in the attached letter, the applicant has identified projected, future structures and improvements that are being ormomplated but are not shown on the site plan, Staff does not recommend approval of any structures not shown on the site plan. On the northern pad of the property, beyond the onchaMS, there is an area currently being used for outdoor storage and stockpiling of landscape materials (i. a. mulch, landscape debris, etc). This area Is subject to the bufferyard requirements of the zoning ordinance which is a 75-foot buffer composed of predominantly (at least ]5%) evergreen vegetation that is opaque to a height of at least thirty (30) feet at full growth. The buffer will be approximately 200 feet long on each aide of fire stockpiled area (see page 33). The purpose is to create a visual screen between this stockpile and existing residential neighborhoods across the street as a continuing 'good neighbor' policy. The Orange County Fire Marshall inspected the property during the last week of October and found that it was in compliance with the N.C. Fire Prevention Code. The Inspections Division of the Planning and Inspections Department visited the site on November 2, 2001, and the report from that visit is attached. Development Process Schedule and Acton • Public Hearing held on November 26, 2001 • Special Use petition refered to the Planning Board fora recommendation, tc be returned to the Board of County Commissioners no later than February 5; 2002: • Leads Baldwin spoke in favor of the proposal at the Public Heading. Ms. Baldwin indicated her concern about having to obtain approval every 6 years. As indicated previously under Future Requests, staff is currently working on e reclassification to determine the zoning parameters under which uses such as these should operate. Several others spoke in favor of the proposal and no one spoke in opposition. (Draft minutes are attached on page 36.) • Planning Boartl: • Unanimously recommended renewal of the Special Use Permit at its December 5, 2001 meeting with the proposed conditions. (Draft minutes are attached on page 38.) • Some members did not believe that screening of the outdoor storage/stockpiling area was necessary due to the nature of the business. Board of County Commissioners: • BOCC to consider all evidence presented at joint public hearing and any new evidence that was considered by the Planning Boartl in making Its recommendation. Option 1: Clone the Public Heading and Approve the renewal of the Special Use Permit with the attached conditions. Option 2: Close the Public Hearing and deny the renewal of the Special Use Permit. Option 3: Leave the Public Hearing open and table decision to fuWre meeting date. FINANCIAL IMPACT: There is no direct public financial impact with this decision item. Craig Benedict said that there are a lot of state and federal regulations that will make this type of f cality meet higher environmental standards. Questions from the Planning Board In answer to a question from Howard McAdams, Craig Benedict mid that the new standards would apply to all of the land that is being requested (1.09 acres). Pan of the program of re- instituting the EC 5 use is to have the use of the original site plus Me 100% that was requested to be underihe new regulations. Bob Strayhom asked about the setback for the original site. Craig Benedict said that the setbacks were 40 feet in the front yam and 20 feet around the perimeter areas. There are some certain buffer requirements of landscaping in the EC 5. Commissioner Gordon asked It the 10% Is needed to meet the higher standards and if they do not get it, what would happen. Craig Benedict said that having the additional 10% would allow the applicant to have more impervious area. If they tlo not pet the 10%, there might have to be encumbrance of other properties so that the Impervious area could be shifted. Public Commend Alois Callemyn was representing the applicant He asked if the County Commissioners got the rezoning request in writing. He said [hat Ben Lloyd is a farmer and was raised In this community. Since 1922 them has not been a lot sold on this lend other than to a farmer. Obviously this land cannot ba used rorfartning. He appeadides hisworking relationship with the Planning staff . He said thatthe site would be held tor a higher standard Nan In 1987 when Mr. Lloyd applied for the building permit With regard to the 10%, there will be buffers there that will not be used. They are requesting the 10% because the property has right-of-way on three sides. Regarding the 20- foot elevation, he does not believe the elevation will have an impact on the flow of water. He said that they have contacted all the surrounding owners and they have all given Mr. Lloyd their verbal approval of this site. VOTE: UNANIMOUS 2. Renewal of Special Use Permi Class A Reba and Roses, Inc. requested to renew a Stakes Use Pound, Class A for property zoned Agricultural Residential. The Clerk swore in 5 people -Jim Bo trlcke, Jaki Shelton Greene, Laura Baldwin, Craig Benedict and Annie Hassell. Craig Benedict said thata canceled abstract was distributed this evening. The Special Use Permit for this property expires on February 121' so It Is Important that the County Commissioners consider this renewal before that time. The recommendation has been revised to meet this timeline. Craig Benedict made the presentation. This is an existing special use permit, class A, which requires Boom review and comment every six years. In 1996, it was originally approved and there was a site plan for a retail shop to sell mass and garden areas and a gift shop. He referred to page 45, which is the staff analysis. There was anomer greenhouse added to the property over the years, and if the Boats so chooses to renew this special use permit, the applicant has staled that they will obtain the necessary building permits to be sure the structure meek the building code. The staff Is suggesting that all structures that have not been permitted be permitted appropriately. There was one additional condition regarding a pedestrian scenic walkway along Nanry Hill Creek because of its proximity to Chardon Grove. He suggested that this condition not be included at this time. He feels that there can be furtber discussion with adjacent property owners to evaluate the continuation of public access Hails. If at some point in the future Here is a need for these pedestrian walkways. It con be considered at that time. Staff is recommending that the similar conditions imposed In 1996 be re-instituted for this property and that the condition regarding the pedestrian walkway be deleted from the recommendation and that this item be forwarded to the Planning Board for decision and recommendation by February 5, 2002 and returned back to the Board of County Commissioners no later than February 12, 2002. Questions from Board aCounter Comm 65 en Commissioner Gordon pointed out that this is an existing development and the house has been there a long time and the walkway would not be too far from the existing house. She reek that there should be some consideration given to the fact that the house has been there a long time and the use already exists. She said that there would be a disruption if the pedestrian walkway were added. She would not support this pedestrian walkway. Public Comment Jim Bestow, 153 West Margaret Lane, spoke in support of Raba and Roses and said that this is truly a business that should be encouraged This is a unique and wonderful place. Ithan asset to the County. He feels that this type of business fits really well in an AR zoning eneronment. There is low tratha volume, no noise, no smells and it is a type of business that fits in this kind of neighborhood. He said that as orange County is striving to preserve open space and the appearance of open space , this klod of business in this setting meets the requirement by providing a viable, economical alternative that preserves open space. He said that this establishment is really an asset that we should stove to maintain. - Laura Baldwin presented pictures of her establishment She said that her business is an unusualbusiness . The business is at a private home which was a farm. She wanted to keep her land as it was because she is not a farmer. They want Reba and Roses to remain true to the country and nvironment and still be allowed to support a viable business. They have grown to 25 employees over the last six years. They sell everything from ad from local pursue and international artists. They sell plants that are grown on the property and plants that are not She understands that there are boxes met they must fit into, but Reba and Roses does not fit into any of the County's boxes. The property is actually split into 2 parcels. Raba and Roses she on the 4o acres and her home sits on the 16 acres. This is not a normal development or business. They need the flexibility to grow.
