PURPOSE: To seek authonzabon to enter into a contract with TJCOG —Area Agency on Aging
for$39,256 to provide Family Caregiver Support Services.
BACKGROUND: Of the top 20 Master Aging Plan's issues/objectives, three address the need
for caregiver and family support services. Goal IIIA-c3 recommendetl the implementation of an
adult day care program to provide relief to caregivers and Goal I WA-b3 recommendetl the
implementation of a heavy house cleaning service. The BOCC already have taken action on
both of these initiatives. However, Goal IIIA-bi recommended providing assistance 0
familieslcaregivers by expanding in-home respite care services. The attached Orange County
Respite Plan approved by the TJCOG -Area Agency on Aging meets the needs of caregivers
who have different types of caregiving situations. The plan to be implemented by the Orange
County Department on Aging covers four areas: (1)Volunteer In-home Respite—expanded use
of volunteers by"A Helping Hand% a non-prolrt agency that has a volunteer-based home
service; (2) Group Respite—a one-clay-a-week pilot group respite pmgrem at the NorthskJe
Senior Center provided in cooperation with JOCCA, DSS. Junior League, Orange Public
Transportation, and others; (3)Institutional Respite Relief Program—contract with local long
term care institutions to provide temporary relief to caregivers for overnight and 24 hour care
obligations; and (4) In-Home Respite requiring Personal Care—use of a professional such as a
certified nursing assistant to provide relief for the caregiver who is assisting an elderly person
with extreme personal care needs(incon5nence, etc.) beyond the training and appropriateness
of a volunteer.
The Master Aging Plan Steering CnmmMee was reconvened in November to help develop the
respite plan, and the Orange County Advisory Board on Aging reviewed the plan in December
and recommended Its approval.

FINANCIAL IMPACT: The total cost to provide the Respi Program outlined above is$39,256.
The Department on Aging anticipates receiving $30,120 (about A percent of the total)from
TJCOG to off-set the total cost. The Department will cover the required County match of 23
percent ($6,136) by providing in two ways— (1) in-kind contributions such as office apace and
staff supervision and (2) a $3,000 grant hom the Triangle United Way.
RECOMMENDATION(S): The Manager recommends that the RoaN authorize the Chair to
sign the contract to provide family caregiver support services.

County/[Orange County Department on Aging] (hereinafter referred to as the"Agency')and the Triangle J
Connell of Govemmondn/Ares Agency on Aging,@ucivafter craned to as the"Area Agency"}
WITNESSETHTHAT:
WHEREAS, The Area Agency wishes to have performed and the Agency wishes to provide certain aging
ervicus In connection with activities Induced in part by Older Amcrcros Act grant funds provided to The Area
Agency fiom the United Slates Department of Health and Humor Services though the Nmth Carolina Division
of Aging;
NOW TIIERFFORE, in consideration of the pm uses, and mutoal covenants and agreements hereldaftes
cOVmined,thepartics hereto agree as fellows:
1. Employment of the Agency, The Area Agency hereby agrees m engage the Agency and the Agency
hereby agrees to perform the services hereinafter set Ionia in accordance with the terms and conditions
contained herein.
21 Sense of Services. The Agency shall provide Family Caregiver Support services to caregivers coring
for individuals who are 60 years of age or older (and all for grandparents caring for grandehildfen
under the age or nautical)residing in Orange County. All services are to be performed in accordance
with the Agamcy.s Caregiver Support Plod submitted to the Area Agency, me terms of which are
ncorporated herein by refnenec. In addition,the Agency agrees w perform services in full compliance
with NC Family Caregiver Support Program requirements.

5. Compensation and Method f payment The Agenry shall he compensated for the work and services
actually performed ender this contract by payments m be made monthly by the Aroa Agency. However,

receipt of grind funds from the North Carolina Division of Aging.
6. Rc mbursemen[ of Service Costs. The Agency will report to the Area Agency on Aging,on a monthly
basis, and in the form specified by the Area Agency, the allowable expenditures to be reimbursed under
this condor- The amount of allow able expev&tares mgvHldJ will be reduced by die amount of program
income resolved for the service for the month reported. The amount of reimbursement due the Agency
will he got➢of the remainder which represent;the grant share of costs reported for the starlet.

the local match directly or indirectly consist of federal funds from any source nor may any of the funds

8. Agency Personnel.The Agency repoesenta that it has or will secure all personnel required to perform
the services provided for under this contract. Such personnel shall not be employees of the Area
Agency, nor shall such personnel have been employees of the Area Agency during any time within the
twelve (12) month period Immediately prior to the date of this contract, except with the express written
commit of the Area Agency's Director. The Agency shall procure a fidelity bond for all persons
authorized to receive or disburse Pmject funds. Agemys personml having access to property or Nnds
belonging m any clients served under this contract should also be bonded in an amount of at least
$1o,000. Public agencies shaLL procure a public employees' raldtful podormanm blanket bond. Nom
governmental agencies shall procure either a blanket fidelity bond or name schedule Fidelity bond. The
band limit for persona authorized to receive and disburse grant funds shall be at least rite amount of

R. Approval of Subcontract Assigerangrov, The Agency shall not resign all or any portion of its interest
in this contact. Any purchase of services with Purely Caregiver Support grant funds shall be carried
out in accordance with die Procurement and contracting policy of the Agency or, where applicable,dam
Area Agency, which dean' not conflict with procurement and contracting requirements contained in 45
CPR 92.36.
10. Review and Cuord'nation. To ensure adequate review and evaluation of the work, and proper
nmtination amorm inlnrested parties, the Area Agency shall he kept fully informed concerning the
progress of the work and services to be performed hereunder. The Area Agency's staff will conduct
scheduled on-site assessments and may also make unannounced visits for the purpose of evaluating the
Agency's ware.
11. Acc_ountiny, The Agency shall maintain complete accounting records sufficient to document receipts
and expenditures of gent and metchivg funds under this agrccmen . All accounting records should be
maintained in accordwce with the North Carolinaincal Csovemm rm Budget and Fiscal Control Act.

13. Maintenance of Retards. The Agency shall maintain all financial and program records for a period of

the Nash Carolina Division of Aging, and the Compo-ollm Gempl of the United States, or any of their
drily authorized representative¢. If any litigation,claim, negotiation, audit or other action involving the

retained until completion of the scion and resolution of all issues which arise from it.

23. Audit If the Agency expends a total of$300,000 or more from all federal sources,as defined in Ob®
Circular A-133 (effective July 1, 1bud, the Agency agrees to have an proud independent audit which
meets the requhemeals of the Division of Aging Program Audit Guide for Aging Services, applicable
North Carolina Gcaeml Stations send Neal Government Commlasnn requirements, and OM Circular
A-133 and OMB Circular A-87 or A-122. The audit is to be completed within six ((s) months of the
close of me Agency's fiscal year.. Upon Completion of the audit, the Agency shall deliver to the Area
Agency a copy of the audit and any opinion letter and management lever. H the Agency receives federal
homing in an amount less than the$300,000 threahuld,she Agency may be subject to fiscal monitoring,
as deemed devereary by the Area Agency and the Nand Carolina Department of Health and Human
Services. For providers expending less than 3300,010 in state fmanclal assistance aweEk as of July 1,
1997, audit and reporting provisions established by G.S. I43-0.1 and State Audit Advisory No. 2

25. Ind. The Agency agrees to indemnify and save business the Area Agency, its agents and
employees from and summit any and all logs,cost damages, expense and liability caused by the failure

proper mmtner its obligations under this mngact or if the Agency has or shut; violate any of the
covencere, agreements, representations or stipulations of this contract, the Area Agency shall therefore
have the right to tormNate this decrease[by giving writing notice to the Agency of such demarcation and

damage sustained by the Area Agency by virtue of any breach of Nu contract by the Agency and the

determined.
28. Terminative for Convenience. The Area Agency may terminate Nis moo-act for the convenience of Nc
Area Agency at any time by giving written notice to the Agency of such terminated and specifying the
date thereof,no fewer than fifteen (15)days prior N the effective dabs of such termination. m that event,

to the effective date of such comminution, less payments of compensation previously made by the Area
Agency. Provided, however', if this contract is terminated because of default by the Agency the
provisions of paragraph 26 hereof shall prevail

Backgroba
Triangle J Area Agency,on Aging has received National Peabody Caregiver Support Funds from
the Reau[herivcon of me Older Americans Act to he distributed to all counties m Region J. The
purpose of ratio funds is to support respite services for family caregivea of adults aged 60 and
older which may include(1) mformatlon regarding saNces to caregivers, (2)Assistance to
ampivers m accessing those services,(3)Caregiver coining,suppon groups,individual
cop ekg,(4)Reapitecareand(5) SWplemmmismic6. Respiteisdefinedaspmvidinga
sitter,to home or other cane location,which relieves the family/ureaid primary caregivers)of a
pemeq aged 60+from direct two responsibilities for a short time. The duration can be fioma
half how to several days wrier various circumstances.In a fully,developd county respite service
Francis,different formins(in and out of home,short and long term,etc.)would be available to
meet the needs of the differwt types of categiving situations.
Orwge County has been allocated a mimrntw of$26,667 for FT2002 which includes a$5,000
local match,either cash or m-kind. Each County is responsible for establishing a work group
that would prepare a respite service proposal and submit it to the Region J Aging Advisory
Council for approval by December 2001. To be f rshed, proposes wwty respite plans must.

segments of county caregivers;

Qtange County Planning,Process
During the FY 1999-2000,the Orange County Reard of Commissioners approved a process to
develop a Master Aging Plan(M.A.P.)for Orwgc County for the period from July 2000-June
2005,The Commissiomrs' goal was" develop and implement a Master Aging Plan(M.A.P.)
that would provide a comprehensive and cnmdinated delivery of commonality services to savior
citizens over the life span who have different levels of Emotional capacity" To achieve this
goal,the County Commissioners enabbshed a M.A.P.Task Forte in November 1999, comprised
Of a Steering Comminee sued three functional subcommittees:the Well-Pit Subcommittee,the

Moderately unpaired Subcommittee and the Severely Disablsl Subcommittee. Ova ninety
Orange County citizens,professionals in the aging field,and commodity service providers
volunteered then time to improve to quality of life for older residents.
After ten months,numerous meetings,and two public hearings,the M.AT, Task Force had
identified the issues,developed goals and objectives to address them.The Task Force completed
the Mason Aging Plan which was officially adopted by the Orange County Board of
C iasionem(BOCC)on March 6,2001 The County Commissioners gave the County
Advisory Board on Aging the responsibility to coupon the progress of the Master Aging Plan by
makingnecessary annual revisions_seek fundin fierit 6omval sources and submit finding
prionfies to the BOCC per approval. Thus,the proposal uas of available National Family
Caregiver Support Program funds was submitted ro the Advisory Board on Aging to consider in
light ofthe approved objectives m the Master Aging Plan
To assist the County Aging Board in this planning process,the Master Aging Plan Steering
Committee was reanimated on November 16 and 2610 serve in the role of respite care weak
group.This group is comprised of approximately 20 key voteaneer and agency leaders m Orange
County. p was charged with preparing a funding proposal to submit W Triangle J Ares Agency
on Aging,supportive ofthe M.A.R respite care issues identifial for the moderately impaired and
severely diasbled population. The 611owing respite care proposal is submidol based on this
planning process.
Fundine Proposal
Omnge County has had a long tradition ofpmviding support to caregivers as evidence by Home
and Commodity Block Grant lauds being used for in-home respite(48 hours per week)as well
es iddfomutiov and assistance seance. The Orange County Department on Aging also offers
megiver counseling and a operates a support group for caregivers. Of the top 20 Master Aging

1. Volunteer la-house Respite Service. Under contract with the Orange County
Department on Aging,"A Helping}Wrd"von-profit agency world depend its volunteer
based home services to include respite care.The agency would be responsible for
screening,trending,placing and supervising volunteer who would provide weekly mr
home respite to camsiveri. The Department on Aging's EWeroaze Services Division as
well ses the Dept.of Social Services'Adult Services Division would assess and review the
needs of the caregiver families with"A Helping Heard"in asking appropriate matches
and schedWwg volurrtc;e to provide the service. Priority will be given he caregivers
whose family member requires fall time care. This funding will allow"A Helping Hand"

to expand its Faith in Action Project, forded by the Robes Wood Johnson Foundation in
January,2001. Thu pryect would not only include 24 hours per week ofvohateer respite,
but provide assistance with household projects and yard work to benefil caregivers. It would
also include a new"Hospitality'program that invites community enhancers m bring a home

Goal:To serve 45 caregiver/famtiies with a minimum of 30 volunteers receiving a
minimum of 4 hours training and orientation.

Senior Center. This would be done in cooperation with several agencies-JOCCA,DSS,A

Services would warrant with local long term care inatimtions m provide temporary relief
caregivers;for overnight and 24 hour care obligaliors. A minumma of two local providers,one in
southern Orange and another in camml Orange,would be retained for this service al the skilled,
intermediate at sodded living care level.
Goal: To serve 10 enregivere with 3 days of insEtutional can relief.
