PURPOSE: To approve the certification requirements for the Fire Marshal to participate in the
North Carolina State Firemen s and Rescue Squad Workers' Pension Fund, at no cost to
Orange County.
BACKGROUND: State law was recently amended to permit county fire marshals to participate
In the North Carolina Firemen's and Rescue Squad Pension Fund. This Fund, which is
administered by the North Carolina Department of Insurance, was established several decades
ago as an instrument by means of which volunteer firefighters and rescue workers who meet
eligibility requirements can receive a modest monthly pension upon retirement. Monthly
contributions are made by or on behalf of these volunteers. State law requires that in order for
members:to be eligible to participate in the Pension Fund and receive a year of credit in the
fund, members must attend thirty six(36) had N of training in the calendar year. During the past
year, Orange County's Fire Marshal received eighty(80)hours of training in fire larson
Investigation, terrorism and county fire administration, as noted in the accompanying certificates
of training, Retirement benefits that the Fire Marshal obtains from this Fund would be through
self paid contributions. These monthly pension payments would be in addition to those benefits
that he Fire Marshal (and all other eligible, vested County employees) receives through the
Local Government Retirement System after retirement.
North Carolina General Statute 58-86-25 requires submission OF a complete and certified roster
ofeligiblestaff annually. The governing body,the County Commissioners, must certify the
annual certification roster. The certified poster and minimum training requirements determines -
eligibility for Pension Fund credit and must be submitted to the North Caroline State Firemen s
Association by January31, 2002. The Boards action to certify that the Fire Marshal's 2001
training was completed will enable the Fire Marshal to begin making monthly contributions
towards future retirement benefits from the Fund.

FINANCIAL IMPACT: There is no direct financial impact on the County resulting from this
certification, as pension fund dues are paid from the Fire Marshal's personal income. Orange
County does pay for the Fire Marshal to attend twining seminars and membership in the NC
State Firemen's Association, but that occuhe irrespective of his participation in this pension fund.
RECOMMENDi The Manager recommends that the Board approve the certification
roster and authorize the Chair to sign certifcation documents.
