The SOCC tabled their decision on October 16, 2001 for additional analysis on five issues.
1. Availability of sufficient water for fire protection and possible need for a pedestrian
corridor to be widened to allow a fire truck to draw water from the beaver pond.
Two sources of water are available for fire protection for this subdivision. (See November
15, 2001 memo regarding this matter and related staffing issues on page 27a.)
2. Birdsong Lane culEesac may be too long, limiting connectivity and EMS access.
A. The stub -out between lots 14 and 15 provides for Birdsong Lane to be extended
southwest toward Pearson Road or NC Hwy 57 should future development occur.
(Resolution Section B].) (see pages 8 -91
B. The enlarged 40 -foot easement between lots 5 and 6 provides a second access point
for EMS Vehicles. This pathway connects Birdsong Subdivision with May Drive the
private road, which serves the three exempt lots to the east following an existing farm
road. Further surface improvements will be made to ensure sufficient support for fire
trucks and other emergency vehicles. (Resolution Sections B.B. & F.6.) [see pages 9
and 11]
3. Further clarification on the proposed private recreation space.
The applicant has delineated a specific 2.24 -acre area dedicated for active recreation and
a 2.07 -acre pedestrian trail network around the perimeter of the subdivision. This
combination (4.31 acres) exceeds County regulations, which do not specify a type of
private recreation space simply a minimum area amount. (See Resolution Section E.2.)
4. Potential maintenance concerns linked to the pond, wetland area and beaver habitat.
A. The applicant has increased the building limb line from 50 feet to 65 feet away from the
edge of the pond to prevent any risk of structural OOOtling. (The 65 feet distance is
consistent with our new scream buffer regulations.) (Resolution Section F.2J [see page
10]

B. The applicant will also add a section to the Homeowners documents that requires the
Association to maintain the pond and regulate the water elevation to Rs current level.

5. Developer agrees to restrict further development on adjacent 10 +.acre parcels

A 50 -foot `stub oW between lots 14 and 15 shall be reserved for future roatl connections
to the wast and must be formally der lcated to the County as an access easement (or
right -of -way) as part of the Final Plat approval process. The cul-de-sac areas shall be
reverted to the adjacent lots 13, 14, and 16 if /when the stutrout Is constructed.
• There are no existing connection points (stub-outs) in the adjacent subdivision Wilson
Place (Dawn Lane).
• A40 -foot pedestrian and emergency vehicle easement shall be established between lots
5 and 6. Designed as part of the pedestrian ni this easement shall contain a
constructed tmvelway capable of supporting emergency vehicles.

The existing drainageway is protected by a stream buffer calculated by Method A (per
Section 6.23.7 of Orange County Zoning Ordinance)
• The drainageway is further protected by the 501 buffer consisting of two zones (30-foot
Zone 1- forested) and (20 -foot Zone 2- grassed /vegetation) as required by the Nauss River
Basin regulations
Recreation & Parks:
Public Recreation Space
• The site is located in the Northern District Park (per the Recreation Service Area Boundaries
Map)
• All subdivisions (not located within a flocdplain) must provide a minimum of 1/57 acre of
recreation space per lot (Section IV- B -7 -b)
• A minimum of 19,869 square feet (0.456 acres) of land is required for public recreation
space
• Or a payment in- lieu -of parkland dedication =$ 11,830($455' 26 lots)
Private Recreation Space
All subdivisions must provide a minimum of 0.028 square feet of recreation space per land
area dedicated for residential use (Articles 5. 1.1 8 6.12 of the Orange County Zoning
Ordinance, outline Land Use Intensity (LUI) requirements.)

In those cases where the LUI calculation results in s larger amount than the public
recreation space requirement of 1157 acre per lot, the difference shall be established as

Planning Staff Comments
The Preliminary Plan meets the conditions placed on the Concept Plan approval.
Revisions to Ne concept plan include:
• Compliance with the Nauss River Basin rates that have been adopted since Concept Plan
approval.
• Delineation of a building limit line along the eastern edge of lots 1 -14 to eliminate any load
potential from the drainageway and beaver pond.

• First Action: Planning Board to consider Concept Plan
The Planning Board approved the flexible development concept plan for Birdsong on
October 4, 2000 with the following conditions:
1, Birdsong Lane shall be a public right -of -way built to INDUCT standards with additional five
(5) foot utility easements on each side. The rigM-of-wey at the Lidle River Church Road
intersection shall be Improved to NCDOT Standards. Sight distance triangles (10 x 10')
shall be delineated on the plat for Birdsong Lane at the intersection withiidle River Church
Road.
2. Driveway access came shall be a minimum of 50 feet from the intersection of street ril
m -way.
3. Lots 1 and 26 shall not have direct access onto Little River Church Road but shall exit onto
Birdsong Lane.
4. If an entrance sign is andcipa[ed and will not be placed within the 100 -foot building buffer,
maintained by the Homeowners Association, a sign easement must be reserved within one
of the residential lots.
5. All common areas (stream buffers, building buffers, landscape buffers) must be clearly
identified on the preliminary and final plats and maintained by the Homeowners Association.
The common areas cannot be subdivided or recombined with adjacent lots. Draft farms of
the Homeowners Association documents, including restrictive covenants and conservation
easements, that contain use and maintenance provisions for the open space and buffers
must be submitted for review by the County Attomey as pad of the preliminary plat approval
process. The restrictive covenants or conservation agreement shall designate a backup
grantee in the event that the Homeowners Association is eliminated.
6. The preliminary and final plats shall contain a note restricting further subdivision.
7. Each lot shall contain an adequate area for scene disposal and a repair area as approved by
the Orange County Division of Environmental Health.
B. The preliminary plat shall indicate areas for on -site infiltration of storm water that
demonstrates compliance with Article 623.3a of the Orange County Zoning Ordinance.
9. The location of all dramageways, stream buffers and flood plains shall be delineated on the
preliminary and final plats, along with appropriate information regarding restrictions.
10. The developer shall establish a building limit line along the eastern edge of Iota 1 -14 to
eliminate any flood potential from the drainageway and beaver pond. This line should be
shown on the preliminary and final plats.
11. The preliminary plat shall show the location of tree protection fencing and contain a note
requiring the installation of tree protection fencing prior any grading to ensure the
protection of vegetation within all buffers and open space.
12. The applicant shall dedicate a minimum of 19,869 square feet (1/57 acre per readdenfial lot)
for public recreation space , of pay an in- lieu -of fee, as part of the preliminary plat approval
process. (Section IV -13-7 -b Recreation Sites, Orange County Subdvisron Regulations).
13, The applicant shall provide a minimum of 43,293 square feet for private recreation space as
pad of the preliminary plat approval process. (Section IV-B-7-b Recreation Sites, Orange
County Subdivision Regulations).
14. All street names ro be reserved with CIS section of Planning Department prior to submittal of
preliminary plat subdivision request.
Second Action: Planning Board to consider Preliminary Plat
The Planning Board recommended approval of the preliminary plat for Birdsong
Subdivision on September 5, 2001 in accordance with the attached Resolution for
Approval.

Board of County Commissioners consideration of Preliminary Plat
1, The Board shall consider the application within a reasonable amount of time.
2. During deliberations and consideration of the application the Board may defer
consideration at any point to pursue additional analysis and review.
3. If the Preliminary Plat is approved by the County Commissioners the applicant shall have
one (1) year to prepare and file a Final Plat or to request a one -year extension from the
Planning Director

TO APPROVE
BIRDSONG SUBDIVISION PRELIMINARY PLAN

The Board of County Commissioners hereby approves the Preliminary Plan for Birdsong
Subdivision as shown on the preliminary plat dated June 26, 2001 (last revised November 21,
2001) ant subject to Po1011ment of requirements spedfled herein.
NI roads shall be irrevocably dedicated to me general public and be constructed to standards of
the North Carolina Department of Transportation (NCDOp. The approval of this resolution
authorizes and dlrecls the Orange County Manager to accept for the County, and on behalf of
the pudic generally, the offer of dedication of Birdsong Lane. This acceptance of dedication to
the general public Abell be without maintenance responsibility. These wads shell be maintained
by the owner/applicant (Elie Is May Batouli( until such time as they am accepted! for
maintenance by NCDOT or some other governmental body. At easements for drainage,
pedestrian access or other purposes, all private open space shall likewise be maintained by the
ownerlappllcant unm such time as they are transferred to the control of the Homeowners
Assocladon or are accepted for maintenance by the County.
Before the Final Plat of Birdsong can be recorded:
A. Swags Disposal
1. All lots shall camain adequate septic disposal and repair areas, approved by the
Orange County Division of Environmental Health Septic areas shall not extend
into required landscape buffers.
2. Septic systems shall not be constructed or extend with'm twenty feet of the
small boundary line of the Birdsong subdivision adjacent to William Place
(Dawn Lane). This twenty-foot bufM, located will the 100-frW building buffer
required for the conservation cluster flexible development design option, shall
remain undisturbed. Septic systems Well not be constructed or extend! within 50
feet of the Little River Church Road dghbf-way as specified in section G2. of
this Resolution.

restrictions to be recorded concumently with the Final Plat.
B. Roads and Access
1. Birdsong Lane shell be constructed to NCDOT minor local standards win a 50.

inspected and approved by NCDOT

A letter of credit or sucrose agreement or other secunty shall be subtraed b
secure construction of Birdsong Lane to NCDOT standards. An estimate of Me
construction cost must be prepared by a ceritiedlllcensed engineer or grading
contractor and submitted to the Orange County Planning Department and
approved by the County Engineer. The financial guarantee must reflect 110
Percent of Nat estimate and be Issued by an accredited financial institution
licensed to do business In North Caroline. The document describing
development restrictions to be recorded with the Final Plat shall State that the
financial guarantee will not be released until the mad construction has been
Inspected and approved by NCDOT.
2. An erosion control plan for the entire project. Including Birdsong Lane, shall be
submitted by the applicant to the Orange County Erosion Control Division for
review and approval prior to any disturbance on the site. The Erosion Control
Plan shall Include a stommater management plan Nat meets the requirements of
both the County and the house River Man rules.
1 Prior to any construction or any alteration of any existing across within rue right-
of-way Little River Church Road (SR 1543), the developerlowner shall secure a
driveway permit from the NCDOT District Office. A copy of the NCOOT-
approved permit and letter to the Planning Department shall be submitted at the
me time as Me request for Planning Department signatures on the Final Plat.
Sight distance triangles shell be shown at all intersections within the subdivision,
or included within Me right-of -way of the proposed street.
4. Access to all lots shall be from Birdsong Lane. Driveway cots for lots 1 and 26
shall be a minimum of 50 feet from the Intersection with Late River Church Raced.
This restriction shall los appeal In a document to be prepared by Planning Staff
and recorded concurrently with the final plat. Non-vehicular access easements
(NVA),-areee where driveways shall not be betted —shall also be shown on the
final plat.
5. An approved street name sign shall be erected at the intersections of: Little River
Church Road (SR 1543) and Birdsong Lane, as required in Search N -8-3-012
Street Name Slans of the Orange County SubdFASion Regulations. The
applicant shell submit either evidence Nat the sign Is in place or a receipt for
purchase of the sign prior to Planning Department signatures an the Final Pie[.
6. The applicant shall Medicine, In fee simple to the North Carolina DBPerthent of
Transportation, an additional 5 feet or 35 feet soon the centerline of the existing

Fire Marshal and local Fire Department Chief shall Inspect and approve the
travelway to ensure its accessibility to EMS vehicles poor to Final Plat approval.
Once constructed, tore easement and thavelway shall be maintained by the
Homeowners Assoaation as provided by the recorded Declaration of Covenants,
Conditions and Restrictions for Birdsong Subdivision. (See also Section R7 of
this Resolution.)
C. Land Use Surface and Landscaping
I Landscaping shall be installed [or preserved] as indicated on an approved
landscape plan and shall M inspected and approved by the Planning
Department prior to Final Plat approval. Landscaping shall induce a 3 ficet
Type A Land Use Buffer along Little River Church Road.

undisturbed. This buffer, which is separate from the hghtbf-way dedication
referenced in B.B. of this Resolution. shall consist of the So l Type A Land
Use Buffs along Little River Church Road and an addition 20 -foot area south of
[ore Land Use Buffer. The 20 -foot additional buffer is to remain undisWrbed.
Septic systems shall not edend into any portion of the combined 50.foot buffer
along Llltle River Church Road.
3. The landaceping shall be maintained by the wvnerlaippicant (Elie Batouli) until
such time as it is accepted for maintenance by the twmeowners associetiw.
C Provisions for the protection of existing trees as shown on the approved
landsci plan shall be included in a document describing development
restrictions and requirements to be prepared by Planning Stag and recorded
concurrently with the Final Plat.
S. Drainage
1. Impervious surface data for all lots, pursuant to Anide 6.23 Fxtm Requirements
for Watershed Prob ion Overlay Districts of the Orange County Zoning
Ordinance, shall be included in the development restrictions and requirements
document to be prepared by Planning Staff and recorded concurrently with the
Final Plat The impervious surface limitations for each lot shell indicate whether

the impervious surface includes or excludes one -hare OiT) ct the roadway
widM In Me calculations.
2. Drainage easements shall be located on the Final Plat as required following
review and approval of Me Erosion Control Plan.
3. Drainage culverts shall be met and located as required by NCDOT and Me
Orange County Erosion Control Wool.
E. Parkland
1. The proposed assnty six lot subdivision is located within to Nonhem District
Park area. As per the decision of the Board of County Commissioners, cash In
the amount of $11,830 ($455f1ot) shall be paid to Orange County as payment In
lieu of parkland dedication.
2. The secants paragraph of Section IV-8-7-b of the Orange County Subdivision
Regulations references the Land Use Intensity (LUI) calculators In the Orange
County Zoning Ordnance, Amides 5.1.1 and 6.12, which require 0.028 square
feet of recreation space per land area dedicated to residential use (0.028' 54.66
= 1.53 acres or 66,647 square feet). In those cases where the LUI cahowitron
results in a larger amount Man the public recreation space requirement a 1/57
acre per lot, Me difference shall be estebffshe t as private recreation space for
the use of the residents of the deveopmenf (66,647 - 19,869= 46,]]6 square
feel (1.07 acre). The developer is offledng 20.44 acres of open space (37.4 %) to
be maintained by Me Homeowners Association, Including 2.24 acres In a
designated active recreation area and 2.01 acres in passive pedestban
walkways.
P. Miscellaneous
I The Final Plat shall contain a Me block and vicinity map in accordance with
Section V -D -2 Le Bid and V -D-3 Vicinity Mao of the Orange County
Subdivision Regulations.
2. The 100 -foot building buffer, 65 -foot building limit line, stream buffers—County
and Nauss River Basin, minimum building setbacks, easements, public (along
Life River Church Road) and private open space areas shall he stood on the
plat and in a document describing development restrictions and requirements In
W prepared by Plannhg Staff and recorded concurrently with Me Final Plat,
3. The sense of shallow pools surrounding the drelnageway shall be maintained by
the Homeo'mlem Aseeciadon as provided by the recorded Declaration of
Covenants, Conditions and Restrictions for Signal Subdivision to regulate the
punts water height and minimize Me potential for flooding.
4. Dionne easements shall be provided as required by section D. Item 2. outlined
above.
5. The Final Plat shall contain a note realdding any fuller subdannon on the site
and Me developer shall record a document restricting further subdivision of the
adjacent Most exempt lots served by May DMe. as agreed to by to
ownedapplicent. The Final Plat shall also contain a note prohibiting any
subdivision, recombination or development within to open space or buffer areas.

6. The owner/applicant shall establish an easement on that portion of May Drive,
which provides a second acr¢ss for emergency vehicles from Little River Church
Road (SR 1543) to the 4Pfoot combination pedestran/ emergency vehicle
social easement in BiNsong Subdivision as outlined in Section B.B. of this
Resolution.
1. If any condition of this Resolution shall be held invali or void, the Resolution
Itself shall be void and of no effect.
G. Certifications
1. A Cti i4cate of Survey and Accuracy signed by a Professional land Surveyor
shall be notanzed on the face of the Final Plat.
2.. A Certificate of Declaration and Maintenance In the form provided In Section V -D-
e-b of the Orange county subdivision Regulations slgnM by the landowners and
developer shall be on the face of the plat and included in a document describing
devebpment restrictions to be recorded concurrently wit the Final Plat.
3. The North Carolina Department of Transportation shall certify that all roads have
been constructed to State standards or that construction plans have been
approved.
4. A Certificate of Approval signed by the Orange County Planning and Inspections
Department.
NOW, THEREFORE Be IT RESOLVED, by the Board of Orange County Commissioners, that
the Preliminary Plan for Birdsong subdivision is approved In accordance with the above
mentioned conditions and attached Preliminary Plat dated June a, 2001 (and last revised
November 21, 2001).

RE: Birdsong Subdivision
Upon review of the Preliminary Plan for the Birdsong Subdivision, Erosion Control staff
have determined that the Nauss River Buffer requirements have not been met. A 50'
Neuse River buffer must be delineated on the Plan surrounding the pond and the blue
line stream. This buffer may be shown as 30' forested! (Zone 1), 20' grassedNegetated
(Zone 2). A building line outside of this buffer should also be shown on each lot.
Zone 1 on the pond shall begin at the most landward limit of the nmmal water level, or
the rooted herbaceous, and extend landward a distance of 30', measured horizontally
on a line Perpendicular to the Surface water. Zone 1 on the blue line stream shell begin
at the most landward limit of Me top of the bank, or the rooted herbaceous vegetation,
and extend Iantlwartl a distance of 30' an all sides of the surface water, measured
horizontally on a line perpendicular to Me surface water.
Zone 2 shall consist of a stable, vegetated area that is undisturbed except for activities
and uses provided for in the agached Table of Uses. Grading and revegetadng Zone 2
is allowed provided that Me heats of the vegetation in Zone 1 is not compromises.
Zone 2 shall begin at the outer edge of Zone 1, and extend landward 20' as measured
horizontally an a line perpendicular to the surface water.
The following is a brief summary of provisions outlined in the Table of Uses that would
impact single family lots:
• minimal disturbances such as fences are allowed in Zone 2, so long as installation
does not require removal of any forest vegetation in Zane 1,
one -time fertilizer application Is allowed for establishment of replanted vegetation in
Zone 2,
• annual fertilizer application is prohibited,
playground equipment is allowable as long as installation does not require removal
• of any forest vegetation,
• mowing and pinning are allowable in both Zane 1 and 2 as long as the health and
function of the vegetation is not compromised, and
planting of new vegetation (grass, shrubs, trees, etc) is allowable in both Zones.
This summary is not meant to take the place of the approved Table of Uses.

This letter is in response to your request concerning the changes for your subdivision. The revised map dated
November 26, 2001 shows a 40' Pedestrian and Emergency Vehicle Easement between lots 4 and 5, where there w
previously a 20' Pedestrian Access Easement. This proposed change would not affect the chain field areas as
delineated for lots 4 and S.
Improvement Permits for each lot in the proposed subdivision have been issued. As you are aware the county
planning and health regulafions require that each new lot should support at minimum a thee- bedroom (360 gallon
day) home. You will be able to determine fiom the permits Nat each site as proposed has been permitted for 600 g
or 5- bedrooms, with the exception of lot 1, which has been approved for a480 gpd or 4Iwdroom system. The on[
caveat is that certain lots will require innovative dorm fields or repair areas to accomplish the 600 -gpd request.

b_ Birdsong Subdivision Preliminary Plan
The Board considered a preliminary plan for Me proposed BiMSOng subdivision.
Craig Benedict made this presentation.
The subdivision is a 5421 -acre matt The original most was 05.39 acres, 31 of Mich
r subdivided into three Iota of just over 10 acres each through the exempt process. There
will be 26 single-family residential lots on Me conservation- cluster flexible development option.
The average lot size is 123 acres and Me proposed open space is W% of the site The site Is
located on the south side of Little River Church Road between Walnut Grove Church Road and
NO 57 In Cedar Grove Township. Payment-in-lieu fees of$1183o will be collected. Planning
staff recommends approval because It is In accordance with the flexible development plan.
Commissioner Carey asked about Pe blue area on Pe map and Craig Beneditl said
that it was a flooded area.
Commissioner Carey asked about the stub out at the end of the cul -de -sac and rf it
would be developed. Craig Benedict said Pat the staff was looking into a 50 -foot easement
reservation that would allow Me continuation of the cut de-s b; In the other subdivision. In the
vent that the 50.fcot easement is not available, this stub out would all for access to a large
portion of undeveloped properties to the south and southwest.
Commissioner Jacobs said that for noticed on the previous subdivision , Duck
Lending, that there was information about building the mad to DOT standards and Pe mad in
this subdivision is being built W DOT minor local standards. He asked about thediffdence and

Commissioner Jacobs asked about certain sized subdivisions that require community

Commissioner Jambs asked that staff look into whether Mere should be some kind
of automatic point at which it would require a more comprehensive look at requiring recycling
He would also like for staff to look into whether there should be a standard for Me distance from
an access point Pat would lead to the open space.
Commissioner Jacobs asked about the acre of recreation space.
Ella Batoull, developer of this project said Mat he could have made to lots larger,
burns would have had to use the pond and the wetlands. He was against possible
comtaminationofthepond. He addressed Me emergency management letter and the three

about beaver ponds and what happens when beavers are not there.
