PURPOSE: To consitler adoption of the Regulated Recyclable Materials Ortlinance (RRMO).
BACKGROUND: Following a recommendation from the Consimction & Demolition Recycling
Task Force in August of 2000, several subsequent tliscussions by [he Boartl of Commissioners
and a Public Hearing on November ], 2001, the RRMO has been refried and modifetl to the
e#enf that staff believes it is now ready far foal consitleration by the Board.
Tha key motli0cation [o [he RRMO, in its current drak (#tfi), is the temporary elimination of
non-reusable wood waste from [he definition of splitl waste, which is the podion of the
oNinance that weultl impact the agriculture communitys landcleadng activities. This part of the
ordinance has bean the primary focal point of most of [he differences of opinion and
uncedainfies relatetl [o the RRMO in ifs previous form. The akached drak has been motlitietl
from the previous version, es related to open burning, as follows:

Separating the prohibition on burning of landclearinq debris would allow the remainder of the
ortlinance-[he recyclable materials resvic[ions -to be implemented in a timely fashion. The
question of open buming cf landclearing debris can ba resolved and/or addressed by other
means or through a future amentlmen[to the RRMO. It is suggested that proceeding In this
manner would allow stall time to more thoroughly examine the issues related to prohibiting [he
open buming of agriculturally genereletl lantlcleadng tlebds. These issues wroultl specifically
include:
• How would the agricultural wmmunity be impacted by the prohibition cf open burning of
landclearing debris?
• How could the ortlinance be modified to make specific accommodations to the agricultural
communiq?
What alternatives to open buming could be made available to the agricplturel community
should the BOCC proceed to prohibit open buming of all landclearing debris?
• Are options available to subsidize costs to the agriculWral community tha[are associated
wRh alternatives tc open buming?
• What is the estimated amount of land cleared on an annual basis for agriculture activities?
• Could the "use value'tax designation be utilized in consitledng special accomnwtlations for
agdcultursl burning4
Are there other means available, aside from the RRM Okinance, that mould be considered
in pursuing regulation cf the open burning of landclearinq debtls9
These and other questions could be addressed in a future analysts of the issue of regulating
open burning of landclearing debris in Orange County. Should the BOGG agree to this
approach, stall mould return by the first BOCC meeting In Febmary 2002 with a comprehensive
report cn the subject. This would provide the BOCC with sufficient time to amend any
previously adopted odinance, prior to its anticipated July 1 effective date, to include provisions
to regulate the burning of landclearing debris. Additionally, it would allow time to develop
alternatives to open buming for the agricultural community.
Implementation of this ortlinance would require the immediate creation of a new permanent
position to handle bath education end enforcement activities related to management of
cona[mction 8 demolition waste. The C8D Waste ftecyclinq Task Force recommended such a
position, and funding far the position was indutletl in the 2001-02 Solid W as[e operating
budget, pending formal approval of the RRMO by the Board of Commissioners. Copies of
pertinent 2001-02 budget background matedals related to this new position are included as an
atlachment to this abstract.
Other modifications to the current draft of the ordinance include addition of an effective date of
July 1, 2002. While the education proceea would begin immediately upon adoption, stall is
assuming the[ actual enforcement and imposition of penalties would commence July 1.
Alfematively, the odinance could be prepared so sa to become effective immediately, but refer
to s apecifc grace pedotl ending on a date certain.
Atltlitionally, the references W a 525 fee for issuance of a license (per vehicle) and for permd
applications has been modified to reference a BOCC approved tee schedule. Staff believes
this to be prudent so that the odinance would not require amending simply to change a fee.
FINANCIAL IMPACT: The fnancialimpad of atloption of the oMinance bas been previously
tletailetl in a report to the County Manager tlated September 5, 2001 and subsequenlly
providetl antl tliscussed at the BOCC Wodc Sssaion of October 1, 2001. ToWI facility costs are
estimatetl to be approximately $315,000. Total equipment costs are estimatetl tp be
approximately $1,000,000, Annual opemtin9 costs, including new personnel costs, are
estimated b be about 5315.000. Revenues for fees, surcharges and recyclable mefedaV
uea are estimated to be $315,000 annually. Lost tonnage duo [o tliveralon of materials
from disposal to recycling is estimatetl to be approximately $305,000. Other savings relafetl to
elimination of annual wood waste conVac[ gdnding expenses are estimated to be about
$90,000. All costs are to be fundetl by the Solitl W oats enterprise funtl operating revenues or
reserves. When fully implementeQ the redaction/tliversion pactices contemplated in this
ortlinance ere antlclpatetl fo protluce a monthly reduction of between 600-750 [onalandflletl.
Using a general rate of thumb, [he approximate value of the landfill space thereby saved for
subsequent use woultl be in the range of $14,500-$16.000 par rtronth. Atltli[ionally, tlepentling
on actual reductions achieved in the volumes of waste being tlisposed, implementation of this
oMinance will also extentl [he life of a new C&D lantlfll, perhaps by as much as 3.5 years.

BACKGROUND: In August 2000, the Construction antl Demolition (C&0) Recycling Task
Force submiked hs foal report to the Boartl of Gcunty Commissioners. The report contained, -
among other recommentlatigns, the rewmmentlaticn that the County atlopt a mandatory
recycling ordinance. The pdmary objective of this regulatory approach was to enwurage more
responsible management of highly recyclable materials from fhe CSD waste stream and to
divert these antl potentially other materials fromlantl011 disposal. At the time. Oange County
was Involvetl in a search for a new consfruceon and demolition IaMfll to replace fhe ensting
facility, which is expeMetl to reach rapacity In 2002. The tlilficulty of siting a new C6D lantlfll in
Orenge County providetl an additional impetus for fhe odinance in that it reFlecta a tleaire to
make any new such facility last as long as possible by tliversion of selecYetl materials.
The purpose of the proposed ordinance islo regulate bath recyrAable C80 matedals antl
potentialy other materials in the waste stream by keeping those materials from being landflletl
and raquiringthat they be separated for recyclln9 insteatl. While the ortlinenca is not
specifically a C&D recycling oNinanca, the initial focus of the ordinance Is on what are typically
considered CSD matedals-for example, untreatetl/unpainletl wood waste, wooden pallets, end
scrap metal CaNboartl is also inclutletl. Other materials may be atltled In the future to the list
of regblatetl matedals.
The proposed ordinance regulafea the on-site separation of the regulatetl matedals, requires
Regulatetl Recyclable Material Permits to be obtainetl along wtth the tratlitionel
building/demolition permits, and the licensing of waste haulers that haul wastes that typically
contain theregulatetl materials. Passage of the ortlinance woultl signifcantly after the ways in
which wnsiruction and tlemolition waste is managed in Orange County, and has the potential to

reduce the amount of material landfllletl, If properly implemented and administered. The current
disposal ban on cardboard In the Orange County landfill would be expanded to mandate
recycling of all commercially generated ceMboarq whether it is delivered to the in<ounly landfill
or other cutafcounty fecilifies. One additional provision of the oNinance is to prohibit the open
buming of solid waste, including Iandcleerin9 debris.
Implementation of such an ordinance requires staffing, facilities development, and coordination
with other departments and governments within Orange County as well as with the requlatetl
community of developers, contractors, end waste haulers. If the ordinance is adapleq the
County would proceed to develop the necessary local recycling Infrestmc[ure to recycle and
market the regulated matedale. The County would also develop an educational and
enforcement capability [c:

• provide continuing enforcement of the oNinance
A substantial grace period is proposed to follow adoption of the ordinance. That period would
allow the regulated community to became informed regarding the ordinance and would pemnR
stag to develop the necessary recycling infrastructure.
During the past year, Solid Waste staff has met or otherwise cemmunicatetl with varbus
stakeholders who would be affected by the ordinance end has made numerous modifications to
the tlreR oNinance based on these interactions. Additionally. the BOaN of Commissioners has
previously discussed versions of the tlreR ordinance at meetings in November 2000, January
2001, and October 200E and provided further tlireMion to staff. The ordinance has now
progressed to the point where the County is seeking formal public comment priorto further
conslderetion by the BcaN and possible adoption. If the Boertl ultimately adopts the
oNinance, it would be desirable for the Towns to implement the same oNinance within the
municipal boundaries so that the same rules would be applicable throughout the County.
Should Orange County eventually adopt the Regulated Recyclable Materials oNinance, the
County would be at the forefront In the State of North Caroline regeMing management of
construction and tlemolRion waste. Staff notes that Representative Joe HerJcney is sponsoring
aimiler legislation on the State level that would ban caNboaN, clean wood waste and wooden
pallets from being buried in landfills.
FINANCIAL IMPACT: Atlopticn of the oNinance would result in an ohllgalian to develop
recycling fadlitiea et existing County waste management facilities to receive the regulated
materials. Such facilities, equipment and staff would be funded from the Solid WastelLantlfill
Operations enterprise Pond and wouldnol involve any Geneal FUnd expentli[urea. Permit fees,
licensing fees and landfill surcharges would supplement existing tipping fees and reserves to
fund these services. The FV 2001-02 solid waste budget contains funding far the immediate
hiring of a recycling education specialist, following the adopGOn of the ordinance.
RECOMMENDATIONjS): The Manager recommends that the Board receive public wmment
and schedule further consideration of the proposed oNinance al a future Board of
commissioners' meeting.
