HomeMy WebLinkAbout2020-794-E Planning-BBUDC contract amendment 8031 Sandberg LnRevised 07/20 NORTH CAROLINA CONTRACT AMENDMENT ORANGE COUNTY THIS CONTRACT AMENDMENT (“Amendment”) is made and entered into this 4th day of December, 2020 by and between ORANGE COUNTY (hereinafter referred to as “County”) and BBUDC, Inc. (hereinafter referred to as “Provider”). WITNESSETH: THAT WHEREAS, the County and Provider entered into a contract dated October 16, 2020, (hereinafter the “Original Agreement”), for the provision of services for the installation of a private sewer lateral connection at 8031 Sandberg Lane (REF: Orange County RFP Number 367-OC 5297); and WHEREAS, the County and Provider desire to amend the Original Agreement while keeping in effect all terms and conditions of the Original Agreement not inconsistent with the terms and conditions set forth below. NOW THEREFORE, for and in consideration of the mutual covenants and agreements made herein, the parties agree to amend the Original Agreement as follows: 1. The Scope of Work and Basic Services shall be expanded to include all of the “Additional Services Description” as described in Attachment A. 2. The compensation for the additional work included in this Amendment shall be ONE THOUSAND FIFTY DOLLARS ($1,050.00). This compensation amount may be invoiced by the Provider and payable by the County as a single additional invoice. 3. Section 5(a) of the Original Agreement is amended to reflect a maximum payable not-to-exceed amount of FOURTEEN THOUSAND FIVE HUNDRED FIFTY DOLLARS ($14,550.00). 4. Except for the changes made herein, the Original Agreement shall remain in full force and effect to the extent it is not inconsistent with this Amendment. In the event there is a conflict between the terms of the Original Agreement and the terms of this Amendment, this Amendment shall control.
