PURPOSE: To mnsitler approving a resolution that provitles direction to the Greene Tract
Work Group regartling the tlisposition of the remaining 109 scree of [he Greene Tract antl
affirms the BaeN's tlesiretl generel uses of that properly.
BACKGROUND: The solid waste management inteddcal agreement slgnetl by [he County antl
Towns in September 1999 and amendetl in March 20001ays out parameters untler which the
Greene Tract owners will resolve the ultimate tlisposition of the 109 acres of [hat parcel Net
remain in joint ownership. the agreement also adtlresses how [he Solltl Waste/Lantlfill
Operations Enterprise Fund ie to ba reimbursetl if the properly is put to uses that are not relatetl
to Ne solid waste enterprise. The agreement antidpales that tM1e Greene Tract owners will
reach agreement on the tlisposition of the property during a bargaining period the[ woultl
conclutle on April 1l, 2002 (Yhe Iwo year anniversary of the efkctlve tlate upon which Orange
County assumed overall responsibility for solitl waste management in Omnge County).
In May 2001, the BOCG appointetl Commissioners Brown antl Carey to serve on a Greene
Tract work group with two elected officials each from the governing boaMS of Canbom (Jacquie
Giet antl Alex Zaffron)antl Chapel Hill (Kevin FOy and Bill Strom. Following two meetings in
October 2001, [he group spcnspretl a public foram on November 15 to hear tliscueeion among
members of the wmmunity repaking [heir views of how the Greene Tract propery shoultl be
used. In light of Net public input, the Work Group adopted the accompanying resolution on
November 19 recommending that the three governing bpaltls affirm open space, affortlable
housing, antl recreation es [he three general uses for the 109 acres of the Greene Tract that
remain in joint ownership.
Staff have preparetl a proposetl resolution for BOGG adoption Na[ woultl efion [he three
recommentletl general uses, specifically rule out the use of the propery for any solitl waste

managamen[ puryoses, entl woultl direct the Wodc Group to tlevelop a more tletailetl concept
plan for the property for presentation b each cf the three governing boaNS by March 2002.
FINANCIALIMPACT: There is no fnancielimpact associetetl wdh the receipt of ihls uptlate.
However, the County antl Towns will be obligetlto reimburse the Landfill Fund for the otlginal
1984 purchase price of $608,000, plus interest if the Greene Trect is used for purpcses other
than those of the solid waste system.
RECOMMENOATION(5): The Manager recommends that the Boak approve the proposed
resolutbn.
