A scope of work and fee proposal is presented below. 1.0 INTRODUCTION Orange County (County) has requested a proposal to prepare and submit the permit application to construct Phases 2 and 3 of the Eubanks Road C&D Landfill. Draper Aden Associates (DAA) will prepare and submit a permit request to the North Carolina Department of Environmental Quality (NCDEQ) in accordance with Rule .1603(a)(2). Current permit drawings and reports prepared by Draper Aden Associates in 2017 and 2019 will be utilized. Draper Aden Associates will update permit documents needed for the permit submittal and will update drawings based on the recent 2020 topographic survey. The following discussion presents a scope description and a not-to-exceed fee proposal for the work necessary to prepare and submit the permit renewal request. Work will be conducted in accordance with this proposal and the existing contract between Orange County, hereinafter referenced as "County", and Draper Aden Associates, hereinafter referenced as "Engineer". 2.0 BASE SCOPE OF SERVICES 2.1 Permit to Construct Application: DAA will assist the County in preparing and submitting a permit to construct request to the NCDEQ to construct Phases 2 and 3 of the C&D Landfill. The permit request will include the following: DocuSign Envelope ID: D2193F1C-ECD7-4E1F-86D9-499117BF12A2 Robert Williams – PTO for C&D Phase 2 & 3 August 11, 2020 Page 2 of 7 P:\R00\500\R00592\R00592-226N\PROPOSAL-CONTACT\PRO Williams- C&D Ph 2&3 PTC - CTC Jr.docx  Facility Plan to update information regarding waste stream, remaining capacity, and other pertinent data;  Engineering Plan including facility standards, design calculations and technical specifications;  Construction Quality Assurance Plan;  Operations Report including waste screening plan, inspection forms, and monitoring plan;  Closure and Post-Closure Plan: DAA will meet in person or teleconference with NCDEQ to address any review comments that may be received. 2.2 Design/Construction Drawings: DAA will develop a set of permit drawings per the original permit and update to permit drawings to indicate current operational areas and to reflect proposed grading for the construction of Phase 2 and 3. It is assumed the drawings will include the following sheets:  Cover sheet  Existing conditions  Overall Facility Plan  Phase 2 Base Grades  Phase 3 Base Grades  Phase 3 Final Grades  Details 2.3 Design Hydrogeologic Memorandum: DAA will generate a design hydrogeologic memorandum to be attached to the Permit to Construct application. The memorandum will use previous existing field studies and data collected since 1999 for the various permit applications, groundwater monitoring plans, and hydrogeologic studies conducted by DAA and other consultants. No additional filed studies, groundwater readings, borings, or lab testing are to be completed. 2.4 Project Bid Manual and Contract Documents: DAA will prepare a project manual, contract documents, final construction drawings, and technical specifications to be advertised by the County for bids. DAA will finalize the construction drawing set (100% design) by incorporating comments from previous reviews. DAA will incorporate the project special provisions, bid tabulation, and the front-end and standard technical specifications, and will prepare the final bid package project manual. The County will be responsible for cost of advertising and bidding the project. Deliverables will include a project manual (Front End and Technical Specifications) and final construction drawings. 2.5 Bid Administration: DAA will assist the County in advertising the project for bid, assist in conducting a bid opening, evaluate the bids received, and make a recommendation of award to the County. If appropriate, DAA will assist in negotiations with the low bidder. Upon Award of the Bid by the County, DAA will prepare and assist in proper execution of the contract documents, respond to contractors’ questions, provide input for addenda (if required), and provide technical support through the contracting process. DAA will assist the County in obtaining and reviewing construction contract documentation and other preliminary actions through issuance of formal Notice-to-Proceed. 2.6 Construction Services/CQA Inspections: During construction, we will assist the County in administration of the construction agreement between the County and Contractor. We will provide services to include the following:  participation in a pre-construction meeting and other periodic project meetings (typically weekly while site work is ongoing) to review construction progress  issue record of meetings  Implementation of the CQA plan to include: a. site visits to inspect the work including reporting of observations and recommendations regarding suitability of the work and schedule progress b. testing of soils and aggregate as prescribed in the project CQA Plan  review of shop drawings for site-related materials and maintenance of a shop drawing log  interpretations in writing or in the form of supplemental drawings necessary for performance of the work  review of contractor payment applications and recommendations for payment  preparation of change orders and construction change directives  conduct inspections and punch lists as part of final project close-out  request and assemble final written guarantees, affidavits and other contract closeout documents from the Contractor prior to approval of final payment to the Contractor  preparation of as-built, or record drawings based on Contractor mark-ups  Final certification inspection by a PE and PG per NCDEQ rules.  serve as agent of the County as described in the contract documents This proposal is based on an estimated 60 calendar day period of construction activities that require daily oversight or testing. Inspections are assumed to be part time and limited to a maximum 6 hours onsite per day average. Due to the nature of the services under this task, it will be billed on a time and material basis. The Engineer shall incorporate comments received from the County into a final package. The final Permit to Construct application (drawings and reports) shall be submitted to the NCDEQ and a copy shall be submitted to the County. In addition, DAA will prepare final Contract and Construction Documents for use in obtaining bids and for use in construction of the project. 4.0 EXCLUSIONS For services not expressly set forth in writing in this proposed scope, or signed attachments to this proposal, the Engineer assumes no duty to the County to perform such additional services. 5.0 ASSUMPTIONS/CONDITIONS The Scope of Services presented in Section 2.0 is based upon the following assumptions and conditions.  Current topographic mapping performed by DAA in April 2020 will utilized as a basis for design.  The Engineer will respond to NCDEQ comments arising from its initial review. NCDEQ comments that require information beyond the scope of services of this proposal, including requests by NCDEQ for additional information beyond this scope, will be considered additional services.  The base liner system and closure cap design will remain the same as in the current permit. Changes to the liner and cap design may be considered as additional services.  The County will be responsible for any fees paid to regulatory entities.  Local review or permits will not be required. The previous obtained Erosion and Sediment Control Plan approval is still applicable and will not need updating.  Public meetings or hearings are not anticipated. The County will not be invoiced for T&M items below for time not expended or material not utilized. Invoices are issued monthly and are due upon receipt. Standard DAA billing rates shall be used for billing purposes. Depending upon the duration of the project and the contract date, the unit rates used to prepare this estimate may be modified. Prior to any changes in the unit rates, the County will be notified, and the modifications will be approved.
