PURPOSE: To approve the submittal of a petition for voluntary annexation to the Town of
Hillsborough for 12.866 acres of land, buildings and other improvements owned by Orange
County and located at 401 Valley Forge Road, Hillsborough, NC; and upon review by the
County Attorney, authorize the Chair to sign the petition and related documents.
BACKGROUND: The County owns a 12.866 acre property located at 401 Valley Forge Road in
Hillsborough. The property is zoned general commercial and contains a 105,000 square foot
warehouse and distribution facility. The property was acquired in 1997 as the result of the
retirement of revenue bonds owned by the Orange County Industrial Development Corporation.
The property and buildings were subsequently leased to Builders FirstSource, Inc., a Fortune
500 company that is a manufacturer and supplier of building materials. The company is
headquartered in Dallas, Texas and is the largest supplier of building products, prefabricated
components and value-added services in the US.
The 401 Valley Forge Road property is located adjacent to, but just outside of the town limits of
the Town of Hillsborough. All of Valley Forge Road is located within the town limits of
Hillsborough except for a short section leading to this property, which is at the end of a dead
end road. Just before entering the property, a stream crosses underneath Valley Forge Road
though a large culvert. Due to a series of heavy rainfall events, this culvert has washed out
several times, requiring the Town of Hillsborough to perform costly repairs to restore access.
The only beneficiaries of this repair work are the occupants of 401 Valley Forge Road.
Attachment 1 provides a Google map of the area. Attachment 2 provides pictures of the most
recent washout.
The Town of Hillsborough has requested that Orange County initiate a voluntary annexation
request of this property so the town can hope to recoup some of the significant funds being
expended to maintain road access to this property. Attachment 3 is the Annexation Petition
document that will facilitate the request. A survey of the property is provided as Attachment 4.

FINANCIAL IMPACT: There is no financial impact associated with this request.
SOCIAL JUSTICE IMPACT: There is no Orange County Social Justice Goal impact associated
with this request.
ENVIRONMENTAL IMPACT: There is no Orange County Environmental Responsibility Goal
impact associated with this request.
RECOMMENDATION(S): The Manager recommends that the Board
1) Approve the submittal of a petition for voluntary annexation to the Town of Hillsborough
for 12.866 acres of land, buildings and other improvements owned by Orange County
and located at 401 Valley Forge Road, Hillsborough, NC; and
2) Upon review by the County Attorney, authorize the Chair to sign the petition and related
documents.

To the Board of Commissioners of the Town of Hillsborough, North Carolina:
1. As evidenced by the signature of the Chair below,the Orange County Board of Commissioners,
the elected representatives of Orange County,the owner of certain real property referenced
and described herein, respectfully requests that the area described in paragraph 2 be annexed
to the Town of Hillsborough, North Carolina.
2. The area to be annexed is contiguous to the Town of Hillsborough, North Carolina and the
boundaries of such territory are as follow:
Being all of a certain parcel of land situated M' Hillsborough Township, Orange County,
N.C.bounded on the north by Douglas and Kimberly Robins(Deed Book 5088 Page 190
Plat Book 109 Page 194) on the cast by Town of Hillsborough (Deed Book 5495 Page 1.85,
Plat Book 74 Page 127), on the south by Interstate 95 and on the west by Sports Endeavors,
lnc.(Deed Book 1075 Page 382 Plat Book 8 Page 90) and North Carolina Railroad, and
being more particularly described as follows:
Beginning at an existing iron pipe(eip) having NC Grid values of N= 841,342.34 E= 1,972,998.94,
said eip being in the eastern line of Sports Endeavors,Inc. and at the southwest corner of Robins;
thence,with Robins' southern line and crossing Valley Forge Road, S 66°32'37"E 340.80'to a point
in the center line of Cates Creek,Town of Hillsborough's southwest comer; thence,with the Town
of Hillsborough's western line and the center line of Cates Creek for the following sig calls:
S 44010'27"E 64.43'to a point,S 31044'19"E 218.40',to a point S 43°33'59"E 426.64'to a point,

thence,continuing with said Right-of-Way,along a curve to the right having a radius of 2262.69'
